ORDINANCE NO. 2009-28 I AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2009-22, PASSED AND APPROVED OCTOBER 5, 2009, SAME BEING AN ORDINANCE APPROVING AND ADOPTING I THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2009-2010, BY APPROVING `BUDGET AMENDMENT I" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2009-2010"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2009-22, the City Council of the City of Friendswood; Texas, adopted its"Original General Budget for Fiscal Year 2009-2010"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally i economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2009-2010; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2009-2010," is hereby amended for municipal purposes as shown on "Budget Amendment P' to the "Original Budget of the City of Friendswood, Texas, For the Fiscal year 2009-2010" attached hereto. Said Budget Amendment I shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits"A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Appropriate insurance reimbursement for Hurricane Ike damages to Fire Station #3. Revenue was received from the Forest Bend Home Owners' Association in May of 2009. Repairs and renovation of Fire Station #3 are planned to be completed in fiscal year 2010.. 2 Homeland Security Grant, $60,438. Re-appropriate grant awarded funds to the Fire Marshal Emergency Management departmental accounts. The funding will be used in fiscal year 2010 to enhance the Emergency Operation Center (EOC) with audio visual equipment with controls, off-air antenna and weather station. The grant,period expires in February 2010. The grant award notification was accepted by City Council on December 15, 2008. 3 Surface Water Plant#2 Addition, $95,800. Appropriate funds for the expenditures of the ground storage tank addition to surface water plant#2. The project was approved as one of the 2009 water and sewer bonds funded utility projects. The bid for the water plant addition was awarded to LJA Engineering & Surveying, Inc. on November 2, 2009. The funding source for the project was identified as the 2009 water and sewer bond proceeds. 4 Water Plant#6 Rehabilitation, $130,850. Appropriate funds for the expenditures of the rehabilitation and upgrade of water plant#6. The project was approved as one of the 2009 water and sewer bonds funded utility projects. The bid for the water plant addition was awarded to LJA Engineering & Surveying, Inc. on November 2, 2009. The funding source for the project was identified as the 2009 water and sewer bond proceeds. 5 Fire Hydrant Maintenance. $2,260. Appropriate revenue received from TRCU, Ltd. for fire hydrant maintenance at the 16" waterline project. Auditing,,cleaning and painting the fire hydrants located at the project site by the contractor was included in the City's agreement with TRCU, Ltd. The City's Public Works department completed the fire hydrant maintenance service and TRCU, Ltd. reimbursed the City for services rendered. Funds were received in October 2009 and will be applied to the Public Works fire hydrant maintenance account. 6 2009 Fall Haul-A-Day. $263. Appropriate funds generated from the garage sale held during the 2009 Fall Haul-A-Day event. Funds will appropriated to j the Community Appearance Board division of the Community Services i department's operating budget. The event was held on November 7, 2009 and the funds will be used for Stevenson Park beautification. 7 Appropriate Senior Proaram Donations, $4,960. Appropriate funds donated to the Senior Programs. Funds totaling $2,346 donated in fiscal year,, 2009 and unexpended at year end, September 30, 2009 will be re- I appropriated. Funds totaling $2,614 donated in the first month of fiscal year 2010 will be appropriated. Funds will be used for senior program activities and senior program trips. 8 Police Department SWAT Team Vehicle, $42,000. Appropriate funds to purchase and equip a rapid deployment vehicle to be used by the City's Police Department SWAT team. The new vehicle will replace the 1984 refurbished ambulance currently being used by the team. Currently needed repairs are not financially feasible for a 25 year old vehicle. Although the Police Department's budget narrative for 2009-10 included information on replacement of this vehicle, funding was not included in the annual budget. Vehicles are replaced based on the vehicle replacement schedule. This vehicle should have been replaced in 1998 and was removed from the schedule at that time. Therefore, it did not appear as a replacement for fiscal year 2009-10 and funding was not appropriated in the adopted budget. Supplemental appropriation from the vehicle replacement fund is needed to replace the vehicle. 9 Lone Star Library Grant, $1.7,095. Appropriate grant awarded funds to the Friendswood Public Library's departmental expenditure accounts to purchase books, videos, audio books and CD's. The grant period is October 1, 2009 through September 30, 2010.
