Fire Marshal/Emergency Management Coordinator Terry Byrd presented an update on funding the City received from the State of Texas,who made it available to cities, and stated with additional funds from the State of Texas, the City of Friendswood was able to purchase a Hazmat trailer, equipment and radios and further reported on other ways the funds are being used. Discussion was held with Planning and Zoning Commission representatives regarding the Official Zoning Map. Planning and Zoning City Planner Diana Steelquist presented information and stated Staff is preparing an updated Zoning Map. The Zoning Ordinance requires the official zoning map be kept on file in the City Secretary's Office. An official map, even though it has been kept up-to-date with all the zoning changes over the years, has not been officially adopted since 1992. Since that time the format of the map has been changed and there have been numerous zoning changes. The map on hand is not out of date, but since the Zoning Ordinance requires an "official" map to be adopted, it is recommended that an update be provided. Discussion was held with the Planning and Zoning Commission regarding Industrialized Housing. City Pianner Diana Steelquist stated fnat State law has recentiy changed allowing industrialized housing within cities. Unlike Mobile Homes, industrialized housing cannot be restricfed to a particularzoning category,and must be allowed in any Single Family Residential area. Deed restrictions in subdivisions will apply, and can serve to regulate the location of this type housing in a particular area, but the City is required by law to allow them under the Zoning Ordinance. In order to regulate these type houses, the Planning and Zoning Commission has recommended a change in the Building Code. The changes specifically set standards for how the houses will be located in a subdivision, and how ihey will be anchored, as well as requiring similar values and appearances. The amendment to the Building Code will nof require a public hearing, but witl require the adoption of an amendatory ordinance. Council concurred fo proceed with these amendments. 04/19/04 2�4� Cify Manager Ron Cox arrived at this time. Discussion was held with the Planning and Zoning Commission representatives regarding revisions to the Permitted Use Table for Used Car Sales, Amusemen�/Recreation Industries, and to Parking Requirements. City Planner Diana Steelquist presented information regarding Used Car Sales and stated there is now no provision in the Permitted Use Table for used car sales anywhere in the City. This is an oversight in the ordinance. The Planning and Zoning Commission is recommending these be allowed in CSC, OBD and PUD zones within the City, subject to a Specific Use Permit (SUP). You will recall this item was delayed from an earlier meeting since one of the Commissioners expressed some concerns. That issue has been resolved and this recommendation is ready to move forward. AmusemenURecreation - There is a paintball game business operating on Dixie Farm Road, in the City limits of Friendswood. This business was operating in violation of the Zoning Ordinance, as the use was not fisted specifically in the Permitted Use Table {PUT). The business sought and received a variance from the Zoning Board of Adjustment and Appeais;ZBOA), but iike used car sales; the use is noi fisted in ihe PUT. i nis amendment piaces ihai use witnin the Light Industrial and Industrial Zoning Districts with a Specific Use Permit. Parking Requirements - Parking requirements for certain uses have recently been the subject of some discussion, particularly for mini- warehouselstorage uses. The specific recommendation is to allow flexibility in determining parking requirements by amending the PUT parking requirements to read "to be determined" and letting Staff negotiate the needs on a case-by-case basis. Cluster Homes—Council met in a Work Session with the Planning and Zoning Commission on this issue on December 1, 2003. At that time, the Planning and Zoning Commission was recommending that the density for Cluster Home developments be increased significantly. The Council expressed concern that since the recommendations did not lirnit developments in size, very large acreage developments could be rezoned fo this category, significantly increasing overall residential density within the city. It was referred back to Planning and Zoning Commission for further discussion. Planning and Zoning Commission and Staff worked together to develop a matrix for cluster home developments that would decrease density allowed as the size of the property increases. This change is designed to allow smaller tracts to increase the density, and create open space at a higher rate than on larger tracts. A chart was presented showing the impact. A question and answer session was held regarding safeguards built. in, rules and regulations, may need to address potentially large developments, can a guarantee for the developer be built in, could this be a zone rather than by specific use, the City has every obligation to look at the projects carefully. Council would like the opportunity to review but move forward. The information presentation regarding Lega► Non-Conforming Uses will be rescheduled until the next Workshop. The Special Session was adjourned at 6:33 PM. 7:00 PM — REGULAR SESSION The Invocation was given by Pastor Joe Roher from Friendswood Friends Church. Mayor Brizendine led the Pledge of Allegiance to the United Sfates and to the State of Texas. 04/19/04 2146 COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Officer Dement provided a brief overview of the DARE Program and a presentation was made to the DARE Essay Winners from Bales, Windsong and Wedgewood area schools. The essay winners read their essays and their names are Taylor Farrington from Bales Intermediate, Clair Horne from Windsong Intermediate and Eric Alexander from Wedgewood Elemenfary. Each winner read their essays and received standing ovations. The Mayor presented a Proclamation to Marjorie Hoffman for the month of April as Child Abuse Month. COMMUNICATIONS FROM THE PUBLIC Ron Smith, 906 Nottingham Way, addressed Council and stafed he was surprised to learn through the City newsletter that the City does not have Ordinances that regulate scooters, is concerned with safety ard esaecialfy chsfdrer�'s safety, ihere is a safety concern regarding smaii gas scooiers,concerned with speeding, lack of control and driving in other people's yards, may be law but should be parental responsibility,concerned witli safety issues, to protect children around or on vehicles, children do not have licenses, no insurance, no inspection, they may be operated on a street if under 35 mph, on sidewalks. Children do not have control and � expressed concern for their safety. Mayor Brizendine referred her to the City Manager to respond. COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS Mayor Brizendine recognized Communify Appearance Board member Kaye Corey for her years of service to .. the Community Appearance Board and this City. Judy Kimbail, Chair of the Community Appearance Board, introduced committee members Sara Betterton, Kaye Corey, Denise Nobles, 8renda Erfurdt, Judy Zavalla, Patricia Steinke,Susie Westphal,Judy Kimball and Madonna Crame and gave the annual report on the status and activities of this board. She reported on the tree giveaway in which they gave away 1700 trees, gave landscaping award to the Shell Station on FM 518 and FM 2351, reported on the colorful banners along FM 518,and reported the Community Appearance Board is currently working to expand the banners to FM 528 and FM 2351, looking at patriotic banners for4'h of July, continuing to monitor sprinkling system and landscaping, funded landscaping around the sign of the proposed Public Safety Department building on FM 528, Grant Program is in place to encourage landscaping for business, Tree Preservation Ordinance committee continues to participate, reviewing the use of pervious cement; looking at eco-tourism,adopt-a-spot and introduced Councilmember Laura Ewing who is the liaison to this Board, who provided a report on the Spring Sparkle and Fall Haul-a-Day. Mayor Brizendine thanked the Community Appearance Board for their work and looks forward to having a Workshop to discuss some projects with this Board. Ciiy Manager Ron Cox made a special presentation of the Five Star Award for the First Quarter of 2004 fo Jose"I nez"Garcia, Equipment Operator, Water Deparfinent, Public Works. Jose is known by his friends and fellow co-workers as"Ines". He has been recognized wifh his 25-year anniversary piri from the City and is an 04/19/04 2147 employee in the Water and Sewer Department of Public Works. Jose was nominated by a fellow employee wanting to recognize him for stepping up to assist in the overall operation of the department following the deafh of a fellow employee. Jose has taken on extra responsibilities and is a great asset to the department. Jose exhibits all the attributes of the Five Star Award in filling in while a new supervisor was being selected, and in helping to heal the wounds that were created by their loss. We thank Jose for his spirit and willingness to help his fellow employees in a time of need. City Manager Ron Cox presented a Certificate of Achievement for Excellence in Financial Reporting for2002 to Roger Roecker and Cindy Edge who accepted on behalf of the City and Staff. RESOLUTIOPV *'�Councilmember Goza moved to approve Resolution No. R2004-07—A Resolution of the City Council of the City of Friendswood, Texas, amending the City's Major Thoroughfare Pian io provide for the extension of Blackhawk Boulevard from Beamer Road to Bay Area Boulevard. Seconded by Councilmember Smith. The motion was approved unanimously. Councilmember Measeles stated he would like to recognize the Fire Department for handling a house fire across from his home and to watch them in action, he has a deeper appreciation. Councilmember Kimmel reported on the Friendswood Legends Golf Tournament honoring Mike Dorian, raised $40,000 to Friendswood Independent School District Foundation and to MD Anderson, thanked everyone involved includina the Mayor and Councilmember Ewing who oa.rf_icioated. CQUncilmemher Kimmel sta±ed he would fike to pass on to Kaz Hamidian in Public Works a thanks for doing such a greatjob and would like to personally thank and commend Mayor and Council for not getting involved politically. Councilmember Smith reported he would like to remind everyone of the upcoming.Concerts in the Park which begins at the end of the month, attended a Workshop held with the Planning and Zoning Commission and complimented Staff for a job well done. Councilmember Goza reported on the Friendswood Community Prayer Breakfast at the Church of Christ. Councilmember Ericsson recognized the anniversary of Waco and Columbine, is very comforted by the Emergency Management antl the Police Chief whose military background fits well, commented on a neighbor city that does not do things well and noted the things that we do well, may be time to refocus on that higher path, the .Houston-Galveston Area Council meeting is tomorrow, is chairing the audit committee, has a meeting wifh Bay Area Economic Development Partnership regarding the Keep It Sold Program in Washington will be a grass roots group attending along with other states, also will work on the Ellington Program while in Washington. Councilmember Ewing reported she attended a meeting of the Senior Citizens Advisory Committee, has a trophy displayed from the Councii bowling get-together, Friday is the Relay for Life Cancer for Friendswood Team, will walk from 6:00 pm to 6:00 am, Special Legislative Session begins tomorrow on school taxes. Mayor Brizendine talked about Whifaker Drive and the planned dedication at a later date in honor of past Mayor Harold Whitaker, remembered Councilmember Goza's wife Kim who had surgery and hope she continues to do well, met with Pasadena Mayor Manlove and attended that Mayor's State of the City Address, Galveston County does not have a Hazardous Waste Reclamation site and has visited with the County leaders _ and they support fhis idea and will work moving fhis forvvard, attended the League City Special Meeting,went to support that Mayor and Council during this trying time, need this City leadership to be strong, have a strong 04/19/04 2148 relationship and partnership, they are important to Friendswood, offered encouragement to move on to higher ground, made him very proud of our City Manager, City Secretary and Council for their conduct during open meetings and stated he is very proud to be a part of this Council. CONSENT AGENDA *"Councilmember Measeles moved to approve the Consent Agenda as presented. A. Payment of Capital Projects- 1. Centennial Park Phase II Architectural with payment in the amount of$10,320.46 to Hall Barnum Lucchesi Architects for architectural services. To date, 88 percent of the contract has been expended. 2. AnnalealKingspark/Whitehall Drainage with payment in the amount of$4,795.00 to C. L. Davis&Company for surveying services. To date, 100 percent of the contract has been expended. 3. Whitaker Drive Engineering with paymenf in the amount of$5,720.00 to DeAnda Engineering, Inc.,for preparation of construction plans for 600 L.F. Roadway, south of FM 528. To date, 67 percent of the contract has �een expended. 4. Longwood Fark VJater/Sewer Conversion wiih payment in the amount of $69,250.75 less $3,462.54 withheld for retainage fo Pennstar, Inc.,for construction services. To date, 86 percent of the contract has 6een expended. 5. 2003-04 Asphalt Street program wifh payment in the amount of$11,551.15 less retainage in the amount of $577.56 to Main Lane Industries for construction services. To date, 46 percent of the contract has been expended. Total payments were$97,597.26. B.Award of Bid No.2004-04 and approval of Contract to Brandt Construction, LLC for the Consfruction of Whitaker Drive for the new Public Safety Building located on FM 528 South. C. Approve Cost Sharing Agreement with Galveston County Consolidated Drainage District for the construction of Whitaker Drive and Public Improvements for the new Public Safety Building on FM 528.
