MINUTES OF A REGULAR MEETING OF THE FRIENDSWDOD CITY COUNCIL THAT WAS HELD ON
MONDAY, FEBRUARY 2,2004AT 5:00 PM AT FRIENDSWOOD CITY HALL COUNCIL CHAMBERS, 910 S.

Mayor Brizendine called the meeting to order.
Mayor Brizendine and City Council surprised City Secretary Deloris McKenzie on her 20-year anniversary,
toasted and roasted her and presented her with a beautiful bouquet of flowers and a card. City Secretary,
Deloris McKenzie commented that these 20 years have been a blessing and an educational experience.
5:00 PM —WORK SESSION '
Discussion was held regarding medians, left turn bays and traffic controi modifications to FM 2351. Deputy
Director of Community Development Dan Johnson presented a PowerPoint presentation with maps showing
�-- traffic flows and discussed the proposed 18 conflicts 50% improvement for two changes, right turn on Pecan
and left turn on Cherry Tree Lane, a question and answer session followed, discussed signage, City and
TxD�T, consolidate driveways near Melody Lane, accidents report, existing driveways, Phase 1 being
Woodland Trail, Phase 2 being Pecan Street and Phase 3 being Driveway Consolidation near Melody Lane, .
Council discussed Phase 1 and 2 can move along pretty aggressively and Phase 3 will take some additional
work and another Workshop. The Community Development Department would like to monitor accidents and
report back in 6 months. �
Mayor Brizendine announced that the discussion that was to be held regarding interim measures for tree
preservation would be pulled from the agenda this-evening to allow the Tree Preservation Super Sub-
Committee to work on the information that has been received.
7:00 PM — REGULAR SESSION
The (nvocation was given by Pastor David Ruzicka from Crossroads Community Church.
Mayor Brizendine led the Pledge of Allegiance to the United States and to the State of Texas.
JOINT DOCKETED PUBLIC HEARING
Mayor Brizendine and Chair of the Planning and Zoning Commission Bob Bertrand called a Joint Docketed

Public Hearing to order to receive comments from the public, either oral or written, regarding changes to the
Subdivision Ordinance for Amended Plat approval process.
No one spoke for or against.
Hearing no further comments, the Joint Docketed Pubiic Hearing was closed. -�
COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS
Councilmember Ewing reported that the Community Appearance Board Sub-Committee met regarding the
Tree Ordinance, set goals to continue,Arbor Day was very successful, 1700 trees were given away, March 17
is the Spring Sparkle Clean-up Day, reported on the Chamber of Commerce dinner, Library Board Advisory
meeting, they are excited about new carpet and looking at an expansion plan and spring plans, the Fourth of
July Steering Committee met regarding the parade.
Councilmember Ericsson reported on the Academic Decathlon, the Chamber of Commerce dinner was a
great event, Houston-Galveston Area Council meeting and Committee Meeting on water issues and flood
mitigation.
Councilmember Goza reported that he attended the same Chamber of Commerce Banquet, February 5 Mayor
Brizendine will give the State of the City Address and thanked City Secretary Deloris McKenzie for her 20
years of service and stated he was in the 4�h grade when she became City Secretary for the City of
Fi iendswood.
Councilmember Smith reported on the Homeowner's Association Liaison Pines of Wilderness Trails and about
the Liaison position and all that is available, tap into resources, attended the Community Prayer Breakfast
Tuesday morning at 6:00 AM at Friendswood High School, over 100 athletes attended with some giving
testimony, Majority Leader Tom DeLay was recently in Hitchcock and some community leaders attended.
Councilmember Kimmel stated he had no report.
Councilmember Measeles reported on the Clear Lake Area Council of Cities meeting where Fire Marshal -�-�
Terry Byrd was the speaker, talked about storm-ready community, Friendswood is the only one in this area
designated and thanked him for a very good program.
Mayor Brizendine attended the S.E. Church of ChrisYs 9:00 AM and 11:00 AM service and said a few words
about Pastor Frey retiring after 40 years of service, was a real pleasure and was well attended. The
Windsong and Sunmeadow Drainage Improvemenfi Project have had good meetings and very fruitful,
expressed his regret about the incident at Clear Brook High School, very proud of our Police Department for
their offer of service to that,will be unable to attend the unveiling ceremony of the commemorative painting by
Laurie Whitehead of the Columbia Shuttle, the unveiling ceremony is Friday evening at South Shore Harbour,
State Representative Larry Taylor will attend in his stead and wili introduce Ms. Whitehead and make some
brief statements.
COMMUNICAT{ONS FROM THE PUBLIC
Fred Krch, 209 Dawn, addressed Council and stated he would like to present information to Council on
Windemere Park Lake and requested a written response.
Mayor Brizendine requested to allow Council to review and come back at a later time.

Ray Racca, 505 Providence in Heritage Estates, addressed Council regarding the proposed Tree Ordinance
and it being in residential areas, totally objects to residentiai areas being involved in the ordinance, the City
shouid have caught if 100-year old trees were being cut down.
—�� The Mayor commented that this was referred to a committee.
Don Beeth, 5303 Whittier Oaks, presented written information and comments to Council regarding trees and
property rights.
Joe DeBonis, 418 Oak Vista Drive, congratulated Mayor and Council for their service, the tree ordinance
review process and nofification process, stated after owner of a property for 40-50 years selis to developer
what can you expect to happen.
Mayor stated there will be plenty of opporiunity for citizens to have input and there should be no surprises to
anyone.
COMMUNICATIONS FROM COMMITTEES AND SPECIAL F:EPORTS
Chair Bob Bertrand of the Planning and Zoning Commission reported they recently conducted their first
planning retreat and discussed the goals and objectives set from that retreat, among other items, in a
presentation. He asked for Council's indulgence to allow the committee to review his written report for
submittal. Presented information on committee accomplishments and training opqortunities and would
strongly suggest Mayor and Council and Economic Qevelopment attend some of this training as well, very
involved with the Tree Ordinance and three members serve on the Super Sub=Committee of the Tree
Ordinance and commit his efforts towards that effort, reported on retreat, goals are to reach out, goal to
Council is to find time to have a general workshop with Planning and Zoning, thanked City for providing
excelient Staff and hope City would recognize their hard work and efforts, how to get more people to attend,
invite everyone.
City Manager Ron Cox made a special presentation of the Five Star Award for the Fourth Quarter of 2003 to
---- Karen Keesler, Account Clerk with the Administrative Services Department. Karen received several
nominations commending her work and dedication to helping others, making her a great candidate for the
fourth and final award of 2003. Before coming to work for Friendswood, Karen was employed through the
Kroger Corporation. On August 8, 1997, Karen was hired by the City as a Central Cashier in the
Administrative Services Department. Since her employment with Friendswood, she has received several
promotions and is now a key asset in Accounting as an Accounting Assistant. Along with her dedication to her
work, she is also dedicated to the Weliness Program,to which she has recruited a few City employees to join
as weil. Karen has one son, and has taken up stained glass making as a hobby. Karen has been described
by her friends as a special person who loves herjob, gives good advice, and has an excellent work ethic. We
appreciate Karen's dedication to her co-workers, and her position. There is no question that Karen is a
shining examp.le of exceilence and five star spirit.
CITY MANAGER'S REPORT
The City of Friendswood Emergency Management anci Public Safety Staffs have been very active over the last
two years developing a program for homeland security. In fact, Friendswood had a plan for dealing with
Weapons of Mass Destruction (WMD) before the tragedy of September 11, 2001. As a result of our own
preparedness,the City tias received$183,000(2002-$46,000 and 2003-$137,000)in federal funds in the last
two years for these purposes. These funds have gone to purchase HazMat and WMD equipment and for
conducting assessments and plans for personnel to respond to disaster situations. For 2004, Friendswood is

in line to receive ad.ditional amounts of federal funds through Houston—Galveston Area Council(HGAC), our
regional planning commission. Friendswood will receive a grant of $69,267 for additional equipment to
respond to hazardous situations in our county. Friendswood has been designated as a second tier responder
in our region, with first tier responders being Houston, Baytown and Harris County. With this responsibility
comes funding for additional equipment and training. Galveston Gounty has been allocated about$222,686
for their use and for distribution to other agencies within the county. We have applied for$30,000 of those
funds to supplement our communications system, to be able to better communicate with other law
enforcement and emergency management agencies in our area. And,finally,we will be making application of
other discretionary monies that may be available this year: Once again our preparedness is paving the way for
funding. But with this preparedness and additional funding comes responsibility to train, be proactive, and
respond where called upon. Our emergency managernent, police and fire personnel are committed to accept
that responsibility in all these areas. in order to provide more detail on this we will be scheduling a work
session in the near future.

*'`Councilmember Measeles moved to approve the Second and Final readinq of Ordinance No.T2004-01,an
Ordinance of the City of Friendswood, Texas, amending Ordinance No. 84-15, said Ordinance No. 84-15
being the Zoning Ordinance of the City, and amending Ordinance No. 2000-7, said Ordinance granting a
Specific Use Permit to David Offenburger to ailow Office Uses on a 0.3587 acre tract of land out of lot 21 of
the Hoidale and Coffman Subdivision out of the Perry and Austin League Abstract No.2 in Galveston County,
Texas, located at 402 E. Edgewood within the City of Friendswood; by amending said Specific Use Permit by
allowing the use of the land for Professional, Medical, Dentai, and Optometry Uses, and imposing certain
conditions; providing for the amendment of the Official Zoning Map; providing a penalty in an amount not to
exceed $2,000 for each day of violation of any provision hereof; and providing for severability.
Seconded by Councilmember Smith. The motion was approved unanimously.

amending City of Friendswood, Texas, Ordinance No.2000-01,as amended,originaliy adopted the 17`h day of
December, 2000, being Appendix B of the Friendswood City Code, and being an Ordinance providing Rules
and Regulations governing plats and the subdivision of land, by striking ali of Paragraph 1 of Subsection g of
Section II thereof and substituting therefore a new Paragraph I of Subsection g, by striking all of paragraph 3
other than Sub Paragraph (g)through (j)of Section 2 thereof substituting therefore a new Paragraph 3 of Sub-
Section (g); authorizing the City Manager or his designee to approve amending plats; providing a penalty of an
amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability.
Seconded by Counciimember Measeles. The mofion was approved unanimously.
'""Councilmember Smith moved to approve the First reading of Ordinance No.T2004-05,an Ordinance of the
City of Friendswood, Texas, amending Ordinance No. 96-5 (Zoning Specific Use Permit of Office Building
purposes), by granting to Irish Green Office Park inc., Phase II, an amended Specific Use Permit to allow an
increase in the amount of building space that may be used for sales/retail uses from 30%to 40%, and to add
certain uses as permitted uses, for the development located on Lots 2 and 3, Block 1, Melody Plaza
Subdivision; providing for the amendment of the Official Zoning Map; providing a penalty in an amount not to
exceed $2,000 for each day of violation of any provision hereof; and providing for severability.

CONSENT AGENDA

Projects—1. Public Safety Building-Phase I with payment in the amount of$12,000.00 to Vaughn Construction
for architectural services. To date, 8 percent of the contract has been expended. 2. Sunmeadow Drainage
Project Engineering with payment in the amount of $6,154.50 to Claunch & Miller, Inc., for engineering
services. To date, 59 percent of the contract has been expended. 3. Friendswood Link Road Engineering
with payment in the amount of $6,107.79 to Claunch & Miller, Inc., for engineering services. TxDOT will
reim�burse the City$4,814.23 of this payment. To date, 55 percent of the contract has been expended. 4.
Brittany Bay Blvd. Extension Engineering with payment in the amount of$569.44 to Freese and Nichols, Inc.,
for engineering services. To date, .87 percent of the contract has been expended. 5. Friendswood
Link/Whittier Oaks Force Main with payment in the amount of $162,255.88 to Fox and Bubela, Inc. for
appraisal services in the amount of$1,200. To date, 100 percent of the contract has been expended. With
payment in the amount of$169,532.50 less retainage in the amount of$8,476.63 to Troy Construction, LLP,
for construction ser.vices. To date, 94 percent of the contract has been expended. 6. Annelea, Whitehall,
Kingspark Drainage with payment in the amount of$22,475.77 to Lockwood, Andrews & Newman, Inc. for
engineering services. To date, 24 percent of the c:ontract has been expended. Total payments were
$209,473.38. B. Disposition of Bid No. 2004-02 for the 2004 Water/Sewer Supplies. C. Accept Utility
Easement from Harris County Flood Control District for Whittier Oaks Force Main. D.Accept Easement from
