MINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD CITY COUNCIL THAT WAS HELD ON

Council convened into Executive Session in accordance wrth the Texas Government Code, pursuant to
Section 551.072— Deliberation regarding Real Property.
Council re-convened inta Regular Session at 7:OO.pm with n� action taken. .

The Invocation was given by Associate Pasfor Charlie Quiroz from Caivary Chapel.
Mayor Whitaker led the Pfedge of Allegiance to the United SYates and to the State of Texas.

Mayor Whitaker and Cha�r of tl�e Planning and Zoning Commission Bob Bertrand called a Joint Docketed
Public Hearing to order to receive comments from the public, either oral or written, regarding a request for a
zone classification change for 2.04 acres at#8 Queens La�ne in Galveston County,Texas,from Single
Family Residential (SFR,} fo Planned Unif Devefopment(PUD).
John Jolly, 2015 Aberdeer� Drive, stated fhat he is the son-in-law of the landowner, Mr. LaCabe, and wants to
divide this land and build tvvo single-family homes for he and fiis father-in-law who has owned the land since
1987, the land is an undeveloped !ot wifh a drainage easement, he wili build a private road for access, there is
access to the easement, and I�as spoken to fhe City of Friendswood Fire Marshal's office regarding
emerqencv services for this area.

Charles Michael, 211 Stanley.Court, abufs the pr;operty Mr. Jollywants to subdivide. �"he land has been zoned
Single Family Residential for years and should :stay that way, there is building goir�g on nearby which has
harmed drainage and this would add to the problem. He is againsf the proposed r�quest.
Doris I-ieard, 204 Stanley Courf, lives near this land and stated that there are floodinq and drainage problems,
neari�y Mary Queen Catholic Church was suppased to ha:ve a detention pond wheri they made additions to
their building and they do not. She is against tf�e proposed request.
�aul Street, 3 Queens Lane, stated he was there fo only comment about the volume of traffic on Cedar Oaks
Ct. Road and Mary C�ueen Catholic Church area and it cannot take much more of a volume of traffic and he is �--'
neither for or against this zone change.
To receive comments from the public, either ora6 or writteri, regarding a request for 2i Specific Use Permit—
Residential for 2.04 acres at#8 Queens Lan� in Galveston County, Texas.
City Attorney John Olson stated that it was not nECessary to make the same commer�fs again since they were
related to the same properties

Mayor Whital<er reported that City Secretary Deloris McN<enzie was not afi tonight"s i�eeting because her
husband had surgery bul that he was doing well and had gotten a good report.
Councilmember Kitten Brizendine reported that she attended the Rotary Club's Rewerse Draw.
Councilmember Ericsson reported that he and :Mayor Pro-Tem Goza presenfed a proclamation to Nicole
O'Brian, a Friendswood resident who was in the recent Miss USA contest. I-le furtl�er reported she placed
second runner-up in the centest and fhe citizen� of Friendswood should be proud.
Mayor Pro-Tem Goza reported he attended a Co:uncil Election Candidate training se;ssion last week given by
City Secretary, Deloris McKenzie, and it was.v�ry informative, Saturday attended� the Friendswood Little
League Opening Day ceremonies, everyone sho,uld see the Challenger League which is made up of kids with
disabilifies which was a neat experience.
Councilmember Kim Brizendine reporEed he attended the Community Prayer Breakfast, Community - -
Appearance Board meeting, Friendswood Volunteer Fire Department and EMS rneeting, Rotary Reverse
Draw, Spring Sparkle and attended two senior c'itizens evenfs at Stevenson Park. .
Councilmember Kimmel reported that he attenc�ed KidFish and hats off to Community Services Director Jon
Branson and also attended the Planning and Zoning meeting. •
Councilmember Measeles reported that he is th�e liaison to Friendswood Indepenclent School District and
recently attended a joint meeting in which relocafing the FFA site was discussed a�nd the possibility of the
Drainage District donating land for this, attended the Harris County Mayor & Couni�il Associatio� meeting,
attended a Galveston County Drainage District meeting where it was announceci that the new General
Manager for the Drainage District is James Phipps, attended tlie Texas Municipal L€�ague Region 14 Spring
meeting on April 3�d vdhere an FBI person was the speaker with the topic being terrorism, next Monday he will
go to Austin to see what legislature is doing and is concerned fhat some bills are tal�ing away rights of cities

and the City of Friendswood. ,
Mayor Whitaf<er reported that he attended Opening Day ceremonies for the Friendswood Little League,
commended Communify,`3ervices Director Jon Branson ior a good job and parents thanked the City for their
efforts in purchasing the ?portspark. .

COMMUNICATION FROkN COMMITTEES AND SPECIAL F'�EPORTS
Jon Branson gave a Powe�rPoint presentation of the annual re�nort for the Parks and Recreation Board,which
was prepared by Chair, Stuart Williams,who could not attend ithe meeting. He reported on the purpose of the .
Board, budget requests for 2003/2004, reported on the indivi.dual benefits, values of recreation, comrriunity
benefits, economic benefi�s, important issues such as Centenriial Park development; recominendations such
as moving ahead with Ph��se II and III and to hire Hall, Barnurr� & Lucchesi Architects for design services for
the remaining phases, presented a master plan for CentenniaU Park, basketball pavilion, restroom/concession
�icnic pavilion, amphitheafre, and a funding proposal to comp�lete construction.
CITY MANAGER'S REPORT
The City Council recently authorized participation in the nev;�ly developed Network Early Warning System
(NEWS). , Congressman Tom DeLay has assisted Harris �Counfy in receiving a grant for $1 million to
ii�nplemenf this system.
The system is now operafional, and its name has been changed to the Neighborhood Early Warning Systei�n,
with the same acronyir�of NEWS. This system will supplemeu�t the First Call telephone alert system the City
has had since 2000 fund�d through Galveston County.
Tl�e FY2002-03 City Budget contains funding in the Ec�nomic Development Budget for developing
informational/educational material. This budgeted item's pu�rpose is two-fold: 1) to better inform potential
businesses and brokers af the ready position of FriendswoocJ for locating a prospective business, and 2) to
better educate and inforrri the residents of the need tor economic development and business placements.
Currently $20,000 is budg.eted for that purpose.
The City has been in di:scussion with Griffin Infegrated NJarketing, a consulting firm that has worlced
extensively with the Clear Lake Area Economic Development Foundation, NASA Jol�nson Space Center,
NASA Kennedy Space (;ent�r, and other economic development organizations. This company was
responsible for working with CLAEDF in determining their new logo and"brand"to use internationally. Gwen
Griffin has made a series of presentations to both the staff andi the members of the Community and Economic
Development Commitfee�CEDC) over her proposals for pro�iding this education and information. She has
developed a contract with a budget that the City has now sign�d. Griffin Markefing will provide monthly written
reports on �heir work and progress.
This is an important step For fhe City's economic developmenf program. Time has been spent on planning
what is needed. Time ha�> been spent amending fhe City's ordinances and procedures to make it easier for
the �ypes of businesses d;esired to be here and to actually c�me, Incentive packages have been created,
including budgeting for c�sh grants, 'to encourage busines�es to come. Now the Ci.ty needs io ieli ihe

businesses, in a concerted, organized effort who�the City is,why they need to come to Friendswood, and what
the City has available to get them here. This co:ntract will help to accomplish that final task.

Nichols for preliminary engineering services for�the Shadowbend/VVoodlawn Street and Drainage Project.
Seconded by Councilmember Kitten Brizendine. The motion was approved unanirraously.
**Councilmember Goza moved to approve actiom regarding a Contractwith Claunch<�nd Millerforengineering
and environment assessment services for the vuidening of Friendswood Link RoadlWhisp�ring Pines. -
Seconded by Counc:ilmember Ericsson. The motion was approved unanimously,
RESOLUTIONS
**Councilmember Kitten Brizendine moved to approve Resolution No. R2003-21 - A Resolution of the City .
Council of the City of Friendswood, Texas to approve Interlocal Agreement with thE� City of Alvin, Texas for �
provision of Water and Sewer Services.
Seconded by Councilmember Measeles. The rmotion was approved unanimously.
ORDINANCES
**Councilmember Goza moved to approve th� First and Final reading of Or�din<�nce No. T2003-03, an
Ordinance approving an Agreementwith State ofTexas for traffic signals and/or lighfing at various location on
FM 518, providing for the approval of the Agreement dated April 7, 2003 between th�=State of Texas and the
City of Friendswood, Texas, for the installation, construction, existence, use, operakion and maintenance of
highway traffic signals and/or lighting located at FM 518 at Country Lane and FM 518 at Chelsea Lane/Dunbar
Estates Drive, Eastbound/Southbound/Westbouind, as shown on Exhibit 1, attached hereto and made a part
hereof, in the City ef Frierds::�ood; pro��iding for the execution of said agreer�nent; and declaring an
ernergency.
Seconded by Councilmember Kim Brizendine. �The motion was approved unanimausly.
'`*Councilmember Kiften Brizendine moved to approve, with amendment to.d�lete Section 5 of the
Ordinance, the First reading of Ordinance Number T2003-04,an Ordinance granting a Specific Use Permit for
certain land in the City of Friendswood for use as a Private School, granting a Specific Use Permit applicable
to certain property locafed off of West Bay Area Boulevard, Harris County, Friendswoc�d,Texas,same being a �� �
nine (9) acre tracf of land ouf of restricted Reserue"A", Autumn Creek Subdivisio.n, SE�ction 9,within the City of
Friendswood, for use as a Private School; providiing for the amendmenf of the Zoning Uistrict Map of fhe City
as adopted by Ordinance No. 84-15, The Zoning Ordinance of the City; confaining other provisions relating to
the subject; providing a penalty; and providing for severability.
Seconded by Councilmember Kim Brizendine. �The motion was approved unanimously.

Ordinance amending the False Fire and Burglar Alarm Ordinance to make a viol�ation thereof a Class C
Misdemeanor and imposing a fine for violatiori thereof, amending the Code of �rdinance of the City of
Friendswood, Texas, by striking portions of Arti�le V of Chapter 54 thereof; making, excessive false alarms
thereunder a Class C misdemeanor and providing a fine for violatioh thereof; �,roviding for definitions;
providing for severability; and repealing all ordinances or parts of ordinances inconisistent herewith.
Seconded by Councilmember Ericsson. The mation was approved unanimously.

and confirm $10,000 payl�nent on March 31, 2003 for materials. B. Final payment of$14,964,23 to Great
Southern Borders, L.L.C., for construction services. Total payments are$24,964.23. To date, 100 percentof
the contract has been expended. 2, Lighting System-Renwick Park with payment in the amount of$31,248.00
to Instrumentation and Electricai Specialists, L.L.C., for con��truction services. To date, 62 percent of the
contract has been exper�ded. 3. San Joaquin Gravity Sanitary Sewer with payment in the amount of
