FRIENDSWOOD DRIVE, FRIENDSWOOD,TEXAS,UVITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR HAROLD WHITAKER - MAYOR-PRO-TEM . TRACY GOZA COUNCILMEMBER KITTEN BRIZENDINE COUNCILMEMBER JERRY ERICSSON COUNCILMEMBER KIM BRIZENDINE COUNCILMEMBER SHANNON�KIMMEL (left at 7:00 pm) � COUNCILMEMBER MEL MEASELES CITYATTORNEY LOREN SMITH (arr. at7;00 pm) CI7Y MANAGER RON COX CITY SECRETARY DELORIS MCKEIV7_IE Mayor Whitaker called the meeting to order. • SPECIAL SESSION Discussion was held reyarding the Clear Creek Flcod Confirol Project Federai Budget Issue. Mayor Whitaker gave a brief overview and City Manager Ron Cox.provided an update from the meeting with Congressman Toir� Delay in Pearland, discussed funding opportunities, a question and answer session followed with Mayor and Council, the City needs to develop and promote allies to support the Clear Creek project, gave project status, and reviewed an ��nimated flood scenario, LiDAR study, of the Galveston County area of Friendswood ' and the Pearland watershed area of Clear Creek which will demonstrate 100 year flood in this area. Discussion was held to hold a meeting at a later date on local detention projects and tributaries and review the Dannenbaum study on regional retention. Discussion was held regarding Council requesting Galveston County Mayors and Councilmen's Association and Clear Lake Council of Cities fio adopt a resolution of support for the Clear Creek project. Later in the agenda there is a resolution of support for Council's consideration. There is also a sample letter for homeowners (both individuals and associations) to send to their Congressman and understands that letters are already being sent. CXEGUTIVE SESSION Council convened into E=xecutive Session in accordance with the Texas Government Code, pursuant to Section 551.074, discussion regarding personnel matters. Councilrnember Kimmel left at this time. Council re-convened info Regular Session at 7:00 pm wifih action taken later in the agenda. REGULAR SESSION The Invocaiion was given by Pastor Roy SI<eeter from Friendswood Friends Church. 03/03/03 1988 Mayor�Nhitaker led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATIONS FROM�THE MAYOR AN�D COUNCILMEMBERS ' . Mayor Whitaker reported he atterded the Frierdswood lndependent School District meeting last Thursday and discussed their financial bind, the problems they are facing, and school financing, attended a coalition meeting last Friday of local entities with Congressman Tom DeLay, who represents Pearland regarding the Clear Creek project. Discussion was held regarding the background on the Corps of Engineers project and the need to restore funding and felt that it was a successful meeting. Ne further reported th�t a City employee was , _ . killed over the weekend and prayers and thoughts go out to the family.in this time of grief. Councilmember Kitten Brizendine reported on several communications received by the Citywifh one being Mr. Gadd commending Fire Chief Smith and also announced a Resolution that was received from Texas . Municipal Clerk's Association recognizing City Secretary Deloris McKenzie with a special recognition fior serving on the Sfate Open Records Steering Cammittee: � � Councilmember Ericsson reminded everyone of the Houston Galveston Area Gouncil's annual meeting on March 315f and that reservations are necessary, attended The Park Subdivision Homeowners Association meeting, reported that the City has sample letters to send 10 support the Clear Cr�ek Project F�mding and that letters of support are needed. Councilmember Kirri Brizendine reported he attended the Eagle Lakes Subdivision Homeowners Association meeting, Wedgewood Village Subdivision Homeowners Association meeting, and Main Street I,mplementation Task Force meeting. Councilmember Goza had no report, Councifinember Measeles nad no report. • COMMUMCATIONS FROM THE PUBL.IC Robin Hall, 1803 Vaquero, appeared before Council and stafed that she has been a resident of Friendswood for seven years, her husband graduated from Friendswood Independent Schooi Distr�ct, they are members of the Lutheran faith and served in.the first Chamber Leadership class and received the Chamber Business of _...._. the Year for 2003. Ms. Hall further stated she is a candidate fo�Council Position f�1 in the upcoming election. CITY MANAGERS I�EPORT Mr. Cox reported on the opportunity he had Monday, February 24, to visitwith Congressman Nick Lampson's Chief of Staff, Tom Combs, and Legislative Director, Dan Easley, regarding the Clear Creek Project. Congressman Lampson's staff gave assurances of the Congressman's support for the continuation of the GRR and continued federal funding for that project, they have written both the House Appropriations Committee and the President expressing their concern and displeasure with:the project's elimination from the p�oposed FY2003-04 federal budget. In addit.ion, they committed to write botf� Senators Hutchinson and Cornyn encouraging them to_support the reinstatement of the project. Council will be consiciering a resolution at a future meeting supporting the need for continuation of the project, and encaurages ci'ti�ens io write IetEers to express th��-vi!I of the people in the upper end of the Clear Creef< watershed for the prcject. , 03/03/03 �g89 Mr. Cox further reported that he, Mayor Whitaker, and representatives of Galveston Counfy Consolidated Drainage District were able to be with the host City of Pearlancl and Brazoria County Drainage District#4 in a meeting wifh Congressman Tom DeLay, on Friday in Pearland City Hall. The-presentatiorl to Congressman DeLay�was the same as what City of Friendswood presented to Congressman Lampson in September. --- Congressman DeLay pledged that he would work to get this funding reinstated. Just as importantly, he asked if there were related projects that could be funded under the Corps of Engineers Secfion 205 Program that he could help with. This is a 75/25 program for drainage improvement, such as regional detention, thatwould be helpful. The City of Friendswood will be working with the City of Pearland and Galveston County Consolidated Drainage District on a package fo submit fo both Congressmen. At the lasf regular Councif ineeling on FebrUary 17, a reside:nt spoke about a permit issued by the Texas Commission on Environmental Quality (TCEQ) to Magna-Flow Company. Magna-F�low has contracted with the City of Houston to haul and distribuie "the waste material from fhe water treatment plant as a land application on approximately 20 acres in Friendswood on Dixie Farm.Road. The.report was the first that City " staff had heard about the permit. , Dan Johnson, Division Director for Communify Development, made a number of inquiries and found the following. • Magna-Flow is required by TCEQ to comply wilh all local ordinances. In the regulations issued by TCEQ, specific reference is made to not affecting the flood plain with this applicalion of waste material. • Magna-Flow made no contact with the City of Friendsv�rood. � TCEQ, on the word of Magna-Fiow, issued the permit from the Austin office. • Dan has spoken with TCEQ representatives, City of Houston representatives, and representatives of Magna-Flow, including their lawyers, and indicated ths company must comply with both our zoning ordinance and our rlood damage prevention ordihance. To determine compiiance in botl� tl�ese areas, Dan is requiring a site plan and overall plan for this project. • The City of Hou�;ton is holding the contractor, Magna-Flow, responsible for compliance with any and all regulations. � ' ��� • In the meanEime a "red"tag has been placed on the site, prohibiting any further applications unEil the City of Friendswood is satisfied. It is now up to Magna-Flow to respond. The City will continue to monitor the site to ensure no additional activity tal<es place. , ACTION ITEMS � **Councilmember Ericsson moved to approve a $265.00 a month salary increase to City Secretary Deloris McKenzie for outstanding performance. Seconded by Councilmember Measeles. The motion was approved 6-0 � ""`Councilmember Kitten Brizendine moved to approve a contract with Claunch and Miller Engineering to conduct a.Water and Sewer Impacf Fee Study and authorize the Mayor to sign tlie contract. Seconded by Councilmember Kim Brizendine. The motion was approved 6-0. RESOLUT(�NS '`*Councilmember Kim Brizendine moved to approve Resolution No. R2003-14 - A Resoluiion adopting a Capihal Improvement Plan Manual containing a summary of all proposed programs to be acquired during a five and fen year period, cosf estimates, method of financing and a recommended time table for constructing the 03/03/03 1990 improvements to be undertaken in the City of Friendswood, Texas, pursuant to the authority contained in Amendment No. 11 of the Charter. Seconded by Counc;ilmember•Goza. The motion was ap��roved 6-0. . **Councilmember Ericsson mo��ed to approve Resolution No, R2003-16 - A Resolution of the City of Friendswood, Texas, urging the Texas Congressional Delegation to request and support funding for the U.S. Arrny Corps of Engineers ("CORPS"} General Reevaluafion Report on Clear Creek Seconded by Counc:ilrnember Kitten Brizendine. The motion was approved 6-0. '"*Councilmember Measeles moved to approve Resolution No. R20�3-17-A ResoluEion of the City Council of ��� � the City of Friendswood,Texas, expressing inYent to finanr,e expenditures to be incurred through the issuance of Tax-Exempt Obligations to be issued subsequent to the date hereof. Seconded.by Counc;ilmember Kim Brizendine. The motion was approved 6-0. *"`Councilmember Kitten Brizendine moved to approve Resolution No. R2003-1 g -A Resolution of the City of ' Friendswood, Texas, adopting the Bond Issuance Schedule for the Capital Improvements Project (CIP) as approved by Che voters. Seconded by Councilmember Goza. The motion was approved 6-0. CONSENT AGENDA "`*Councilmember Kitten Brizendine moved to approve the Consent Agenda as presented. A. Payment of Capital Projects— 1. San Joaquin Gravity Sanitary Sewer with payment in the amount of$9,9�t5.90 to SCL Engineering for engineering services. To date, 15 percent of the contract has been expended. 2. Longwood Park Water and Sewer with payment in the amount of$4,000.00 to SCL Engineering for engineering services. To date, 100 percer�t of the contract has been expended. 3. 2002 Asphalt Street Project with final payment in the amount of$31,350.35 to Silva, Inc.,for construction services. The amount includes$29,557.15 in contract retainage. To date, 100 percent of the contract has been expeneled. The project is complete. Totai payments were $45,296.25. B. Approve Resolution R2003-19, A Resolution oi the City o�Friendswood, Texas, urging the 78`h Texas State Legislature to oppose Legislation that would further erode or eliminate Municipal Annexafion aufhority. C. Approve Minutes of February 10 and 17, 2003 Meetings. Seconded by Counc;ilmember Ericsson. The motion was approved 6-0.
