Mayor Whitaker called the meeting to order.
Council convened into Executive Session in accordance with the Texas Government Code, 551.072,
Qeliberation regarcling real property as posted, and eailed for an Executive Session in accordance with
Texas Government Code 551.d71, Consultation with City Attorney concerning pending or contemplated
litigatic�, ar�d i��as uov-errment Co�e S�i.G73, Deii�2i ai�Of; regarding securi�y devises.
Council convened into Regular Session at 7:00 PM with no action taken.
The invocation was given by Dan Loaiza from Calvary Chapel.
Mayor Whitaker fed the Pledge of Alle_giance to the United States and to t�e State of Texas.

Mayor Whitaker and Chair of the Planning and Zonir�g Commission Tom Burke caE(ed a Joint Docketed
Public Hearing to, order to receive comments, either oral or written, regarding amending the Sign
Ordinance, regarding the placement of For Rent, Sale or Lease Signs outside the specific property.
Mr. John Cole, 401 Vi.rginia Lane, appeared before Council and�asked about the size of the signs with
Chair Burke replying 6 square feet woufd be feasible. Chair Burke explained that a citizen brought this

traffic caming through Friendswoad that coul.d cause traffic problems for the city.
Councilmember Kitten Brizendine reported on attending the Prayer breakfast and hoped everyone had a
wonderf.ul Easter. �
Mayor 1r'�hitaker reported on attending ihe Stafr fvieeting on Emergency Ulanagement planning, and
stated that he is proud of the progress being made in planning for disasters and that work is continuing
on improving departmental plans.,

CITY MANAGER'S REPORT �
City Manager Cox reported on the Texas Department of Transportation pro}ects pending or under
consideration for our highways within the city�limits. These are as follows.

• All FM Roads — repainting and restriping, and placing street name signs at all intersections. �
• FM 518/Clearview—turn bays are approved, but not yet funded. �
• �M 518—testing of road bed for base failures to determine future resurFacing needs .
• FM518/Chelsea — flashing yellow beac�n approved with construction expended in summer of
2002 .
• FM 518/Eagle Lakes—currentiy under studyfor a traffic signal (this signal has been identified in
the city's master plan for signalization within the city)
• FM 528/Braokside Intermediate—currently under study to extend the lepgth of the school zone
• FM 2351/Westwood Elementary—extending of right turn lane from intersection of FM 2351/FM
51x to the schooi is appraveci but not yet funcleci.
Mr. Cox also reported on the FCC ruling on Right of Way Maintenance-�hat cities should not do anything
that would impede the industry from providing and expending broaclband services including high speed
internet services to cusfomers. This seems reasonable on the surface, but most{including the industry
and�he cities) are interpreti�g that rufing io mean tha� cities cannot regulate the right of way within our
cities. The Texas Coalition of Cities far Franchisec� Utilities Issues(TGCFUl;.has recentl�t participated in
an appeal to this ru[emaking at the federal level. This is a concerted effort on �he part of the
fe(ecammunications industryto refieve�hemselves of any responsibi(itytoward maintenance and control
of the public rights of way across �he country. Many have seen our rights of way being �awn up by

private contractors. Wi�h current regulations, the,city t�as the autharity to make them provide proper
traffic can�rol, clean up after themseives, and ge� proper permits before beginning work: With the new �
FCC ruling,�here are no such controis. TCCFUI is represen�ing cities in this efforf as weil as the National
League of Cities.

�'�Councilmember Goza moved to approve Ordinance T20�2-09, First reading of an ordinance amending
Appendix C of the friendswood city Code, said Appendix C being the Gity o-f Friendswood, Texas,
Orcfinance �lo. 84-15, as amended, originally adopted the 19�h day of November 1984, and being the
Zoning Ordinance of the City, by deleting Paragrap� 7 of S�ection 9.G thereofi and substituting therefare a
new Paragra-ph 7; Time Limitations for Specific Use Permits; providing a penalty of an amount not to
exceed $2,000 for each day of vio[ation of an� provision thereof; and providing fio� severabifity.

Capital Projects. I, Water System Irnprovements with payment in the amount ofi$1fl,806,72 to Klofz
Associates, [nc.for consulting services. To date, 63 percent of the contract has been expended. 2, Sun
Meadow Subdivision .with payment in the amount of $12,000 to Claunch & Miiler �ngineering
Consuliants for services. To date 78 percent of the contract has been expended. 3. 2v�I �,sphali S�reei
Project with payment in the amount of$165,OOb.00 to Sil�a Contracting Company, Inc. for contracting
services. To c�a±P a4_pPr�Pni-nf thP r�ntra�t has �een expended, Total payments were$187;$12.72, B.
autharize the sale of City Vehicles at Public Auction. C. Approve �esolution i���5t��-�� to authorize a
gran� appfication for Fire Prevention for the Fire Marshal's Office with a required match of $670. D.
Approve Resolution R2002-21 to authorize a grant application to the FEMA Fire Act grant for fire
equipmer�t for the FVFD with a required match of $6,000. �
Seconded by Counciimember Mel Measeles. The mation was approved unanimously.
