The Invocation was given by Pastor Norman Fry of the First Baptist Church. Mayor Whitaker led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATfONS FROM MAYOR AND COUNCILMEMBERS Councilmember Kitten Brizendine reported attending with other Councilmembers the Texas Municipal League Conference that was held in Houston iast week and ofifered congratuiations to FVFD Emergency Medical Services(EMS)for receiving the 2001 Volunteer EMS Provider of the Year Award and expressed her appreciation for their dedication, and reminded parents, regarding the incident that occurred at the Junior High, to know your chifdren room numbers at school in case af an emergency and wished everyone a Merry Christmas. Councilmember Ericsson reported on attending the Houston/Galveston Area Council Regular Board Meeting and he is accepting nominations to the Criminal Justice Board, and asked that if anyone knows of someone interested in serving on this Board to let him know and stated that H-GAC covers a 13 county service area. Councilmember Goza congratulated the FVFD EMS, and also congratulated the Friendswood High School , Mustangs for an exciting season. Councilmember Taylor reported on attending the Clear Creek Drainage District meeting, stated the Mustangs put on a good run and should be proud of themselves, reported that he was at the Junior High last Friday and the Police Department, the Fire Department, and the school district handled the reported shots fired weli, and was thankful that it was not a tragedy, and is grateful for the efforts of everyone that was involved. Mayor Whitaker announced that a Public Safety Security Meeting at the Friendswood High School auditorium is scheduled on Wednesday at 7:30 PM. 12/3/Ol 1834 , Councilmember Measeles reported on also attending the TML conference, brought back a packet of resolutions passed by TML, reported that Councilmember Kitten Brizendine served on the Resolutions Committee, reminded everyone of the Friendswood Community Prayer Breakfast to be held on December 15t'', and invited everyone to attend, and wished everyone a Merry Christmas. Mayor Whitaker extended his congratulations to the mighty Mustangs, reported they did an outstanding job in representing this community and is very proud of our young people that participated and wished everyone a Merry Christmas. COMMUMCATION FROM THE PUBLIC . Ms. Evelyn Newman, 502 Falling Leaf, appeared before Council, and invited everyone to participate in the Annual Tree Lighting to be held at the Frank J. Brown Museum at 7:00 PM on December 7tn Mr. Steve Schuitheis, 613, Tanglewood, President of the Friendswood Soccer Club appeared before Council and presented a check in the amount of $30,000 for the development of soccer facilities at Centennial Park, congratulated the entire community for the park, stated games are already being played on the existing field, this park is a great asset for the community, reported that in 1998 the Friendswood Soccer Club made a commitment of $30,000 and fulfilling this commitment came from parents, kids, and supporters, and the club is looking forward to some lights at the park, introduced some members of the board, and thanked the Community Services Department and Director Jon Branson for their support. Mayor Whitaker thanked the Friendswood Soccer club for the donation and all of the hard work that has been done in Centennial Park. Mr. Fred Krch, 209 Dawn, appeared before Council and presented information regarding rainfall, holding ponds, a pamphlet on the Constitution, reusing water, recycling sewage water, and hoped everyone has a fulfilling Christmas. COMMUNICATIONS FROM COMMITTEES OR SPECtAL REPORTS Chief of the FVFD/EMS Lisa Camp appeared before Council and announced that the FVFD Ernergency Medical Services received a most prestigious award, that of 2001 Volunteer EMS Provider of the Year. The Texas Department of Health, Bureau of Emergency Management presented this award at the annual EMS conference in Austin. Ms. Lisa Camp recognized the members present including Mr. Van Williams for his many years of service and thanked him for being a volunteer for more than 29 years, stated that Medical Director, Dr. David Hearn, sends his congratulations, and reported that volunteers have given years of service ranging from one year to 33 years and stated she started on the ambu(ance when she was 17 years old. Mayor Whitaker stated that words are inadequate to honor the Friendswood EMS in bringing health care to the community, praised them for the countless hours they have given to the community, and that everyone sincerely appreciates all that they do, and the award says what we all know, how great the EMS are. City Manager's Report City Manager Cox reported on the Tropical Storm Allison Recovery Project. Mr. Cox reported that the Harris County Flood Control District has begun a major project to improve the flood plain mapping for all of Harris County. This project is partially funded by FEMA and is now underway. Mr. Cox reported on the Friendswood Response and Recovery Report and presented an overview of the activities as prepared by the Office of Emergency Management, under the direction of Fire Marshal Terry Byrd, and an overview of 12/3/Ol 1835 the financial costs, along with the reimbursements from both insurance and FEMA to the city for the direct costs of the response and recovery, as prepared by the Administrative Services Department, under ' the direction of Roger Roecker. The direct costs amounted to over $527,000, and the city's portion, after reimbursements, will be just over$105,000. The city's volunteer efforts were tremendous, and the accounting for those hours was a significant help to the city's matching requirements for FEMA reimbursement. The city received $27,000 in credit for the documented volunteer time. The city has received $216,706.04 so far leaving $104,720.88 outstanding. Mr. Cox also presented a Buyout Program Report prepared from Deputy Director of Community Development Dan Johnson. To date, closings have taken place on 44 homes, 106 offers for the buyout have been accepted, and 31 are � pending. Mr. Cox also reported on the Domestic Preparedness Equipment Grant and that the Office of ' Emergency is to receive a first time grant from the U.S. Dept. of Justice in recognition of the planning efforts they have undertaken over the last year. The original grant of some $41,650 has now been increased to over $46,000. This grant will purchase equipment to be used by the Office of Emergency Management, Police Department and Friendswood Volunteer Fire Department should the city encounter weapons of mass destruction. Most of the equipment will be personal protection equipment, including suits, self-contained breathing apparatus, and air quality monitoring equipment. Mr. Cox also reported that extensive coverage on the Tropical Storm Allison Recovery Project will be in the newsletter coming out. Councilmember Ericsson asked the City Manager when are the property owners who accept the buyout are to be paid, with Mr. Cox explaining that residents will be paid at closing, the turn around time is about three weeks for closing once the residents accept the buyout proposed amount, that 147 owners of properties have accepted the buyout, and three have turned down the offer for a buyout. Councilmember Ericsson stated that we need to continue to address the problem that caused the flooding. Councilmember Kitten Brizendine complimented City Manager Cox and thanked him for writing the letter regarding EMS to the Texas department of Health. Councilmember Taylor asked if we have started comparing the budget to properties taken off the tax roll with the City Manager explaining that approximately$200,000 will be taken off the tax roll in next year's revenue. Resolutions �'�Councilmember Kim Brizendine moved to approve Resolution No. R2001-44, A Resolution of the City of Friendswood, Texas, declaring a policy to determine what constitutes an existing Subdivision. Seconded by Councilmember Kitten Brizendine. '�'�Councilmember Goza moved to table Resolution R2001-44 to workshop. Seconded by Councilmember Taylor. The motion passed 6-1 with Councilmember Kim Brizendine opposed. Ordinances **Councilmember Measeles moved to approve Ordinance No. T2001-25, amending the Code of Ordinances of the City of Friendswood, Texas, by striking all of Article II of Chapter 3 thereof and substituting therefore a new Article I I of Chapter 3; providing rules and regulations governing the keeping and licensing of animals; providing definitions; establishing the powers and duties of the city's Animal Control Officers; requiring rabies vaccinations; establishing licensing and permitting fees; providing procedures for regulating, quarantining, impounding, controlling, and disposing of dangerous or rabid animals; making it unlawful to keep wild or exotic animals within the city without a permit; making it unlawful to abandon or dump animals within the city; making it unlawful for any person to fail to promptly remove and dispose of feces left by any animal; providing that owners of dangerous animals 12/3/O1 1836 � must carry liability insurance; declaring a public nuisance; providing other matters relating to the subject; providing penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof; providing for severability; repealing all ordinances or parts of ordinances inconsistent or in conflict herewith; and providing an effective date. Seconded by Councilmember Kitten Brizendine. x�Councilmember Measeles moved to amend Ordinance T2001-25 for definition for domestic animal/domesticated animals to two animals per acre, remove hobby breeding from number per acre. Seconded by Councilmember Kitten Brizendine. The motion was approved unanimously. x'�The main motion, as amended was ap.proved unanimously. Consent Agenda '�'�Councilmember Ericsson moved to approve the Consent Agenda as presented. A. Payment of Capital Projects. 1. 2001 Sidewalk Project with payment in the amount of $28,904.40 to Smith Classic Construction for construction services. To day, 44 percent of the contract has been expended. 2. Beamer Road Pump Station and Waterline with payment in the amount of $17,8�7.93 to Klotz associates, Inc. for engineering services. To date, 53 percent of the contract has been expended. 3. 42" Dorado Storm Sewer with, to date 100 percent of the contract has been expended. 4. Friendswood Public Works Building Addition with payment in the amount of $55,100.00 to G & Z Contracting for architect services. To date, 53 percent of the contract has been expended. This payment was authorized by the city Manager to be paid prior to approva! by Counci! to avoid a 10 percent penalty tor being over 30 days late. Total payments were $135,293.04. B. Disposition of Bid No. 2001-17 for a lighting system for Centennial Park to come from the Community Park Fund and a grant frorn the Friendswood Soccer Association. .C. Approve Change Order No. 1 for the Public Works Building Addition in the amount of$35,314.14. D. Approve the demolition of structures located at 2201 S. Friendswood Drive at a cost of $7,300.00. E. Resolution R2001-43, a resolution of the City of Friendswood amending Appendix D and adopting an Additionai Schedule of fees for the Humane Division of the Police Department. F.
