FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR HAROLD L. The Invocation was given by City Manager Cox. Cub Scout Pack 442, Den 7 from Mary Queen Gatholic Church led the Pledge of Allegiance to the United States and to the State of Texas. COMMUNICATIONS FROM MAYOR AND COUNCILMEMBERS Councilmember Measeles had no report. Councilmember Taylor had na report. Councilmember Kim Brizendine reported attending the Main Street task Force meeting and will have a report at a later date. Councilmember Goza had no report. Councilmember Ericsson reported on attending the Houstan/Galveston Area Council meeting where tHere was a budget meeting held and discussion regarding emergency back up plans, and urged a11 City Halis to have a back up plan in the event of a disaster. Councilmember Kitten Brizendine reported that Susan Hood, a volunteer member on the cor►�munity Appearance Soard was seriously injured in an accident on FM 528 and urged everyone to lift her up in prayer. Mayor Whitaker reported on attending some of the same meetings, but none that require reporting. 10( 1 (Ol 1810 COMMUNICATIONS FROM THE PUBLIC Ms. Shannon Anders, a FISD Graduate, and a Houston Texan NFL Cheerleader did not appear. Ms. Caro{ Jones, President of the Friendswood Chamber of Commerce, appeared before Council and presented the Annual Report and discussed their Mission Statement, discussed community events and services provided by the Chamber including Newcomers Packets, Cornmunity and Economic Development, Friendswood maps, {nternet 1ink, and introduced Ms. Rebecca Li{ley who has been Chairman of the Board for the past three years, and Ms. Lucy Woltz, Community Liaison. Mr. Gene Cook, 114 Irnperial, appeared before Council to thank the city for its assistance in the recent flooding from Tropical Storm Allison. Mr. Cook also expressed his concern regarding the lack of action taken on the Ctear Creek Project. Mr. Cook stated that if the Clear Creek Project had been approved, less than 50 Friendswood homes would have damaged. Mr. Cook suggested that the city form a citizens advisory group for the Clear Creek Project, composed of citizens who live in the watershed as opposed to outsiders. Mr. Fred Krch, 209 Dawn, appeared before Council and submitted a set of photos documenting how the city created a situation that nearly flooded his home in June. Mr. Krch stated that if his hause floods due ta a hump in the road at the intersection of Woodlawn and Shadowbend which causes flood waters to back up, he has documentation to prove the flow of water. Mr. Krch also presented a packet regarding Civil Defense and Disaster Relief and information on gun laws and urged Council to pass an ordinance requiring every Friendswood home to have a firearm, ammunition, and a resident knowledgeable in using the firearm. CITY MANAGER'S REPORT City Manager Cox reported on the FEMA Buyout Program. The first round of offers to 67 homeowners under the FEMA Flood Hazard Mitigation Project have taken place. The City's representative, Mr. Don Ward and his staff inet with homeowners on September 21, 222, and 23, 2001 at City Hall. Still being awaited is approval for removing 75 homes from the list of the original 200 submitted to FEMA and adding 23 to the list. With this number added, there is a potential buyout of 148 homes. Mr. Cox also reported on the Leadership Class. This is a new program developed by the Friendswood Chamber of Commerce and Mr. Cox served on the advisory committee to help establish the curriculum. The program will last over a nine-month period, with one class per montn. Class time will be spent at the city of Friendswood, �1SD, Galveston County, utifity companies, and wi{I be capped off with a trip to Austin to the capitol and a visit to our state elected officiais. The cfass spent the afternoon with city staff as well as learning the history of the community, culminating in attending the October 1,2001 Council meeting. This program will allow those interested in a {eadership of the community an opportunity to get first hand knowledge of what is happening and how things work. Mr. Cox introduced members of the class. Mayor Whitaker asked City Manager Cox what weekend is scheduled for the next FEMA buyout rneeting with Mr. Cox responding the weekend of the 12th, 13th and 14t'' for additional buyouts and Mayor Whitaker said there may possibly be four groups. Councilmember Kim Brizendine asked if there was a possibility that a senior citizen has not taken advantage of this buyout program with City Manager Cox responding that there is aiways a chance that someone may be overlooked, stated that the homeowners must be registered with FEMA by October 7tn with Mr. Cox responding that this doesn't apply to the buyout program, and that signing up with the city has technically no deadline, but commitments are being made for FEMA money to all areas, the original commitment to Friendswood was for 200 hornes, some have dropped out and some have been added. Councilmember Brizendine asked if all homes have been identified, and would it be fruitful to send one lo/ 1/oi lgii more fetter even though it means going above and beyond the City's responsibility with City Manager Cox responding that he will look into this. ACTfON ITEMS *'�Councilmember Kitten Brizendine moved to approve action regarding authorizing the purchase of property, at 2102 S. Friendswood Drive, and authorizing the Mayor to sign the cfosing documents. Seconded by Councilmember Measeles. The motion was approved unanimously. **Councilmember Jerry Ericsson moved to approve action regarding authorizing the Mayor to execute an amended contract with Klotz Associates for the design of the Westside El�vated Storage Tank to be located at the Friendswood Sportspark site. The total amount of the contract amendment is $22,500. Seconded by Councilmember Kim Brizendine. The motion was approved unanimously. RESOLUTIONS *�Gouncilmember Taylor moved to approve Resolution No. R2001-39, A Resolution of the City of Friendswood, Texas, hereby designating Councilmember Jerry Ericsson as a representative and Mayor Haro{d Whitaker as an alternate to the Houston-Galveston Area Council 2002 General Assembly and Board of Qirectors. Seconded by Councilmember Measeles. The motion was approved unanimously. ORDINANCES **Councifinember Kim Srizendine moved to approve Ordinance T2001-21, First reading of an ordinance amending Appendix C of the Friendswood City Code, said Appendix C being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19t'' day of November, 1984, and being the Zoning Ordinance of the City, by striking aff of Paragraphs 3, 4, and 5 of Subsection H of Section 9 thereof and substituting therefor new Paragraphs 3, 4, and 5; and by deleting the reference to "Final Site Plan" in Paragraph 6 thereof; providing that the commercial site plan approval process shall include one review and approvaf procedure; providing other matters refating to the subject; providing a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Kitten Brizendine. ���`Councilmember Taylor moved to amend Ordinance T2001-21 by inserting "Any corrections, changes, or condition required to ensure the plan complies with all existing ordinances that are imposed by the commission shall be provided to the applicant, in writing, and shall become a part of the approved site pfan, which, if not met, may be cause far enforcement action or invalidation of the site plan". 5econded by Counciimember Kitten Brizendine. '�*Councilmember Taylor moved to approve Ordinance T2001-22, First reading of an ordinance amending Appendix C of the Friendswood City Code, said Appendix C being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19t" day of November, 1984, and being the Zoning Ordinance of the City, by striking all of Paragraph 2 of Subsection P of Section 7 thereof, the current Perrnitted Use 7able and substituting therefore a new Permitted Use Table; providing that certain uses shail be permitted by right and that certain uses shall require Specific Use Permits in various districts; by striking all of Paragraph 5 of Subsection P of Section 7 thereof and substituting therefore a new Paragraph 5 to describe a new industrial classification system to be used for identifying business uses within the city; and by adding a new Subparagraph 9 to Subsection J of Section 8, Supplementary 10/ 1/O1 1812 District Regulation, thereof, establishing performance standards for dry cleaning establishments; providing a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. � Seconded by Councilmember Kitten Brizendine. '�*Councilmember Measeles moved to approve Ordinance T2001-23, First reading of an ordinance amending Appendix C of the Friendswood City Code, said Appendix C being City of Friendswood,Texas, Ordinance No. 84�15, as amended, originally adopted the 19th day of November, 1984, and being the Zoning Ordinance of the Gity, by adding to Subsection I of Section 8 thereof new sentences to establish additional perimeter landscaping and screening requirements for certain properties adjacent to residential districts; providing other matters relating to the subject; providing a penalty of an amount not to exceed $2,OQ0 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Kitten Brizendine. **�The motion was withdrawn, CONSENT AGENDA �-xCouncilmember Kitten Srizendine moved to approve the Consent Agenda as presented. A. Payment of Capital Projects. 1. 16" Melody to Sunset Waterline/8" East Heritage Sanitary Sewer Replacement with a payment in the amount of $116,204.95 to Ramos Industries, Inc. for construction services. To date, 88 percent of the contract has been expended. 2, Public Works Building Addition with a payrnent in the amount of $80,750.00 to G & Z Contracting for construction services. To date, 36 percent of the contract has been expended. Total payrnent were $196,954.95. b. Disposition of Bids. l. Bid No. 2001-10 — Surface Water Pump Station awarded to T & C Construction, Inc. in the amount of $2,097,000. 2. Bid No. 2001-11 —2001 Sidewaik Program to Smith's Classic Construction in the amount of$57,645 for W. Shadowbend from Woodlawn to FM 518, E. Shadowbend from Quaker to FM 518 and Quaker from E. Shadowbend to Skyview. C. Approve Change Order No. 5 to Phase One Constructian of CentenniaV Park in the amount of $19,855.41 which does not inc{ude ltem 12 from the original change order application. D. Approve renewal of annual contract with Friendswood Chamber of Commerce. E, Approve Resolution R2Q01-40, a resolution of the City of Friendswoad designating the Reporter News as the Official Newspaper for the City of Friendswood. F.
