FR{ENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE �OLLOWiNG PRESENT CONSTITUTING A QUORUM: MAYOR HAROLD L. Boy Scout Troop 442 from Friendswood Methodist Church led the Pledge of Allegiance to the United States and to the State of Texas: JOINT DOCKETED PUBLIC HEARING Mayor Whitaker and Acting Chair of the Planning and Zoning Commission Mark Clark called the Joint Docketed Public Hearing to order to receive comments, either oral or written, regarding amendments to the Zoning Ordinance regarding: A. Permitted Use Table. Mike Dominguez, City Planner from the Community Development Department gave a recap going from 1987 Standard Industry Cade to 1997 North American Industry Classification System regarding the Permitted Use Table. Discussion continued regarding allowing more uses in certain districts, streamlining the table to make development smoother, to reduce redundancy, to be more specific, to determine what business is desired and what the city will allow, and the additions to the table. No one spoke for or against. 7his portion of the Joint Docketed Public Hearing was closed. Mayor Whitaker and Acting Chair of the Planning and Zoning Commission Mark Clark called the Joint Docketed Public Hearing to order to receive comments, either oral or written regarding amendments to the Zoning Ordinance regarding: B. Commercial Site Plan Approval Process. Mike Dominguez, City Planner from the Community Development Department made a presentation �.�....-,,.-�-.-.-__..__� _.__..�._...______ ..,.�__..._ 9J27/Ol 1805 regarding streamlining the site plan process, and creating a more business friendly environment. Discussion continued regarding streamlining the preiiminary process, review at staff level, review by the Planning and Zoning Commission for final approval, pubiic hearings & public input, reworking the � ordinance, and opposition to the changes in the ordinance. Mr. Christopher Smith from Kingspark/Whitehall Subdivision appeared before council to express his concern regarding any step that would reduce public input. Hearing no further comments this portion of the Joint Docketed Public Hearing was closed. Mayor Whitaker and Acting Chair of the Planning and Zoning Commission Mark Ciark called a Joint Docketed Public Hearing to order to receive comments, either oral or written, regarding amendments to the Zoning Ordinance for amendments to: C. Landscaping and Screening. Mike Dominguez, City Planner from the Community Development Department presented information regarding there is no provision requiring commercial property next to residential being required to erect an 8 ft. opaque fence, a provision allawing in certain circumstances to develop berms or graduated fencing and other combinations of requirements regarding fencing. Discussion continued regarding a good definition of graduated fencing. No one spoke in favor or against. Hearing no comments the Joint Docketed Public Hearing was closed. COMMUNICATIONS FROM MAYOR AND COUNCILMEMBERS Councilmember Kitten Brizendine stated that along with the Nation, she wanted to invite all to lift up this country in prayer and to give thought to all those for their great sacrifices, reported that it was a privilege to attend the Clear Lake Area Economic Development Foundation (CLAEDF) Elected Official Luncheon during which Councilmember Ericsson was honored for a{I that he does in this community. Councilmember Ericsson reported that he also attended the CLAEDF luncheon, attended the Ciear Lake Council of Cities meeting during which the program presented was on different funding available to entities including bonds and other ways, and reported that he attended the dedication of the Ralph L. Lowe Parkway dedication on F.M. 528 at the city limits today. Cauncilmember Goza reported on attending the Ralph L. Lowe dedication and wished everyone well during this time of crisis. Councilmember Kim Brizendine had nothing to report. Councilmember Taylor stated that words cannot express our feelings and emotions during this time, reported that our Friendswood Fire Department took action with the boot collection and collected $11,000 for the Fallen Firefighters Foundation, reported on attending the Galveston County Mayors and Councilmembers association meeting, the Chamber of Commerce meeting, with guest speaker presenting information on the City of Houston's Olympic Bid, reminded everyone of the Fall Trade show this Sunday, stated it is hard to continue on with our lives during this time and that we have to pick up the pieces and go on with our lives. Councilmember Taylor reported that Pastor Norman Fry from the First Baptist Church was honored for his 50 years in the ministry, stated our churches work together, and that our area ministers meet regularly, reported on attending the Ralph L. Lowe dedication, and stated that Friendswood is blessed with the leaders who have come before us and wi!! come after, and asked everyone to pray for our country. ........�..��---_.....�.,...�-_.��.�.._.....�..�. �.___....._.�._�...._ _._.�.__. 9/27/O1 1806 Councilmember Measeles dittoed Councilmember Taylor's remarks, stated that the whole world is affected by the past week's events, stated that we will all pull through and be stronger, stated he was out of town the last three weeks and while out of town, attended a concert in a park in Seattle, Washington, " and reported that Seattle also has concerts for the children during the day, and welcomed State Representative Craig Eiland to this meeting. Councilmember Kitten Brizendine reminded everyone of the Prayer Breakfast in the morning and also the Friendswood High School Alumni Pancake Breakfast that will be held at both McDonalds this coming Sunday. Mayor Whitaker stated he appreciates all of the comments made about the tragedy and that it is important to proceed on, to move this country forward, and apologized for not introducing Council at the Ralph L. Lowe Parkway Dedication. COMMUNICATIONS FROM THE PUBLIC Representative Craig Eiland appeared before Council and apologized for nat being able to attend the Raiph L. Lowe Parkway Dedication, appreciates the City's resoVution, congratulated the City and Councii on the work done on the flood, stated the City of Friendswood is the most aggressive city in flood issues in the United States. Representative Eiland stated he serves on the National Legisiators on Flood Issues, and invited City Manager Cox to atter►d and speak to them. Representative Eiland stated that Mr. Cax knew more than anyone else other than FEMA, thanked the City for sharing Mr. Cox with the association, and reported that a handbook is being prepared for legislators and Friendswood experiences will be very helpful in this endeavor. Mr. Eiland congratulated the City on the flood grants received and effarts being taken with the buyout program and recovery efforts, and stated with redistricting, he may not be here much longer but while he is here, if the City needs anything, he is available. Mayor Whitaker thanked Representative Eiland for his efforts in representing the City of Friendswood and asked if he could find additional funding for flood efforts. CITY MANAGER'S REPORT City Manager Cox had nothing to report. ACTION ITEMS ��xCouncilmember Kitten Brizendine moved to approve the Hazard Mitigation Grant Program (HMGP), Approve grant application and floodplain management and mitigation plan to be prepared and submitted. Seconded by Councilmember Ericsson. The motion was approved unanimously. xXCouncilmember Goza moved to authorize acceptance of the proposal with Halff Associates, Inc. to assist in the preparation of the HMGP application and authorize the Mayor to sign the agreement. Seconded by Councilmember Ericsson. The motion was approved unanimousiy. RESOLUTION �xCouncilmember Ericsson moved to approve Resolution No. R2001-38, A Resolution of the City Council of the City of Friendswoad, Texas, authorizing the City Manager and the City's Director of Administrative Services to act as financial administrators of the Disaster Relief Fund Grant awarded by the Texas Department of Nousing and Community Affairs and the City's authorized representatives in all matters pertaining to the City's participation in the Community Development Program. 9/27/O1 1807 Seconded by Councilmember Kitten Brizendine. The motion was approved unanimously. ORDINANCES �`*Councifinember Kitten Birzendine moved to approve Ordinance No. T2001-19, First and final reading of an Ordinance providing for the assessment, levy, and collection of Ad Valorem Taxes of the City of Friendswood, Texas, for the year 2001 and for each year thereafter until otherwise provided, providing the date on which such taxes shall be due and payable, providing for a penalty and interest on all taxes not timely paid; and repealing all ordinances and parts of ordinance in conflict herewith and to approve the tax rate of .6385 with .5547 to fund maintenance and operation expenditures. Seconded by Councilmember Ericsson. 7he motion was approved unanimously. *�Councilmember Kitten Brizendine moved to approve Ordinance No. T2001-19, First and final reading of an Ordinance providing for the assessment, {evy, and collection of Ad Valorem Taxes of the City of Friendswood, Texas, for the year 2001 and for each year thereafter until otherwise provided; providing the date on which such taxes shall be due and payab4e; providing for a penalty and interest on all taxes not timely paid; and repealing all ordinances and parts af ordinances in conffict herewith and to approve the tax rate of .6385 with .0838 for debt service. Seconded by Councilmember Ericsson. The motion was approved unanimousiy. x-xCouncifinember Ericsson moved to approve Ordinance No. T2001-20, First and final reading of an Ordinance approving and adopting the City of Friendswood, Texas, General Budget for the Fiscal Year 2001/2002; making appropriations for the city for such fiscal year as reflected in said budget, and making certain provisions relating to the subject. Seconded by Councilmember Measeles. The motion was approved unanimously. CONSENT AGENDA x-x-Councilmember Kitten Brizendine moved to approve the Consent Agenda as presented. A. Payment of Capital Projects. 1. Beamer Road Pump Station and Waterline with a payment in the amount of $�47,608.64 to Klotz Associates, Inc. for engineering services. To date, 19 percent on the contract has been expended. 2. 1 Mi4lion Gallon Elevated Storage 7ank with a payment in the amount of$14,306.64 to Klotz Associates, Inc.for engineering services. 7o date 10 percent of the contract has been expended. 3. 500,Q00 Gallon Ground Storage Tank/Rehabilitation of Existing Storage Tank with a payment in the amount of$25,186.80 to Wayne Smith &Associates for engineering services. �o date 38 percent of the contract has been expended. Total payments were $87,102.08. b. Approve Contract Renewal with Texas Department of Public 5afety for Failure to Appear Program and aid Municipal Court in collection of outstanding fines. C. Approve Banner Permit Appfications for 1. FISD Red Ribbon Week and @. Friendswood Little League, Inc. D. Property Tax Report for the month of August 2001. E. Minutes of August 27, 2001 and 5eptember 10, 2001. Seconded by Councilmember Ericsson.
