COUNCIL CONVENED INTO EXECUTIVE SESSION IN ACCORQANCE WITH THE TEXAS GOVERNMENT CODE, PURSUANT TO SECTION 551.074-PERSONNEL MATTERS-ANNUAL EVALUATION OF THE CITY MANAGER AND SECTION 551.071 - CONSULTATION WITH ATTORNEY REGARDING PENDING OR CONTEMPLATED LITIGATION - HL&P- RELIANT ENERGY LAWSUIT. A BRIEF RECESS WAS TAKEN AT THIS TIME. COUNCIL RE-CONVENED INTO REGULAR SESSION AT 7:00 PM. CITY MANAGER COX LED THE INVOCATION. MAYOR WHITAKER LED THE PLEDGE OF A�LEGIANCE TO THE STATE OF TEXAS AND TO THE UNITED STATES. MAYOR WHITAKER AND CHAIR OF THE PLANNING AND ZONING COMMISSION TOM BURKE CALLED A JOINT DOCKETED PUBLIC HEARING TO OROER TO RECEIVE COMMENTS FROM THE PUBLIC, EITHER ORAL OR WRITTEN, REGARDING THE FOLLOWING: A. TO RECEIVE COMMENTS REGARDING A REQUEST FOR ZONE CLASSIFICATION CHANGES FOR A TOTAL OF 218.94 ACRES ALONG W.PARKWOOD AVENUE(FM 528)SOUTH FROM THE AMERICAN RICE CANAL TO THE HL&P EASEMENT AND EAST TO THE CITY LIMITS. CAPPS S�ATED TNE CITY IS ACTING AS THE AGENT FOR ALL THE LAND OWNERS AND IDENTIFIED THE AREA TO BE REZONED WAS IN 1998, A PART OF A 500 ACRE TRACT IN THE COMPREHENSIVE LAND USE PLAN AND ALSO NOTED IN THE VISION 2020 PLAN. MS. CAPPS EXPLAINED THAT THERE IS NO SPECIFIC USED IN MIND BUT THE CITY WOULD �� � LI KE TO PROMOTE THE USE FOR A CAMPUS STYLE BUSINESS PARK WI7H TILT WALL CONSTRUCTION ;: �: AND THE PROPOSED AREA ALREADY HAS PUBLIC INFRASTRUCTURE IN PLACE. � � MR. GEORGE BOFYSIL APPEARED BEFORE COUNCIL AND QUESTIONED THE REZONING WITHOUT HAVING ANY POTENTIAL BUYERS FOR THE PROPERTY. MS. CAPPS EXPLAINED THAT THERE IS NO SPECIFIC DEVELOPER, BUT THERE HAS BEEN SOME 1NTEREST AND BY HAVING THE CORRECT ZO{V1NG IiV PLACE, IT WOULD HELP DEVELOPMENT MOVE FORWARD. MR. FRED KRCH, 209 DAWN, APPEARED BEFORE COUNCIL AND SUGGESTED PERFORMING ENVIRONMENTAL STUDIES TO AVOID CONFLICTS WITH ENVIRONMENTAL AND/OR ANIMAL RIGHTS GROUPS. MR. NORBERT HERZOG, 2008 SHULTZ LANE, APPEARED BEFORE COUNCIL AND STATED HE WAS SURPRISED AT THE SIZE OF THE PROJECT, AND ASKED WHERE DOES THE BOUNDARY SPLIT FOR L1GHT AND HEAVY INDUSTRIAL. AND WHAT TYPES OF BUSINESSES WOULD BE PERMITTED iN EACH ZONE AND QUESTIONEQ THE ADEQUACY OF THE PUBLIC INFRASTRUCTURE. MR. STEVE MCLENDON, AN OWNER OF 2 ACRES, APPEARED BEFORE COUNCIL SPEAKING FOR THE PROJECT AND POINTED OUT THAT ANY FUTURE DEVELOPMENT WOULD HAVE TQ HAVE AN APPROVED COMMERCIAL SITE PLAN. MS. EVEI.YN NEWMAN, 502 FALLING LEAF, REPRESENTING THE OWNER OF 26 ACRES, APPEARED ° ; BEFORE COUNCIL AND STATED THE PROPERTY HAS BEEN FOR SALE FOR OVER TWO YEARS AND HAS NOT HAD ANY INTEREST. WITH VISION 2020 AND ECONOMIC DEVELOPMENT, THE CITY HAS TAKEN � �# THE INITIATIVE TO HELP CHANGE THE REZONING AND BELIEVES THE REZONED AREA WOULD BE AN ASSET TO THE CITY. MR. BOFYSILAPPEARED AGAIN BEFORECOUNCIL AND STATED ALTHOUGH HE IS AI.L FOR REZONING, ASKED IF WE DO NOT HAVE ANYONE WANTING TO BUILD IN THE AREA, WHY REZONE HOW. MS. CAPPS STATED THERE ARE PROSPECTIVE BUYERS LOOKING AT THE PROPERTIES AND ARE LOOKING AT THE REZONING PROCESS. COMMISSIONER SAMSON APPEARED BEFORE COUNCIL AND EXPRESS CONCERNS REGARDING HOW THE REZONiNG WOULD AFFECT THE PEARLAND SPORTS CLUB. MS. CAPPS ASSURED H1M THAT THE NEW ZONING WOULD LEGALLY PERMIT THE GUN CLUB THAT IS CURRENTLY OPERATING AS A LEGA�LY NON-CONFORMING USE IN THE SFR ZONE. HEARING NO FURTHER COMMENTS, THIS PORTION OF THE PUBLIC HEARING WAS CLOSED. 12/4/00 1694 MAYOR WHITAKER AND CHAIR OF THE PLANNING ANO ZONING COMMISSION TOM BURKE CALLED A JOINT DOCKE7ED PUBUC HEARING TO ORQER TO RECEIVE COMMENTS REGARDING A REQUEST FOR A SPECIFIC USE PERMIT (SUP) - MIXED USE COMMERCIAL FOR PROPERTY LOCATED AT 313 E. EDGEWOOD. MS. MARILYN ALEXANDER, 1201 BLUEBERRY, CO-OWNER OF THE PROPERTY, APPEARED BEFORE COUNCIL AND GAVE A PRESENTATION REGARDING PROPOSED SPA AND FITNESS CENTER, COMPLETION DATE, TO BE BUILT Wti'H AN ITALiAN DESIGN, AND STATED THE EXISTING BUILDING WILL BE DEMOLISHEO AND ALSO ADDRESSED CONCERNS FROM NEARBY HOMEOWNERS REGARDING TRASH LOCATION AND PICK-UP, NOISE AND LIGHT POLLUTION AND BUILDING HEIGHT. CHAIR OF THE PLANNING AND ZONING COMMISSION TOM BURKE QUESTIONED THE FENCING, LIGHT LOCATIONS, OFFICES,AND WINDOWS AND EXPRESSED CONCERNS ABOUT APPROVING BOTH PHASES OF THE SITE PLAN. MS. VERONICA, CURRENT OWNER OF THE PROPERTY, APPEARED BEFORE COUNCIL AND SPOKE IN FAVOR FOR THE APPLICATION AND STATED MS. ALEXANDER AND MS. HOLMES HAD DILIGENTLY RESEARCHED CITY REQUIREMENTS. MR. BILL LANGDOC, 108 ROYAL COURT, OWNER ADJACENT TO THE PROPOSEO DEVELOPMENT, APPEARED BEFORE COUNCIL, SPOKE IN OPPOSITION, SUBMITTED A LIST OF WRITTEN CONCERNS TO THE CITY SECRETARY, STAT�D HE HAS BEEN DEALING WITH SPECIFIC USE PERMITS FOR THE PAST EIGHT YEARS, AND EXPRESSED HIS CONCERNS REGARDING TRAFFIC VOLUME, STYLE OF THE BUILDING,THE RESTAURANT, COFFEE SHOP, BANQUET FACILITY, NOISE,TRASH PICK UP, LIGHTING, GLARE, THE GYM, THE HEIGHT OF THE BUILDING, RAIN RUNOFF, DIMINISHING PROPERTY VALUE, AND COMPLIANCE WITH THE LAW. MS. MELISSA HARBOUR, 110 ROYAL COURT, APPEARED BEFORE COUNCIL AND EXPRESSED CONCERNS REGARDING THIS PROJECT THAT WILL BACK UP TO HER BACK YARD, FENCING, DIMINISHING PROPERTY VALUE, HOURS THE BUSINESS IS OPENED AND STATED SHE WOULD NOT WANT TO SEE THIS 1N HER BACK YARD. MS. COOKIE LANGDOC, 106 ROYA� COURT, A 26 YEAR RESIDENT OF FRIENDSWOOD, APPEARED BEFORE COUNClL TO EXPRESS HER CONCERNS REGARDING ZONING, THE ITALlAN STYLE OF THE PROPOSED BUILDING,THE DRAWING PLANS, CUTTING DOWN TREES, PARKING AND TRASH PICKUP. MS. LANGDOC ALSO READ A LETTER FROM CARL AND JACKIE ALLEN, 107 ROYAL COURT, WHICH STATED THEIR CONCERNS REGARDING THE PROJECT BEING lNCONSISTENT WlTN THE AREA DEVELOPMENT, VEHICLETRAFFIC, THE GYMNASIUM AND BANQUET FACILITY WITH THE INCREASED NIGHT TIME USE, AND THE NET IMPACT ON BUSINESS. MR. JOHN HARBOUR, 110 ROYAL COURT, APPEARED BEFORE COUNCIL AND STATEO HE DOES NOT WANT A 35 FT. ITA�IAN VILLA STYLE BUILDING IN HIS BACK YARD,AND HE WANTS TO PRESERVE AS MANY TREES AS POSSIBLE. HEARING NO FURTHER COMMENTS, THE JOINT DOCKETED PUBLIC HEARING WAS CLOSED. COMMUNICATIONS FROM MAYOR AND COUNCILMEMBER. COUNCILMEMBER KIM BRIZENDINE REP4RTED ON THE MAINSTREET TASK FORCE MEETING AND INVITED COUNCIL AND THE PUBLIC TO ATTEND, REPORTED THE 7EXAS NATURAL RESOURCE CONSERVATION COMMISSION WILL HOLD A PUBLIC HEARING ON JANUARY 9T", 2001 AT CHALLENGER PARK REGARDfNG CLEAR CREEK CONTAMINANTS, AT 7:00 PM, STATED THAT WE ARE BLESSEO WITH A VERY SUCCESSFUL FOOTBALL TEAM, THEY HAVE GREAT TA�ENT AND HEART,AND 12/4/00 1695 HONOR THOSE THAT BRING HONOR, GALI.ANT EFFORTS, AND GREAT REPRESENTATION TO THE CITY OF FRIENDSWOOD. COUNCILMEMBER TAYLOR ALSO STA7ED THAT FRIENDSWOOD IS BLESSED WITH A VERY SUCCESSFUL FOOTBALL TEAM AND THE GREAT HONOR THE TEAM BROUGHT TO THE CITY AND COMMENDED THE PLAYERS AND THE POSITIVE MANNER IN WHICH THEY PLAYED. COUNCILMEMBER MEASELES REPORTED ON ATTENDING THE COMMUNITY APPEARANCE BOARD MEETING AND THAT THEY ARE PLANNING THEIR ANNUAL TREE GIVEAWAY, REMINDED EVERYONE OF �=; THE 30T"ANNUAL TREE LIGHTING AT THE BROWN MUSEUM TOMORROW AT 7:00 PM SPONSORED BY THE FRIENDSWOOD HISTORICAL SOCIETY AND THE HERITAGE GARDENERS AND THE 15T"ANNUAL � LIGHTED PARADE SPONSORED BY THE CHAMBER WHICH WILL BE HELD ON SATURDAY, DECEMBER 9T" AT 6:30 PM. COUNCILMEMBER KITTEN BRIZENDINE REPORTED THAT SHE ATTENDED SOME OF THE SAME FOOTBALL GAMES AND IT IS A HONOR TO HAVE A TEAM LIKE THIS,AND REMINDED EVERYONE THAT DECEMBER 7T" IS THE ANNIVERSARY OF THE BOMBING OF PEARL HARBOR,AND WISHED EVERYONE TREASURED BLESSINGS CONTINUE THROUGH THE COMING YEAR. COUNCILMEMBER ERICSSON REPORTED ON MEETING WITH SENATOR PHIL GRAMM'S SOUTH EAST TEXAS REGIONAL DIRECTOR CHRIS DEVANEY WHO REPORTED THAT THE CLEAR CREEK PROJECT IS MOVING FORWARD AND WE NEED TO KEEP THEM INFORMED, DISCUSSED THE INTERNET SALES TAX ISSUE AND THE ADVERSE IMPACT ON TEXAS AND WILL TAKE THE INFORMATION BACK TO THE SENATOR. COUNCI�MEMBER GOZA RECOGNIZED THE FOOTBALL TEAM AND THE GOOD JOB THAT WAS DONE BY THE TEAM. MAYOR WHITAKER RECOGNIZED THE FOOTBALLTEAM AND OTHER RECOGNITIONS RECEIVED BYTHE SCHOOL, CONGRATULATED THE TEAM AND STATED HOW HE WAS PROUD OF THIS GREAT TEAM AND THEIR GREAT ACCOMPLISHMENTS AND THE TEAM SHOIlLD HOLD THEIR HEADS UP HIGH. MAYOR WHITAKER ALSO REPORTED HE ATTENDED THE GULF COAST WASTE AUTHORITY MEETING DURING WHICH THE BUDGET WAS PASSED AND DISCUSSED THE CAPITAL PROJECTS PLAN, REPORTED ON NOVEMBER 30TH, ATTENDED WITH THE CITY MANAGER AND COUNCILMEMBER BRIZENDINE, THE FRIENDSWOOD INDEPENDENT SCHOOL DISTRICT MEETING WHERE DISCUSSIONS WERE HELD REGARDING COMMON ISSUES SUCH AS TRAFFIC ISSUES INVOLVING WINQSONG AND CLINE � SCHOOLS, REPORTED ON THE BLACKHAWK FACILITIES WHICH ARE OVER 30 YEARS OLD AND THAT � THE GULF COAST WASTE AUTHORITY HAS DONE A GOOD JOB REFURBISHING AND UPGRADING, BUT HAVE IDEN�fF1ED UPGRADING NEEDS TO BE MADE fN THE AMOUNT OF $3.6 MIlLION, THE BOARD WORK SHOPPED AND REVIEWED NEEDED REPAIRS AND A FURTHER REVIEW REDUCED THAT AMOUNT TO $1.6 MILLION WHICH IS APPROXIMATELY 52% LIABILITY FOR FRIENDSWOOD, REPORTED THAT THERE ARE SEVERAL WAYS TO HANDLE EXPENDITURES SUCH AS REVENUE BONDS WHICH COULD INCREASE SEWER RATES 3 1/2Jo, AND WOULD LIKE COUNCIL TO TAKE A LOOK AT THESE ITEMS NEEDING REPAIR OR UPGRADING, THE TIMELINE IS NOT A RUSH, BUT SOMETHING NEEDS TO BE DONE. MAYOR WHITAKER SUGGESTED A COUNCIL WORK SESSION IN SIX TO EIGHT WEEKS WITH A LIST OF PRIORITIES FOR COUNCIL. MR. FRED KRCH, 209 DAWN, APPEARED BEFORE COUNCIL WITH SOME TRIVIA REGARDING GOVERNMENT, THE CONSTITUTION OF THE UNITED STATES AND THE CHARTER OF FRIENDSWOOD. MR. KRCH STATED THAT THE CONSTITUTION TELL WHAT TO DO AND THE CITY CHARTER TELLS PEOPLE WHAT THEY CANNOT DO AND REMINDED COUNCIL THAT TAX MONEY IS NOT YOURS TO GIVE AWAY. 12 /4/00 1696 MS. KATHY HALE, 902 APPLEWOOD, PRESIDENT OF THE FOOTBALL BOOSTER CLUB APPEARED BEFORE COUNCIL AND STATED SHE IS PROUD OF THE FOOTBALL TEAM AND THANKED THOSE IN THE CITY THAT SUPPORTED THE TEAM AND REPORTED THAT SOMETHING HAPPENED LAST WEEK...THE SIGNS OF SUPPORT THAT WERE PLACED IN THE MEDIAN WITH THE PERMISSION OF JON BRANSON, WERE PICKED UP BY A POLICE OFFICER AND THROWN IN THE DUMPSTER. MS. HALE STATED THAT SHE DID NOT HAVE A PROBLEM WITH THE CITY BUT RATHER SHE HAD A PROB�EM WITH THE POLICE DEPARTMENT AND THE OFFICER, AND STATED SHE WAS ASKING FOR A CHECK TO COVER THE SIGNS AND A LETTER OF APOLOGY FROM THE POLICE OFFICER TO THE FOOTBALL TEAM. MAYDR WHITAKER RESPONDED THAT THIS INCIDENT DOES NOT REFLECT THE ATTITUDE OF THE CITY, APOLOGIZED FOR THIS INCIDENT, STATED IT IS UNDER INVESTIGATION AND ASSURED MS. HALE THAT APPROPRIA7E ACTIONS WILL BE TAKEN. CITY MANAGER COX ALSO APOLOGIZED FOR THIS INCIDENT AND STATED THAT APPROPRIATE ACTION WILL BE TAKEN. MR. COX REPORTED THAT HE AND DIRECTOR OF ADMINISTRATIVE SERVICES ROGER ROECKER ATTENDED THE HOUSTON GALVESTON AREA COUNCIL ADVISORY COMMITTEE MEETING ON PUBLIC AGGREGATION OF ELECTRIC POWER AND SUGGESTED THIS SUBJECT BE INCLUDED IN A FUTURE WORKSHOP. **COUNCILMEMBER ERICSSON MOVED TO APPROVE A 5.5°�o INCREASE IN THE CITY MANAGER'S ANNUAL SALARY IN THE AMOUNT OF $4,979 BASED UPON HIS ANNUAL EVALUATION. SECONDED BY COUNCILMEMBER KITTEN BRIZENDINE. THE MOTION WAS APPROVED UNANIMOUSLY. COUNCILMEMBER ERICSSON STATED THAT IT IS A HONOR TO SERVE WITH THE CITY MANAGER. COUNCILMEMBER KIM BRIZENDINE STATED COUNCIL RAISED THE BAR WITH MORE ACCOUNTABILITY, BETTER SERVICE TO THE PUBLIC AND EXPRESSED KUDOS TO AL� THE CITY MANAGER HAS DONE, STATED HE HAS DONE A VERY GOOD JOB DEALING WITH THE CONCEPTUAL IDEAS OF COUNCIL AND STATED TNAT NE 1S GLAD TO HAVE CITY MANAGER COX LEADING THE CITY. COUNCILMEMBER MEASELES STATED THAT MR. COX IS HIGHLY RESPECTED THROUGHOUT THE STATE AND APPRECIATES ALL HE DOES. COUNCILMEMBER KITTEN BRIZENDINE RECOGNIZED THE MAGNITUDE OF THE JOB THE CITY MANAGER DOES. MAYOR WHITAKER SECONDED WHAT EVERYONE NAD STATED, AND PRAISED MR. COX ON NIS EFFORTS, INTEGRITY AND ALL THAT HE DOES FOR THE CITY.
