AT FRIENDSWOOD CITY HALL COUNCIL CHAMBERS, 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR HAROLD L. WHITAE�R MAYOR PRO TEM MEL MEASELES COUNCILMEMBER JERRY ERICSSON COUNCILMEMBER TOM MANISON COUNCILMEMBER KIM BRIZENDINE COUNCII�MEMBER LARRY TAYLOR CITY MANAGER RON COX CITY SECRETARY DELORIS MGKENZIE COUNCII.MEMSER HAJECATE WAS ABSENT FROM THE MEETING. MAYOR WHITAKER CALLED THE MEETING TO ORDER. DISCUSSION WAS HELD REGARDING SURFACE WATER ISSUES AND THE HARRIS/GALVESTON COASTAL SUBSIDENCE DISTRICT. CITY MANAGER COX MADE A PRESENTATION AND REVIEWED REQUIREMENTS REGARDING THE SUBSIDENCE DISTRICT REGULATORY PLAN, THE GROUNDWATER REDUCTION PLAN (GRP] , SURFACE WATER NEEDS, SEEKING ADDITIONAL SURFACE WATER AND THE ESTIMATED COST. MR. COX STATED THAT A GROUNDWATER REDUCTION PLAN WILL BE DEVELOPED WITH THE USE OF A CONSULTANT AND WILL DETERMINE THE AMOUNT OF SURFACE WATER TO PURCHASE. A LENGTHY DISCUSSION WAS HELD REGARDING CAPACITY AND COSTS, USING A CONSULTANT TO DEVELOP A GRP FOR THE CITY, THE SUBSIDENCE DISTRICT'S LACK OF COMMUNICATION REGARDING CHANGING OF TIME CONSTRAINTS AND THE MAKE UP OF THE BOARD. CITY MANAGER COX WILL BRING BACK A REPORT FROM THE CONSULTANT AS SOON AS POSSIBLE. A SHORT BREAK WAS TAKEN AT THIS TIME. COUNCIL CONVENED IN REGULAR SESSION AT 7:00 PM. THE INVOCATION WAS GIVEN BY REVEREND DENNIS OWENS REPRESENTING THE NEW LIFE ASSEMBLY CHURCH. MAYOR WHITAKER LED THE PLEDGE OF ALLEGIANCE TO THE STATE OF TEXAS AND TO THE UNITED STATES. MAYOR WHITAKER AND CHAIR OF THE PLANNING AND ZONING CObIIviISSION BILL FINGER CA.LLED A JOINT DOCKET�D PUBLIC HEARING TO ORDER TO RECEIVE COP�NTS FROM THE PUBLIC, BOTH ORAL AND WRITTEN, REGARDING A REQUEST FOR A SPECIFIC USE PERMIT-DRY CLEANING PLANT FOR PROPERTY LOCATED AT 102 S. FRIENDSWOOD DRIVE, AT FM 2351 (OLD DIAMOND SHAMROCK BUILDING) CITY OF FRIENDSWOOD, TEXAS. MR. TOM RIVES, ARCHITECT, REPRESENTING THE FIRM OF CLEANERS DEPOT EQUIPMENT COMPANY, AND DREW THE PLANS FOR THE FACILITY. A LETTER EROM CLEANERS DEPOT EQUIPMENT COMPANY, SIGNED BY RAFIG KARIMI, AND DATED � ��� NOVEMBER 18, 1999, WAS READ INTO THE RECORD. NO ONE SPOKE IN FAVOR OF THE SPECIFIC USE PERMIT. MR. BILL MARENS, REPRESENTING THE MANAGEMENT COMPANY OF CAPTAIN'S CORNER, APPEARED BEFORE COUNCIL TO EXPRESS HIS CONCERNS REGARDING ENVIROIa�NTAL AND TRAFFIC ISSUES. MS. SUSAN WRIGHT, BUCKINGHAM COURT, APPEARED BEEORE COUNCIL WITH CONCERNS REGARDING THE CHEMICAL "PERK" AND THE HAZARDS, ASKED HOW MANY DRY CI,EANERS DO WEE NEED, , WHY NOW ARE ALL THESE BUSINESSES COMING TO FRIENDSWOOD, DO DRY CLEANERS FIND IT ATTRACTIVE BECAUSE THE REGULATIONS HERE ARE LESS RESTRICTIVE, AND WHAT HAPPENS IF THERE ARE TOO MANY PLANTS AND IF THEY LEAVE, WHO WILL CLEAN UP? MS. VICKY WHYNOTT, FALCON RIDGE, APPEARED BEFORE COUNCIL TO EXPRESS CONCERNS REGARDING "PERK" CONTAMINANTS, BRINGING IN LAUNDRY EROM OUTSIDE THE CITY, STATED THERE WILL BE NO ADDITIONAL REVENUE TO THE CITY, STATED THAT COUNCIL HAS ALREADY HEARD COD�NTS FROM RESIDENTS, REFERRED TO E.P.A. DATA INFOFtMATION REPORT AND THE CITY CONSULTANT REPORT, APPLAUDED COUNCIL E'OR CONSULTING WITH A CONSULTANT, REVENUE IS THE ISSUE, TAKING BUSINESS AWAY FROM OTHER BUSINESSES, STATED THAT THE CITY NEEDS TO BE �7ERY CAREFUL WHAT WE PICK AND BRING IN AND WHERE THE BUSINESS IS PLACED, THAT IT SHOULD BE IN THE RIGHT PLACES, ASKED WE�P,T KIND OF MACHINES WILL THE PLANT USE AND HOW MANY, AND STATED THAT SHE WANTS TO SEE OUR PROPERTY SAFE, AND FEELS TFiE CITY IS NOT GETTING ENOUGH MONEY FOR THE RISK TAKEN. HEARING NO FURTHER COML`�NTS, THE PUBLIC HEARING WAS CLOSED. MAYOR WHITAKER REPORTED THAT COUNCILMEMSER HAJECATE WAS ABSENT DUE TO HER FATHER BEING ILL. COUNCILMEMBER ERICSSON REPORTED ON ATTENDING THE HOUSTON/GALVESTON AREA COUNCIL MEETING. COUNCII�MEMBER MANISON WISHED EVERYONE A HAPPY NEW YEAR AND HAPPY MILLENNIUM, AND REPORTED DIRECTOR OF ADMINISTRATIVE SERVICES, ROGER ROECKER, WAS 1�IAMED VOLUNTEER OF THE YEAR BY THE PEARLAND COPPINGER YMCA. COUNCILMEMBER BRIZENDINE DID NOT MAKE A REPORT. COUNCII�MEMBER TAYLOR EXPRESSED HIS GRATITUDE TO THE FRIENDSWOOD EMS WHO RESPONDED TO A CALL REGARDING HIS FATHER ON CHRISTMAS EVE. COUNCILMEMBER TAYLOR EXPRESSED HIS APPRECIATION TO THE VOLUNTEERS WHO RESPONDED TO THE CALL VERY QUICKLY AND VERY PROFESSIONALLY. COUNCII�MBER MEASELES WISHED EVERY ONE A HAPPY NEW YEAR AND STATED THAT HIS YOUNGEST GRANDDAUGHTER IS VERY Y2 COMPATIBLE. MAYOR WHITAKER WISHED EVERYONE A HAPPY NEW YEAR, AND REPORTED ON DECEMBER 21, HE ATTENDED A MEETING WITH REPRESENTATIVES FROM THE POLICE DEPARTMENT AND GALVESTON COUNTY REPRESENTATIVES IN SANTA FE REGARDING THE COUNTY JUSTICE INVESTIGATIONS UNIFORM SYSTEM. MR. JEFF BRANSCOME, FOUNDER OF THE FRIENDSWOOD CITIZENS FOR PROPER ANIMAL CONTROL, APPEARED BEFORE COUNCIL ASKING FOR COUNCIL`S HELP, CALLING FOR ACCOUNTABILITY, AND SUBMITTED A REPORT PUT TOGETHER WITH OTHER CITIZENS' INPUT TO ASK FOR A CITIZEN COMMITTEE. MR. MR. KEVIN WINDOW, VICE PRESIDENT OF THE FRIENDSWOOD GIRLS SOFTBAI.,L ASSOCIATION (FGSA) , APPEARED BEFORE COUNCIL AND ASKED FOR SIJPPORT FOR THE PROPOSAL FOR LIGHTING AT FIELD #4 IN E�2IENDSWOOD SPORTSPARK, STATED HE HAS SECURED IN-KIND CONTRISUTIONS, AND ASKED FOR COUNCIL'S SUPPORT. PRESIDENT OF FGSA JOHN MOTSCH APPEARED BEFORE COUNCIL AND STATED THAT THE GIRLS SOFTBALL ASSOCIATION HAS THE FINEST FACILITIES IN THE AREA, THEE FIELDS HAVE LIGHTING, BUT NEED THE FOURTH FIELD LIGHTED FOR NIGHT PRACTICE AND GFiMES AND STATED HE IS ASKING FOR COUNCIL'S SUPPORT FOR ADDITION FUNDING, THE ASSOCIATION CAN PROVIDE $5,000 FROM THE F.G.S.A. , HAS SOME FUNDING FROM THE PARKS DEPARTMENT, BUT NEEDS ADDITIONAL FUNDING FROM THE CITY. MR. BEA MORRIS, WESTFIELD LAND, APPEARED BEFORE COUNCIL REGARDING THE LACK OF RESPONSE FROM ANIMAL CONTROL, STATED THE MUNICIPAL COURT CLERKS BLOCK FILING COMPLAINTS, MET WITH OFFICER WEINER BUT HE NEVER GOT BACK WITH FiER, FILED 20 COMPLAINTS AND DID NOT GET NOTIFIED OF THE COURT DATES, STATED THE J[JDGE DISMISSED ALL THE COMPLAINTS, AND CHALLENGED COUNCIL TO DO A RANDOM CHECK OF COMPLAINTS RECEIVED, AND STATED SHE DOES NOT FEEL JUDGE WOLTZ IS DOING THE JOB AND ASKED COUNCIL TO REVIEW HIS ACTIONS AND SERIOUSLY CONSIDER REPLACING HIM. MS. GRACE ELIZONDO APPEARED BEFORE COUNCIL REGARDING A PACK OF DOGS THAT ROAMS HER NEIGHBORHOOD AND STATED THERE IS NO ACCOUNTABILITY, AND NOTHING IS BEING DONE, AND THIS IS AFFECTING THE QUALITY OF LZFE IN FRIENDSWOOD. MAYOR WHITAKER ASKED THE CITY MANAGER TO LOOK INTO THE SITUATION AGAIN. COUNCIII�MBER BRIZENDINE SUGGESTED A MEETING WITH SOME OF THESE PEOPLE AND REVIEW � CHANGES THAT HAVE BEEN MADE AND SEE IF THERE NEEDS TO BE SOME ADDITIONAL CHANGES. CITY MANAGER COX REPORTED ON SEISMIC TESTING. MR. COX STATED THAT HE MET WITH CARROLL SHEARER, PROJECT 6EOPHYSICIST FOR EOG RESOURCES, A SUBSIDZARY OF ENRON TO DISCUSS THE PROGRESS THEIR COMPANY IS MAKING ON THE SEISMIC TESTING PROGRl1M RECENTLY PERMITTED BY THE CITY COUNCIL. ON OCTOBER 4, 1999, COUNCIL APPROVED A PERMIT TO ENRON CORPORATION TO CONDUCT SEISMIC TESTING IN FRIENDSWOOD. SINCE THAT TIME, ENRON HAS BEEN COMPLETING ITS PREPARATORY WORK. THE CITIES INVOLVED ARE ALVIN, DICKINSON, FRIENDSWOOD, LEAGUE CITY AND WEBSTER. MR. COX STATED THAT ALL THE CITIES, EXCEPT WEBSTER, HAVE APPROVED A PERMIT. PRELIMINARY SURVEYING HAS BEGUN BUT ENRON IS AWAITING FINAL APPROVl1L OF THE PERMIT REQUEST FROM WEBSTER BEFORE ACTIVATING THE TIME-RESTRICTED PERMIT. ONCE THAT OCCURS, THE PERMIT WZLL BE SIGNED, WITH ALL RELATED INSURANCE AND BONDING REQUIREMENTS. IN ADDITION, THE CITIES ARE WORKING TOGETHER TO USE THE SAME CONSULTANT TO OVERSEE THE PROJECT FOR THE CITIES. LEAGUE CITY WILL BE THE LEAD ADMINISTRATOR WITH THE CONSULTANT, SINCE THEY HAVE ALREADY HIRED AN INDIVIDUAL. HE WILL WORK ON BEHALF OF ALL THE CITIES INVOLVED, AND ENRON WILL PAY THE COSTS. **COUNCII�MEMBER MANISON M0�7ED TO APPROVE ACTION ADDITIONAL FUNDING FROM THE CONTINGENCY FUND IN THE AMOtJNT OF $6,250 FOR LIGHTING AT FIELD #4 IN FRIENDSWOOD SPORTSPARK. SECONDED BY COUNCII�MEMBER TAYLOR. THE MOTION PASSED 402 WITH MAYOR WHITAKER AND COUNCILMEMBER BRIZENDINE OPPOSED. **COUNCII�MEMBER MANISON MOVED TO APPROVE RESOLUTION R2000-02, A RES�LUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, SUPPORTING THE FRIENDSWOOD POLICE DEPARTMENT'S GRANT APPLICATION TO THE HOUSTON-GALVESTON AREA COUNCIL OF GOVERD'Q�NTS FOR IMPLEMENTATION OF A SCHOOL RESOURCE OFFICER PROGRAM AT THE FRIENDSWOOD JUNIOR HIGH AND HIGH SCHOOL C�USES. THE PROJECT IS 79 PERCENT COMPLETE. 2. 1999 DRAINAGE IMPROVEMENTS WITH THE FIRST AND SECOND PAYMENT IN THE AMOUNT OF $106,901.53 TO REBEL CONTRACTORS, INC. FOR CONSTRUCTZON SERVICES ON BOCA RATON DETENTION POND AND EL DORADO STORM SEWER. THE PROJECT IS 73 PERCENT COMPLETE. RETAINAGE IS TEN PEF2CENT. TOTAL PAYMENTS WERE $112,403.25. B. DISPOSITION OF BID NO. 99-19: PURCHASE OF (2) EXTENDED CAS PICK-UP TRUCKS FOR FIRE MARSHAI�'S OFFICE TO MCREE FORD IN THE AMOUNT OF $33,570. C. APPROVAL OF RESOLUTION R2000-01, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS AUTHORIZING THE POLICE DEPARTMENT TO USE UNMARKED VEHICLES IN ORDER TO FACILITATE POLICE UNDERCOVER WORK AND OTHER LEGITIMATE FUNCTIONS OF THE POLICE DEPARTMENT. D. APPROVAL OF CONTRACT WITH CLAUNCH & MILLER FOR WATER/SEWER IMPACT FEE STUDY AND AUTHORIZE THE MAYOR TO EXECUTE THE DOCUMENTS. E.
