COUNCIL RE-CONVEI�TED INTO REGULAR SECTION WITH NO ACTION TAKEN. CITY MANAGER RON COX GAVE THE INVOCATION. BOY SCOUT TROOP 443 LEDGE THE PLEDGE OF .ALLEGIANCE TO THE UNITED STATES AND TO THE STATE OF TEXAS. MAYOR NEWMAN CA]:,LED A PUBLIC HEARING TU ORDER TO RECEIVE COMMENT, EITHER ' ORAL OR WRITTEN, REGARDING PERFORMANCE EVALUATION OF TCI CABLEVISION OF HOUSTON ACCORDING TO FRANCHISE ORDINANCE 95-6. CITY MANAGER RQN COX GAVE A BACKGROUND REPORT REGARDING THE CITY OF FRIENDSWOOD'S FF2ANCHISE FOR CABLE TELEV:ISION SERVICE AND STATED THE FRANCHISE AGREEMENT AUTHORIZES THE CITY COUNCIL TO CALL A PUSLIC HEARING EVERY THREE YEARS DURING THE TERM 0�' 7'HE AGREEMENT. ON MR. COX'S� RECOMMENDATION, THE CITY COUNCIL CALLED THIS PUBLIC HEARING FOI2 TWO REASONS: 1. TCI ARBITRARILY CHANGED CHANNEL SELECTTON WITHOUT PROPER NOTICE TO THE SUBSCRIBERS; 2. THE COMPANY HAS NOT FULFILLED ITS OBLIGATION UNDER SECTION 10.01 ANI� 11.1 OF THE AGREENiENT TO PROVIDE AN UPGRADED LEVEL OF SERVICE TO THE "HIGHEST ACCEPTED STANDARDS IN THE CABLE TEI,EVISION INDUSTRY. . ." MR. COX ALSO EXPLAINED THE PROCESS INVOLVED IN DETERMINING CURRENT RATES TCI CHARGES AND THAT THE FCC, THE FEDE�2AL REGULATORY AUTHORITY, ONLY ALLOW5 THE CITIES TO REGU'I�ATE RA7`ES FOR BASIC CABLE SERVICE, THE 'FIRST 12 CHANNELS ON THE DIAL. THE CITY DOES NQT HAVE THE AUTHORITY TO REGULATE THE R.ATES TCI CHARGES FOR THE UPPER TIER, NOR FOR PAY TV, NOR FOR THE SPECIALTY CHANNELS SUCH AS THE DISNE'Y CHP;NNEL OR HBO. MR. COX FURTHER ,,.__,., , V . . __ '_""'___. ...-___' _'___"'_ _. 1066 EXPLAINED THAT WHILE RATES ARE IMPORTANT TO ALL CUSTOMERS, 'I'HE CITY WANTS EVERYONE TO REALIZ� THAT THE CITY COUNCIL HAS ONLY LTMITED CONTRQL OVER THOSE RATES. MR. COX REPORTED THAT TCI IS REQUESTING A 21% RATE INCREAS� WHICH IS THE THIRD REQUEST IN 3 YEARS. MS. JILL MACK, REPRESENTING TCI CABLEVISTON, APPEARED BEFOF2E COUNCTL AND APOLOGIZED FOR THE PROBLEMS THAT HAVE BEEN EXPERIENCED BY TCI CUST�MERS. MS. MACK STATED THAT TCI CREATED PROBLEMS FOR CUST4MERS REGARDING SENDING OUT NEW CHANNEI, CARDS AND THAT LOCAT., CUSTOMERS WERE NOT MAD� AWARE OF THE CHANGES, TCI WAS SWAMPED WITH ANGRY CALLS, AND STATED SHE HC7PED EVENTUALI,Y THE PUBLIC WILL ACCEPT THE APOLOGY. MS. MACK ALSO APOLC�GIZED FOR THE � CALLERS WHO GOT A BUSY SIGNAL BUT TCI HAD �JVER 300,000 CUSTOMER CALLS AND DID NOT HAVE ENOUGH PEOPI�E TO HANDLE THESE CALLS. MS. MACK hEPORTED ON THE �---� LATEST TECHNOLOGY THAT TCI WILL USI's. MR. JXM FITCH, MS. LIZ WAGNER, MR. CHARLES GROVES, MR. RALPH BLAUGH, MS. MARY PRIDE, MS. MARCH MCANNI'CH, AND MR. FRANK WEBB AYPEARED BEFORE COUNCIL TO EXPRESS THEIR CONCERNS AND COMPLAINTS REGARDING POOR CUSTOMER SERVICE, POWER OUTAGES, EQUIPMENT, CHANGES IN STATIONS, POOR QUALITY, RATE INCREASES, OFFERING FRANCHISE TO OTHER OPERATORS, AND PAYMEbIT DROP BOX IN FRIENDSWOOD. MS. LUCY WOLTZ APPEARED BEFORE COUNCIL AND STATED THAT TCI DTD HAVE A PAYMENT DROP AT THE CHAMBER BUT CANCEZLED 'I`HE DROP, COUNCILMEMBER MEZ AUSTIN SUMMARIZED THE STATEMENTS STATING THAT IT APPEARS THAT CUSTOMERS ARE PAYING MORE FOR POOR QUALITY. CITY MANAGER COX STATED THAT THER.E 7:S A LARGER ISSUE THAN FIBER OPTICS AND THAT TCI SHOULD BE MORE INVOLVED WITH CUSTOMER SERVICE AND STATED THE CITY WTLL FORMALIZE THE COMPLAINTS MADE AND WILL EXPECT A RESPUNSE FROM TCI, INVITED OTHER COMPANIES TO COME IN TO WORK ON A SECOND FRANCHISE AU'1zEEMENT, STATED THAT TCI HAS GIVEN POOR CiJSTOMER SERVICE, POOR Q'UALITY, HIGHER RATES, CHANGING FIBER OPTICS, PAYMENT BOX IN F'RIE�TDSWOOD, POOR PROGRAMMING, AND STATED THE ISSUES WERE HEARD TONIGHT AND THAT THE CITY' WILL FOLLOW UP ON. COUNCILMEMBER LOWE STATED THAT SHE BELIEVES THAT THIS IS A COALITION PROCESS. CITY MANAGER COX STATED THAT THIS COULD BE SET UP WITH THE C:LEAR LAKE AREA WORKING TOGETHER FOR A CONII�ION FRANCHISE ORDINANCE, HIRE A CONSULTANT OUT OF DALLAS, HAVE TECHNICAL PEOPLE APPOI]NTED TO DEVELOP A FRANCHISE AGREEMENT, CONTINUE RATE REGULATION, TI3ERE AItE 'ABOUT 9 CITIES IN THE BAY AREA TIiAT ARE MEMBERS OF THE COAZITIQN AND THA.T THE'Y HAVE BEEN VERY HELPFUL. FOUKDATION'S MEETTNG AT ELLINGTON, RECEIVED A REPORT FRON! HIS DOCTOR AT M.D. ANDERSON THAT WITH HTS SIX MONTHS THERAPY, THEY FOttND NO NEW GROWTH AND BELIEVES HE IS IN A STATE OF REMISSTON, ATTENDED THE H.C.M.& C.
