MR. HAL TAYLOR, CHAIR OF ZONING BOARD OF ADJUSTMENT, APPEARED BEFORE COUNCIL
REGARDING A RECENT ZONING BOARD OF ADJUSTMENT CASE FOR A VARIANCE FOR AN
ACCESSORY BUILDING AND REQUESTED COUNCIL TO DEFINE "YARD" AND PLACEMENT OF
ACCESSORY BUILDING.
MR. PAUL SCHRADER APPEARED BEFORE COUNCIL AND ADDRE5SED THE RECYCLING FEES,
STATING HE DOES NOT SUPPORT REFUNDING THE I2EC'YCLING FEES AS THIS IS AN
INSIGNIFICANT AN[OUNT BUT COMBINED WITH OTHER FUNDS COULD PROVIDE FOR A
SPECIFIC PROJECT AND SUGGESTED EXTENI�ING THE RECYCLING TO APARTMENT
COMPLEXES.
MR. SCHRADER ADURESSED THE BRIO & DOP SUPERFUND SITES AND STATEMENTS THAT
HAVE BEEN MADE REGARDING THESE SITES. MR. SCHRADER STATED HIS CONCERNS
REGARDING COUNCI'LMEMBER LOWE'S DISCUSSION REGARDING BRIO, CITED THE CODE OF
ETHICS AND TEXAS LOCAL GOVERNMENT CODE AND CONF'LIrT OF INTEREST DUE T0 THE
LOWE'S SUBSTANTTAL INTEREST IN THE SITE. MR. SCHRAI)ER STATED HE WOULD LEAVE
IT UP TO THE COIJNCIL TO DETERMINE IF COUNCILOMEMBER LOWE HAS A C:UNF'LICT OF
' INTEREST. MR. SCHRADER STATED HE WAS �TOT MAYOR NOR ON COUNCIL WHEN THE
BRIO/DOP SITES WERE ANNEXED AND THAT THE SITES WERE DECLARED A SUPERFUND
SITE IN 1985, BUT HE WAS ON COUNCTL WHEN THE ANNEXATIUN PROCEEUINGS BEGAN.
COUNCILMEMBER LOWE STATED SHE HAS FILED CONFLICT OF INTEREST STATEP�ENTS WITH
THE CITY SECRETARY AS REQUIRED EVEN THQtJGH THREE ATTORNEYS HAVE NOT BEEN
ABLE TO DETERMINE ON CERTAIN ISSUES IF SI3E HAS A CONFLICT BUT STATED SHE

CITY MANAGER COX REPORTED ON ATTENDING THE TCMA ANNLTAL CONFERENCE IN
MIDLAND, JUNE 21-24 AND STATED THAT HE ASSUMED THE POSITION OF
PRESIDENT—ELECT OP THIS GROUP AND THAT HE WILL BECOME PRESTDENT IN JUNE
1997. MR. COX ALSO REPORTED THAT ACCESS LOCAL GOVERNMENT (ALG) IS AN
INTERNET PROJECT OF THE NATIONAL LEAGUE OF CITIES AND IS COSPONSORED BY
MANY STATE LEAGUES, INCLUDING TML. MR. COX STATFD THAT AT TE-TEIR QUARTERLY
MEETING, THE TCMA BOARD AGREED TO COVER THE COST OF THE FIRST SIX MONTHS OF

REPAIR PROJECT - ONE BID WAS RECEIVED AND WAS CONSIDERABLY HIGHER THAN THE
AMOUNT BUDGETED; THEREFORE THE RECOMMENDATION OF STAFF IS TO REJECT THE I

BID. IN THE ALTERNATIVE, STAFF RECOMMENDS A SERIES OF REPAIR TO AS MANY
LOCATIONS AS THE BUDGET WILL ALLOW. THESE REPAIRS WILL BE TO MUDJACK THE
STREETS. REPAIR WILL BE DONE UP TO THE BID LIMITATION OF� $15,000, AND
