CONSULTATION WITFI ATTORNEY CONCERNING PENUING OR CONTEMPI.,ATED LITIGATION.
COUNCIL RECONVENED INTO REGULAR SESSION AT 6:45 P.M.
DISCUSSION WAS E(ELD REGARDING THE COMPREHENSIVE PLAN WITH CITY MANAGER COX
PROVIDING A RECAP OF THE DEVELOPMENT OF THE PLAN. MR. COX STATED THE
PROPOSED PLAN HAS BEEN PREPARED BY THE �?LANNING AND ZONING COMMISSION WITH
THE ASSISTANCE OF STAFF AND J.T. DUNKIN AND ASSOCIATES OVER THE LAST YEAR.
MR. COX REPORTEI� THE PLAN HAS UNDERGONE EXTENSIVE REVIEW BY PLANNTNG AND
ZONING AND COUNCIL HAS REVIEWED THE DOCI7MENT ON AUGUST 14 AND NOVEMBER 13,
1995. MR. COX .3TATED THE LAST TIME COUNCIL REVIEWED THE PI.,AN, MOST OF THE
TIME WAS SPENT REVIEWING THE THROUGHFARE COMPONENT OF THE PLAN. MR. COX
I STATED THIS WORK SESSION HAD BEEN ORIGINALLY llEDICATED TO COVER ONLY THE
COMPREHENSIVE PLAN BUT �OItNCILMEMBER LOWE REQUESTED OTHER ITEMS BE DISCU�SED
AT THIS MEETING AND EXPRESSED I3ER CONCERN THAT COUNCIL NOT MOVE E'ORWARD WITH ,
THE REVIEW UNTIL PLANNING AND ZONING HAS LOOKED AT ALL THE USES DESZGNATED
WITHIN THE VARIOUS ZOI�ES. MR. COX STATE�7 EA�H ZONE OF THE CITY HAS WITHIN
IT A LIST OF PERMITTED USES; I�IOST COMMOI�tI,I� THE PERMITTED USE TABLE IN THE
ZONING ORDINANCE IS USED TO LEARN AND GUIDE WIiAT USES CAi�I TAKE PLACE, MR.
COX STATED THEI2E IS ONE ADDITIONAL kZE�'ERENCZ, WHICH IS THE STANDARD
INDUSTRIAL CLASSTFICATION (SIC) MANUAL OF 1972 WHICH IS ALSO A GUIDE AND IS
REFERENCED IN THE ZONING ORDINANCE. THE SIC MANUAL LISTS MANY USES WITHIN A
ZQNING CLASSI�'IC�TION THAT MAY NOT NECESSARILY BE ON THE PERMITTEI7 USE
TABLE. MR. COX STATED COUNCILMEMBER LOWE CONTENDS THE SIC MANUA'L SHOULD BE
CLOSELY REVIEWED AND THE LISTS OF PERMITTED USES REVISED PRTOR TO ANY
ADDITIONAL WORK ON THE PLAN. MR. COX STATED COUNCILMEMBER LQWE`S REASONING

REGARDING COST TO MOW THE MEDIANS, DIFF�RENT TYPES OF LOW MAINTENANCE PLANTS
WHICH WOULD LOHT3?R MAINTENANCE COST, �1ND COUNCIL SUGGESTED TF3E CITY MANIXGER
CHECK WITH TXDOT TO SEE IF THIS IS FEASIBLE AT THIS POINT. COUNCIL ALSO
DISCUSSED THAT THE CITY HAS PAID $30,000 TOWARDS THE BAY AREA BOULEVARD
"PASS" PROGRAM WHICH IS REFUNDABLE IF THE PROJECT DOES NOT MOVE FORWARD.
