AT SAN JACINTO COLLEGE TO DISCUSS THE STUDY AND SUGGESTED REMEDIES THAT ARE ACCE:PTABLE TO THE '" � COMMUNITY AND REPORTED THAT NEW LA'WSUITS HAVE BEEN FILED. CITY MANAGER RON COX REPORTED ON THE CHANGE ORDER REGARUING THE SOUTH FRIENDSWOOD WASTEWATER DIVERSIONS AND THAT TXDOT H1�S DENIED THE APPLICATION TO BORE UNDER FM 518 TO TIE IN TO Tt-iE FORCE MAIN FROM THE E��GLE POINT LIFT STATION IN THE MANNER THAT W�1S ORIGINALLY PLANNED. CITY MAN��GER COX STATED THAT TXDOT HAS IN5TEAD APPROVED A DIFFERENT, MORE EXPENSIVE METHOD AND THAT THE DIFFERENCE IN THE AMOUNT FOR THE ALTERNATE BORING METHOD IS $4,309. CITY MANAGER COX REPORTED THAT THE CITY OF HOUSTON IS CC�NTINUING THEIR PLANNING FOR THE EVENTUAL EXPANSION OF THE SOUTHEAST WATFR PURIFICATIQN PLANT, LOCATED NEAR ELLINGTON FIrLD AND THAT THIS IS THE P7�ANT WHEI2E THE CITY'S SURFACE WATER IS OBTAINED, AS WELL AS OWNING A SMALL INTEREST IN CAPACITY. DIRECTOR MEINECKE'S REPORT WAS ATTACHED ANL� INCLUDED A REPORT ON THE SOUTH FRIENDSWOOD WATERLTNE, WHICH IS FULLX OPERATXONAL, AND THAT FINAL PAYMENT AND ACCEPTANCE OF THIS PROJECT IS ON THE CONSENT AGENDA. CI�Y MANAGEI2 COX ALSO STATED THAT INCLUI�ED IN THIS REPORT IS THE ELEVATED STORAGE TANK, WHICH IS NOW UNDERGOING A FINAL TESTING OF' THE WATER AND THAT RE—LETTERING SHOULD BE COMPLETED IN THE NEXT ' WEEK, DEPENDING ON THE WEATHER. CITY MANAGER COX ALSO STATED �HAT DIRECTOR MEINECKE REPORTED THAT THE ASPHALT OVERI�AY OF MOORE ROAD AND OAK DRIVE ARE ' COMPLETED AND THIS PROJECT WAS DONE WITH THE ASSISTANCE OF GALVESTON � COUNTY. CITY MANAGER COX ALSO STATED THb1T BY WAY OF REPORT, THE STREET DEPARTMENT IS NOW BACK TO WORK ON MELODY LANE; THE F'INAL THIRD IS BEING REPAIRED AND READTED FOR ASPHALT NOW AND THI�T DIRECTOR MEINECKE HOPES TO GET THAT COMPLETED IN THE NEXT 30 DAYS. CI7.'Y MANAGER COX REPORTED THAT HE REQUESTED THAT DOUG KNEUPPER, DIRECTOR OF COMMUNITY DEVELOPMENT, GI.VE A REPORT ON SEVERAL OF THE PROJECTS THEY ART' AS50CIATED WITH AND BY WAY OF SUMMARY, THE 1995 STREET PROGRAM IS PR�GRESSING WELL, WITH WOODLAWN BEING COMPLETED, AND HERITAGE APPROXIMATELY 60 PERCENT COMPLETE. CITY MANA,�ER COX REPORTED THAT DOUG KNEUPPER AND MELV:IN MEINECKE HAVE MET TWICE WITH REPRESENTATIVES OF THE CLOVER ACRES HOMEOWN�RS AND ARE FINALIZING PLANS FOR SOME IMPROVEMEN7'S IN THE AREA TO BE COMPLI?TED BY THE CITY. IN ADDITION, CITY MANAGER RE:PORTED, THAT CLF�1R CREEK DRAINAGE DISTRICT HAS COMPLETED �', THEIR WORK ON THE WEST TRIBUTARY OF COWARD'S CREEK THAT PROVIDES SIGNIFICANT DRAINAGE FOR THf? CLOVER ACRES AREA, AND THAT CLEAR CREEK DRAINAGE DISTRICT HAS PLANS TO DO MORE WORK ON THE EAST TRIBUTARY. CITY MANAGrR ALSO REPORTED THAT THE ENGINEFRING DEPARTMENT IS CURRI?NTLY WORKING ON T.HE PLANS FOR THE 1996 STREET PROJEC�, THE BICYCLE LANE nN SUNSET, AND THE PLACEMENT OF A TRAFFIC SIGNAL AT CASTLEWOOD AND SUNSET. CITY MANAGER COX REPORTED THAT HE AND COUNCILMEMBER LOWE WENT TO AUSTIN TO MEET WITH THE PUC COMMISSIQNERS REGARDING THE CITIES' ABILTTY TO PARTICIPATE IN THE DEVELOPMENT OF REGULATIONS FOR INTEGRATED RESOURCE PLANNING. CITY MANAGER COX STATED THAT _., THE INTEGRATED RESOURCE PLANNING COMMISSION WILL BE THE NEW LEVEL OF PARTICIPATION WITH THF UTILITY COMPANIES IN THETR RATE PROCEEDINGS AriD THAT HE AND COUNCILMEMBER LOWE LEARNED THE COMMISSIONERS GENERALLY SUPPORT THE � CITIES' POSITION THAT THE CITIES SHOULD BE PARTICI.PANTS IN THE PROCESS AND, FURTHERMORE, THE; UTILITIES SHOULD REIMBITRST' THE CITIES FOR THEIR EXPENSES BOTH IN THE REGULATION DEVELOPMENT STATE AND THE ACTUAL IRP PROCESS. CITY MANAGER COX STA'rED THAT THIS PAVES THE WAY FOR THE GULF COAST COALI.TIQN (HL&P RATE CASE PARTIC:IPANTS) AND THE TNP COALITION TO WORK TOGETHER TO INFLUENCE THE DE:VELOPMENT OF THE REGULATIONS FOR THE IMPLEMENTATION OF THE IRP PROCESS AT THE PUC. CITY MANAGER CGX AI,SO REPORTED THAT� THE PUC RULED THAT COMPANIES :iUCH AS METROPOLITAN F'IBFR SYSTEMS (MFS) , THE COMPANY THAT HAS FILED WITH THE PUC TO PROVIDE RETAIL TELEPHONE SERVICE IN OUR AREA, MAY NOT BE SUBJECT TO CITY FRANCHISE AGREEMENTS AND THAT THE PUC HAS DECIDED NOT TO RULE ON THE MATTER, BUT LEAVE IT UP TO THE CITIES TO INITIATE THE EFFORT. CITY MANAGER COX ALSO STATED THAT MFS IS NOT PROPOSING TO BUILD INFRASTRUCTURE I�V OUR CITY, BUT WILL USE THE EXISTING INFRASTRUCTURE OF S.W. BELL AND THAT THIS IS AN ISSUE THAT IS RISI.KG TO THE SURFACE RAPIDLY. CITY MANAGER COX ALSO STATED THAT IN FACT, COUNCILMEMBER LOWE AND HE HAD AN OPPORTUNITY TO DISCUSS THIS TSSUE WITH THE PUC COMMISSIONERS AT THE RECENT MEETING WITH THF.M TN AUSTIN AND THAT THE 1�ILEMMA IS, S.W. BELL MAY CLAIM �.._.� s 792 THAT, SINCE IT IS NOT DERI�IING TH� RETAIL REVENUE FROM THE USE OF THE LINES IN OUR CITY, THEY DO NOT OWE US A FRANCHISE PAYMENT AND THAT THIS WILL LEAVE THIS CITY, AND ANY OTHER CITY, IN THE SAME SITUATION WITH A DECLINING REVENUE AND NO ABILITY TO REGUI,ATE THOSE COMPANIES IN THOSE SITUATIONS. CITY MANAGER COX ALSO REPORTED THAT JOHN PINKSTON, GALVESTON AREA ENGINEER, HOUSTON DISTRICT QF THE TXDOT, HAS QUICKL'Y RESPONDED TO THE REQUEST FOR ASSISTANCE AT THE NEWLY CONSTRUCTED BROOKSIDE ELEMENTARY ON FM 528 IN THE CLEAR CREEK INDEPENDENT SCHOOL DISTRICT AND AN �TTACHED LETTER FROM MR. PINKSTON CONFIRMS THAT PEDESTRIAN SIGNALS AND CROSSWALKS WERE ALREADY INCLUDED IN THE.
