HomeMy WebLinkAboutOrdinance No. 2025-26 ORDINANCE NO. 2025-26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,TEXAS,MAKING CERTAIN FINDINGS;PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FRIENDSWOOD, TEXAS, AND THE ANNEXATION OF APPROXIMATELY 1.3347 ACRES OUT OF LOTS 159, 160, AND 170, SLONE SUBDIVISION ACCORDING TO THE PLAT THEREOF AS FILED IN VOLUME 254, PAGES 53-54 GALVESTON COUNTY MAP RECORDS, AND LOCATED GENERALLY SOUTHWEST OF FRIENDSWOOD LAKE PARK, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF FRIENDSWOOD, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, in 2018, the City of Friendswood (the "City") acquired approximately 1.3347 acres west of Lake Friendswood and located within the City of League City ("League City"),which property is more particularly described in Exhibit"A" which is attached hereto and incorporated herein for all intents and purposes, which property is less than one thousand feet (1,000') in width(the "Property"); and WHEREAS, pursuant to Section 43.015 of the Texas Local Government Code, the City and League City entered into an interlocal agreement to make agreeable changes in their boundaries, wherein League City agreed to disannex the Property and the City agreed to annex the same(the "Boundary Agreement"); and WHEREAS, after complying with all applicable laws,processes and procedures, League City adopted League City Ordinance No. 25-22 on June 24, 2025, which officially disannexed the Property from its corporate limits consistent with the Boundary Agreement; and WHEREAS,thereafter,the City Council of the City of Friendswood passed Resolution No. 2025-24 to annex the Property into its extraterritorial jurisdiction in order to initiate annexation proceedings in accordance with the Boundary Agreement and applicable law; and WHEREAS, the boundaries of the City are contiguous to the Property on at least two (2) sides and the Property abuts the corporate limits of the City of League City; and WHEREAS, the City is comprised of approximately 21.2 square miles; has a population of approximately 41,118, and has not annexed any areas this calendar year; and WHEREAS, pursuant to the Boundary Agreement, the City is required to complete the annexation of the Property within one hundred twenty (120) days of the City of League City's disannexation;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDS WOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this ordinance are hereby found to be true and correct; and such recitals are hereby approved and made a part of this ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Friendswood, Texas. Section 2. That the following described land and territories lying adjacent to and adjoining the City of Friendswood are hereby added and annexed to the City of Friendswood, Texas, and shall hereinafter be included within the boundary limits of the City of Friendswood, Texas, and present boundary limits of such City, at the various points contiguous to the areas hereinafter described, are altered and amended so as to include said areas within the corporate limits of the City of Friendswood, Texas,to-wit: SEE EXHIBIT "A" Section 3. The above-described territories and the areas so annexed shall be a part of the City of Friendswood, Texas; and the property so added hereby shall, to the extent applicable, bear its pro rata share of the taxes levied by the City of Friendswood, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens of the City of Friendswood and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Friendswood, Texas. Section 4. That all ordinances or parts of ordinances in conflict or inconsistent with this ordinance are hereby expressly repealed. Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional;and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 6. This ordinance shall take effect from and after its passage on second reading by the City Council of the City of Friendswood, Texas.
