HomeMy WebLinkAboutOrdinance No. 2016-39 ORDINANCE NO 2016-39 AN ORDINANCE AUTHORIZING AN INTERLOCAL AGREEMENT TO ADJUST THE BOUNDARIES BETWEEN THE CITY OF LEAGUE CITY TEXAS AND THE CITY OF FRIENDSWOOD TEXAS AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT AND THE CITY SECRETARY TO ATTEST AND PROVIDING AN EFFECTIVE DATE WHEREAS, it is the desire of the cities of League City and Friendswood to adjust their common city limit boundaries,and WHEREAS Section 43.031 of the Texas Local Government Code authorizes adjacent cities to make mutually agreeable changes to their boundaries of areas that are less than 1000 feet in width. NOW THEREFORE,BE IT ORDERED BY THE CITY OF LEAGUE CITY TEXAS, that: Section 1 The City authorizes an Interlocal Agreement in substantially the same from as Exhibit A which is attached and incorporated herein, with the City of Friendswood to adjust the boundaries between the City of League City and the City of Fnendswood Section 2. The Mayor is authorized to execute any document necessary to complete this transaction Section 3. The City Secretary is directed to effectuate an amendment of the City's official map thereof with the County Clerks of Galveston and Harris Counties Texas Section 4 This ordinance shall take effect upon passage Section 5 All ordinances and agreements and parts of ordinances and agreements in conflict herewith are hereby repealed to the extent of the conflict only Section 6. It is hereby found and determined that the meeting at which this ordinance was passed was open to the public and that advance public notice of the time, place and purpose of said meeting was given as 1 of 2 Exhibit A 1 R2016-38 BOUNDARY AGREEMENT BETWEEN THE CITY OF FRIENDSWOOD TEXAS AND THE CITY OF LEAGUE CITY TEXAS RELEASING AND ACCEPTING CORPORATE LIMITS STATE OF TEXAS § COUNTY OF GALVESTON § WHEREAS the City of Friendswood, Texas ("Friendswood") is a home-rule city situated within the Counties of Galveston and Harris,Texas and WHEREAS,the City of League City Texas("League City") is a home-rule city situated within the Counties of Galveston and Harris Texas,and WHEREAS Friendswood and League City share common boundaries,and WHEREAS, Friendswood has received a request from Tommy David Caudill and Lambert Clinton Titzman, whose property lies within the corporate boundaries of League City and is immediately adjacent and contiguous to the corporate boundaries of Friendswood requesting the disannexation of the property by League City and annexation by Friendswood to facilitate the development of the property and © WHEREAS,municipalities in Texas are authorized and empowered,pursuant to Chapter 43 of the Texas Local Government Code,to exchange area with other municipalities and WHEREAS, Friendswood and League City have each reviewed their respective corporate boundaries and the location of the area which is the subject of this Boundary Agreement and have determined that such tract would be better served by the municipal services of Friendswood,and WHEREAS, Section 43.031 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes in their boundaries of areas that are less than 1,000 feet in width,and WHEREAS the tract of land subject to this Boundary Agreement and fully described in Exhibit 'A is less than 1,000 feet in width and WHEREAS, Friendswood and League City desire to adjust their corporate boundary lines, whereby League City will release land from its corporate limits to be relinquished to and become part of the corporate limits of Friendswood, and Friendswood will accept this land from League City to become part of the corporate limits of Friendswood•and WHEREAS, the respective governing bodies of the cities hereby determine that this agreement is in the best interest of the health safety, morals and welfare of the citizens of the respective cities and hereby authorize the mayor of each city to execute this and Boundary Agreement between City of Friendswood and City of League City Page I • WHEREAS this agreement is made under the authority granted by and pursuant to the Texas Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended, providing for cooperation between local governmental bodies for beneficial governmental purposes, NOW, THEREFORE, IT IS MUTALLY AGREED BY THE CITY OF FRIENDSWOOD AND THE CITY OF LEAGUE CITY SECTION 1 Pursuant to Sections 43.021 and 43.031 of the Texas Local Government Code,the City of Friendswood and the City of League City hereby agree that the boundaries between the cities will be adjusted as depicted in Exhibit A" which is attached hereto and incorporated herein for all purposes SECTION 2 In accordance with the terms of this Boundary Agreement, the City of League City hereby relinquishes approximately 4 4365 acres described in Exhibit A' to the City of Friendswood and disannexes and discontinues such property as part of the City of League City The City of Friendswood accepts and annexes the land depicted on Exhibit A' into its corporate limits • SECTION 3 The respective governing bodies of the Cities of Friendswood and League City shall take appropriate action to effectuate the terms of this Boundary Agreement through the adoption of an official map("Official Map")showing their respective boundaries as required by Section 41.001 of the Texas Local Government Code The Official Map of each City shall be filed by each respective City with the appropriate county clerk(s) within thirty (30) days of adoption of the City's Official Map,and a copy of each City's ordinance adopting and authorizing the execution of this Boundary Agreement, after the effective date, shall be filed in the deed records of the appropriate counties where the Cities are situated SECTION 4 The City of Friendswood and the City of League City do hereby covenant and agree to protect,preserve,and defend the herein depicted boundary adjustment SECTION 5 The City of Friendswood and the City of League City agree and that the adoption by both cities of this Boundary Agreement, and the boundary changes resulting there from do not mitigate diminish or lessen any way the rights that either party may have,at law or in equity to challenge or contest any other annexations attempted annexations, or extraterritorial jurisdiction claims made by the other party • Boundary Agreement between City of Friendswood and City of League City Page 2 0 SECTION 6 t This Boundary Agreement shall become effective and shall become a binding agreement 1 upon the City of Friendswood and the City of League City by the adoption of same in regular open city council meetings of the City of Friendswood and the City of League City SECTION 7 1 This Boundary Agreement, upon adoption by both cities shall be executed
