MINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD CITY COUNCIL THAT
WAS HELD ON DECEMBER 2 , 1991 AT �: 00 PM AT FRIENDSWOOD CITY HALL ,
COUNCIL CHAMBERS , 109 WILLOWICK, FRIENDSWOOD , TEXAS WITH THE
FOLLOWING PRESENT CONSTITUTING A QOORUM:

MR . JEFF LITCHFIELD , REGIONAL DIRECTOR , GOVERNMENT FINANCE
OFFICERS ASSOCIATION OF TEXAS , PRESENTED THE CERTIFICATE OF
ACHIEVEMENT FOR EXCELLENCE IN FINANCIAL REPOATING FOR FISCAL
ENDED SEPTEMBER 30 , 1990 TO FINANCE DIRECTOR ROGER ROECKER . MR .
ROECKER EXPRESSED HIS APPRECIATION TO MAYOR AND CITY COUNCIL ,
CITY MANAGER , CITY STAFF AND ESPECIALLY TH.E FINANC� DEPARTMENT
FOR THEIR DEDICATION TO THE BUDGET PROCESS.

COMMENTS , EITHER ORAL OR WRITTEN, REGARDING TAE FOLLOWING :
A) REQUEST TO REZONE PARCELS OF LAND CONTAINING 8 . 1064 ACRES
BEING A PORTION OF RESERVE B , ANNALEA WHITEHALL
SUBDIVISION FROM COMMUNITY SHOPPING CENTER ( CSC) TO
MULTIPLE FAMILY RESIDENTIAL DWELLING-HIGH DENSITY (MFR-H) .
BUCK AAUSMAN MADE A PRESENTATION REGARDTNG THE PROPOSED
APARTMENT COMPLEX WHICH IS TO BE NAMED "OAKS OF
FRIENDSWOOD'� AND WOULD BE MANAGED BY BANFIELD PROPERTIES .
MR . HAUSMAN INTRODUCED HIS ARCHITECT , MR . STEINBERG , WHO
PRESENTED AN ARTIST ' S RENDITION OF THE PROJECT. MR .

SCHUSKE , REPRESENTING THE FIRM MR . HAUSMAN HAD EMPLOYED
TO PERFORM A TRAFFIC SURVEY , PRESENTED HIS FIGURES STATING
THAT THE IMPACT ON TRAFFIC WOULD BE NOMINAL . WITH NO
OTHER COMMENT IN FAVOR OF THE ZONE CLASSIFICATION CHANGE
REQUEST , CHAIRMAN BAKER RECOGNIZED MR . GEORGE VALETTA WHO
REPRESENTED THE ANNALEA—WHITEHALL HOMEOWNER ' S ASSOCIATION .
MR, VALETTA READ ,THE COMMENTS REGARDING THE ZONE ��
CLASSIFICATION CHANGE REQUEST AND PRESENTED A PETITION
WITH 155 NAMES IN OPPOSITION . THEREWERE APPROXIMATELY 45 �
PERSONS IN THE AUDIENCE WHO EXPRESSED THEIR OPPOSITION BY
A SHOW OF HAND . APPROXIMATELY 15 SPOKE THEIR OPPOSITION. .F
CITING NUMEROUS AEASONS; TRAFFIC , SAFETY , PROPERTY VALUES ,
THE AESTHETICS aF FRIENDSWOOD AND THE QUALITY OF LIFE .
B) REQUEST TO REZONE PARCELS OF LAND CONTAINING 5 . 0 ACRES OF
LAND LOCATED IN L�ISURE WAY, ON LEISURE LANE AND
WINDING WAY DRIVE FROM MULTIPLE FAMILY RESIDENTIAL
DWELLING—LOW DENSITY MFR—L TO SINGLE FAMILY RESIDENTIAL
(SFR ) .
ONE CITIZEN SPOKE IN FAVOR OF THE ZONE CLASSIFICATION
CHANGE REQUEST . THERE WAS NO OPPOSITION TO THE CHANGE
REQUEST.
C) REQUEST TO REZONE PARCELS OF LAND CONTAINING 5 . 987 ACRES
MORE OR LESS AND BEING LOT 38 LOCATED ON FM 518 FROM
COMMUNITY SHOPPING CENTER (CSC) TO MQLTIPLE FAMILY
RESIDENTIAL DWELLING—HIGH DENSITY (MFR—H) .
THE OWNER OF THE PROPERTY WAS NOT REPRESENTED . NO ONE WAS
PRESENT TO SPEAK IN FAVOR OF THE ZONE CHANGE . JEFF BRANSON
ADDRESSED THE OBLIGATION TO THE COMMUNITY AND THE
MAINTENANCE THEREOF AND REMINDED BOTH THE PLANNING AND
ZONING COMMISSION AND THE CITY COUNCIL THAT THEY
REPAESENTED THE COMMUNITY AT LARGE. MR . BRANSON STATED
THAT HE WAS MOVING FROM HERITAGE PARK BECAUSE OF THE CLOSE
PROXIMITY OF APARTMENTS TO HIM AND ASKED THE REQUEST FOR
ZONE CHANGE BE DENIED . RALPH HOBRATSCHK PRESENTED A
PETITION OF 93 NAMES IN OPPOSITION OF THE ZONE CHANGE .
THERE WERE APPROXIMATELY 35 PERSONS WHO EXPRESSED
OPPOSITION BY SHOW OF HANDS.
D) TO CONSIDER AMENDING ZONING ORDINANCE N0. 84-15 , DELETING
REQUIREMENTS RELATING TO LOCATION AND DURATION OF
TEMPORARY BATCHING FACILITIES AS CONDITIONS OF SPECIFIC
USE PERMITS .
CITY ATTORNEY JOHN OLSON EXPLAINED THE CHANGE IN THE
ORDINANCE TO THE CITIZENS IN THE AUDIENCE. SEVERAL
QUESTIONS WERE DIRECTED TO OLSON AND TO THE COMMISSIOid AS
A WHOLE .

MAYOR SCHRADER PROCLAIMED MONTH OF DECEMBER � 1991 AS "FIRE
AWARENESS" MONTH AND SATURDAY � DECEMBER 7 � 1991 AS "PEARL HARBOR
50TA ANNIVERSARY DAY" .
MAYOR SCHRADER ANNOUNCED THE HERITAGE MUSEUM TREE LIGHTING WILL
BE HELD TUESDAY DECEMBER 3 , REPORTED THE TREE LIGHTING AT THE
PARK SCHEDULED FOR NEXT MONDAY WILL BE CANCELED DUE TO LACK OF ''
PARTICIPATION AND THE COUNCIL WORKSHOP WILL BE HELD AS SCIiEDULED ,
AT 7 : 00 PM ON DECEMBER 9 TO DISCIIS5 GOALS AND OBJECTIVES .
COUNCILMEMBER NEWMAN REPORTED THE CHRISTMAS BANNERS PLACED ON 'A
FRIENDSWOOD DRIVE HAS CREATED SOME DISCUSSION REGARDItJG
ADDITIONAL DECORATIONS AND THAT COMMUNITY APPEARANC� BOAAD WILL
BE CONTACTED .
COUNCILMEMBER STUART REPORTED ON A RECYCLING PLANT BEING BUILT IN
TEXAS CITY TO RECYCLE TIRES.
COUNCILMEMBER FRANKOVICH DISCUSSED A NOTICE FROM CLEAR LAKE AREA
ECONOMIC DEVELOPMENT FOUNDATION REGARDING A PROSPECTIVE
MANUFACTURING COMPANY FROM CALIFORNIA LOOKING TO RELOCATE IN THIS
AREA AND WILL DISCUSS WITH THE CITY MANAGER IF THE CITY DESIRES
TO RESPOND .
CITY MANAGER REPORTED ON STATUS OF FM 2351 AND FM 528
CONSTRUCTION PROJECTS AND AEPORTED ON A CHANGE ORDEA IN THE
AMOUNT OF $3 , 000 FOR WAYNE SMITH & ASSOCIATES FOR THE INTERCEPTOR
LINE DESIGN CONTRACT .
**COUNCILMEMBER RALEY MOVED TO APPROVE EXXON PIPELINE COMPANY �S
REQUEST FOR A PERMIT TO RELOCATE ONE 12-INCH CRUDE OIL PIPELINE,
TWO S-INCH CRUDE OIL PIPELINES, AND ONE 8 INCH REFINED PRODUCTS
PIPELINE .
SECONDED BY COUNCILMEMBER STUART . MOTION APPROVED UNANIMOUSLY .
**COUNCILMEMBER FRANKOVICH MOVED TO APPROVE SECOND AND FINAL
READING OF ORDINANCE N0. T91 -33 , AN ORDINANCE AMENDING CITY OF
FRIENDSWOOD , TEXAS , ORDINANCE N0 . 91-3 , PASSED AND APPROVED THE
4TH DAY OF FEBRUARY , 1991 , BY STRIKING ALL OF SECTIONS 1 AND 2
THEREOF AND SUBSTITUTING THEREFOR NEW SECTIONS 1 AND 2 TO
PROHIBITING THE SALE OF ALCOHOLIC BEVERAGES BY A DEALER WHOSE
PLACE OF BUSINESS IS WITHIN 300 FEET OF A RESIDENCE ; PROVIDING A
PENALTY ; PROVIDING FOR SEVERABILITY ; AND CONTAINING OTHER
