HomeMy WebLinkAboutCC Minutes 1990-09-17 Special 341 SPECIAL MEETING FRIENDSWOOD CITY COUNCIL SEPTEMBER 17 , 1990 MINUTES OF A SPECIAL MEETING OF THE FRIENDSWOOD CITY COUNCIL THAT WAS HELD ON THE 17TH DAY OF SEPTEMBER , 1990 AT 7 : 00 PM WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM : MAYOR PAUL SCHRADER MAYOR PRO-TEM FRANK FRANKOVICH COUNCILMEMBER RON HITTER COUNCILMEMBER EVELYN NEWMAN COUNCILMEMBER ED STUART COUNCILMEMBER HAROLD RALEY CITY ATTORNEY JOHN OLSON ACTING CITY MANAGER MELVIN MEINECKE CITY SECRETARY DELORIS ARCHER ABSENT FROM THE MEETING WAS COUNCILMEMBER BOB WICKLANDER . MAYOR SCHRADER STATED A REQUEST HAS BEEN MADE TO PLACE YELLOW RIBBONS ON THE CREPE MYRTLES IN THE ESPLANADES IN SUPPORT OF DESERT SHIELD . COUNCIL CONCURRED WITH THIS PROPOSAL . COUNCILMEMBER NEWMAN REQUESTED ACTING CITY MANAGER HAVE THE POLICE DEPARTMENT PATROL BLACKHAWK BOULEVARD FOR SPEEDERS RATHER THAN CONCENTRATING ON FRIENDSWOOD LINK ROAD. ACTING CITY MANAGER REPORTED CITY OF HOUSTON CALLED AT 2 : 25 PM TODAY AND ADVISED PUMPING OF SURFACE WATER BEGAN TODAY . **MOTION BY COUNCILMEMBER NEWMAN TO SUSPEND COUNCIL RULE NO. 1 TO ALLOW ACTION TO BE TAKEN REGARDING COMPENSATION FOR ACTING} CITY MANAGER AND CLEAR CREEK DRAINAGE DISTRICT PROPOSAL TO IMPROVE DRAINAGE WINDSONG AT CHIGGER CREEK . SECONDED BY COUNCILMEMBER RALEY . MOTION APPROVED UNANIMOUSLY . **MOTION BY COUNCILMEMBER FRANKOVICH TO APPROVE ADDITIONAL FUNDING IN THE AMOUNT OF $11 , 175 FOR DRAINAGE IMPROVEMENTS FOR WINDSONG AT CHIGGER CREEK . SECONDED BY COUNCILMEMBER RALEY . MOTION APPROVED UNANIMOUSLY . MAYOR SCHRADER PROCLAIMED THE WEEK OF SEPTEMBER 17 - 23, 1990 AS "CONSTITUTION WEEK" AND PRESENTED THE PROCLAMATION TO MUNICIPAL JUDGE LUIS SUARZ AND A PROCLAMATION WILL BE FORWARDED TO JUSTICE OF THE PEACE JIM WOLTZ . MAYOR SCHRADER PROCLAIMED THE WEEK OF SEPTEMBER 23 - 19 , 1990 AS "WORLD SUMMIT FOR CHILDREN WEEK" AND PRESENTED THE PROCLAMATION TO JENNIFER NEUGENT WHO URGED CITIZEN PARTICIPATION IN THE WORLD SUMMIT FOR CHILDREN CANDLELIGHT VIGIL ON SUNDAY SEPTEMBER 23RD AT STEVENSON PARK . COUNCIL CONVENED INTO EXECUTIVE SESSION ACCORDING TO TEXAS OPEN 1 342 APPOINTMENT , EMPLOYMENT , EVALUATION , REASSIGNMENT, DUTIES , DISCIPLINE , OR DISMISSAL OF A PUBLIC OFFICER OR EMPLOYEE , OR TO HEAR COMPLAINTS OR CHARGES AGAINST SUCH OFFICER OR EMPLOYEE - ( A ) MUNICIPAL COURT (B) ACTING CITY MANAGER . COUNCIL RECONVENED IN OPEN SESSION WITH ACTION TAKEN LATER IN THE MEETING . DISCUSSION WAS HELD REGARDING STORER CABLE TELEVISION SERVICE WITH GARY PUMONIS AND SCOTT MARSHAL PRESENTING INFORMATION REGARDING SERVICE COMPLAINTS. MR . MARSHAL ADVISED COMPLAINT CALLS SHOULD BE DIRECTED TO 645-2311 OR SENT TO 2505 BISBEE , HOUSTON . MR . MARSHAL ADVISED THEY HAD A LARGE VOLUME OF CALLS WHEN RATES WERE INCREASED WHICH JAMMED THE PHONE LINES BUT THAT PROBLEM SHOULD BE HANDLED NOW AND APOLOGIZED FOR ANY INCONVENIENCE TO THE FRIENDSWOOD CUSTOMERS . MR . MARSHAL REPORTED THAT PAYMENTS MAY BE MADE AT KROGERS AND AT A DROP BOX AT THE CHAMBER OF COMMERCE OFFICE . COUNCIL ASKED IF STORER ANTICIPATED ANY MAJOR CHANGES WITH MR . MARSHAL STATING POSSIBLY 30 WITH PROPOSED LEGISLATION TO RETURN REGULATIONS TO CITIES AND ALSO THAT STEREO IS PLANNED FOR THE FIRST QUARTER OF 1991 . MR . MARSHAL REPORTED STORER IS LOOKING INTO A HEAVY MAINTENANCE PROGRAM , MR . LARRY OUTLER APPEARED BEFORE COUNCIL TO DISCUSS LANDSCAPE SCREENING. MR . OUTLER ASKED IF ANYONE OUTSIDE CITY STAFF WILL BE DOING RESEARCH ON THIS ISSUE AND IF SO , COULD HE RECEIVE A COPY OF ANY CORRESPONDENCE ON THIS SUBJECT . MAYOR SCHRADER ADVISED HE WOULD PROVIDE ANY INFORMATION THE CITY RECEIVES ON THIS ISSUE . DISCUSSION REGARDING THE GALVESTON COUNTY VIETNAM MEMORIAL WAS DEFERRED UNTIL NEXT COUNCIL MEETING. DISCUSSION WAS HELD REGARDING MAINTENANCE OF DETENTION POND IN PROPOSED PHASE III OF WILDERNESS TRAILS SUBDIVISION WITH COMMUNITY DEVELOPMENT DIRECTOR JIMMY THOMPSON PRESENTING A REPORT ON THE DEVELOPMENT PLANS. DISCUSSION WAS HELD REGARDING THE FACT THAT THE HOMEOWNERS ASSOCIATION NOR THE CLEAR CREEK DRAINAGE DISTRICT WANTS TO ASSUME RESPONSIBILITY OF MAINTENANCE OF THE DETENTION POND. ACTING CITY MANAGER MEINECKE ADVISED THE CITY DOES NOT MAINTAIN ANY DETENTION PONDS AND THE CLEAR CREEK DRAINAGE DISTRICT ACCEPTED THE MAINTENANCE OF DETENTION PONDS IN SUNFIELD AND SUNSET MEADOWS SUBDIVISIONS . FURTHER DISCUSSION FOLLOWED WITH COUNCIL CONCURRING THAT SUBDIVISIONS SHOULD NOT BE APPROVED WITHOUT DESIGNATION OF MAINTENANCE OF DETENTION PONDS AND DEFINITION OF MAINTENANCE DETERMINED . PLANNING AND ZONING CHAIRMAN BAKER STATED PLANNING AND ZONING COMMISSION IS VERY CONCERNED ABOUT THE PROPOSED PHASE III OF WILDERNESS TRAILS SUBDIVISION AND DRAINAGE IN GENERAL . DISCUSSION WAS HELD THAT IN CONJUNCTION WITH THE MAINTENANCE OF DETENTION PONDS , THE RUN OFF ORDINANCE SHOULD BE REVIEWED. DISCUSSION WAS HELD REGARDING COUNCIL GOING ON RECORD THAT SUBDIVISIONS NOT BE APPROVED UNTIL DRAINAGE PLAN WITH MAINTENANCE OF DETENTIONS PONDS BE ACCEPTABLE TO THE CITY ENGINEER . THIS ITEM WILL BE PLACED ON NEXT AGENDA FOR ACTION. 2 343 FOR ACTION . MAYOR SCHRADER ASKED IF THERE WERE ANY COMMENTS ON QUESTIONS REGARDING THE PENDING LIFE SAFETY CODE ORDINANCE. THERE WERE NO COMMENTS OR QUESTIONS FROM COUNCIL AND THIS ORDINANCE WILL BE ON THE SEPTEMBER 24TH AGENDA FOR FIRST READING . DISCUSSION WAS HELD REGARDING SUNWOOD AND BROOKE MEADOW SUBDIVISIONS DRAINAGE WITH COMMUNITY DEVELOPMENT DIRECTOR PRESENTING MAPS SHOWING OVERALL DRAINAGE SCHEME AND OUTFALL FOR THESE SUBDIVISIONS . COMMUNITY DEVELOPMENT DIRECTOR ADVISED THE WATER WILL BE METERED OUT OF THE DETENTION POND FROM THIS AREA THROUGH A 48" STORM SEWER PIPE RUNNING PARALLEL TO FM 518 ALL THE WAY TO CHIGGER CREEK . COMMUNITY DEVELOPMENT DIRECTOR ADVISED CURRENTLY ALL OF THIS PROPERTY AND FUTURE COMMERCIAL PROPERTY ADJACENT TO THIS AREA IS ALL ON THE OPEN DITCH SYSTEM ALONG SUNPARK WHICH FALLS ULTIMATELY INTO THE ROADSIDE DITCHES OF :SUNSET . COMMUNITY DEVELOPMENT DIRECTOR STATED THE OUTFALL WAS PARTICIPATED IN BY SOME OF THE ADJACENT PROPERTY OWNERS WHICH WILL ULTIMATELY DRAIN 130 ACRES . MAYOR SCHRADER ASKED WHO WOULD BE MAINTAINING THE DETENTION POND WITH COMMUNITY DEVELOPMENT DIRECTOR ADVISING CLEAR CREEK DRAINAGE DISTRICT WILL MAINTAIN . THE HOMEOWNERS TO THE NORTH OF THIS AREA HAVE BEEN ADVISED OF THE IMPACT ON THE HOMEOWNERS OF THIS DEVELOPMENT. COMMUNITY DEVELOPMENT DIRECTOR ADVISED THERE IS A SWALE DITCH THAT RUNS APPROXIMATELY 40 FT- OUT FROM THE BACK DITCH THAT EMPTIES INTO THE ROADSIDE DITCH ON SUNSET AND THAT THERE IS A BERME ON THE BACK OF THE LINE OF THE PROPERTIES THAT CONTAINS WATER ON SOME OF THE PROPERTY . THE BACK LOTS WILL BE BUILT UP THEIR LOTS TO THE SAME HEIGHT AS THE BERME AND SWALES WILL BE PUT UP BEHIND ALL THE NEW LOTS ON THE NORTH SIDE IN ORDER THAT THEY DRAIN TO THE ROADWAY . COUNCIL DISCUSSED WHETHER SWALES RUN ALONG THE FM 518 SIDE WITH COMMUNITY DEVELOPMENT DIRECTOR ADVISING THERE IS NOT A BERME IN THIS AREA BUT THERE IS A GAP OR A OLD ROADWAY RIGHT OF WAY BETWEEN THE PROPERTY ON SUNSET AND THE THREE PROPERTIES FRONTING FM 518. COUNCILMEMBER FRANKOVICH STATED ONE OF THE RECENT DEVELOPMENTS ON FM 518 IS SUPPOSED TO BE DRAINING THE PROPERTY TO THE BACK AND THEN ONTO THIS PROPOSED DEVELOPMENT AND NOTHING WAS DONE AS FAR AS DRAINAGE ON THE THE BACK OF THE THIS PROPERTY AND IT SEEMS THAT THE NEW DEVELOPER IS HAVING TO SOLVE THAT PROBLEM WHERE IT SEEMS LIKE SOME OF THE OTHER FRONT LAND OWNERS AND LAND OWNERS ACROSS THE STREET ARE PARTICIPATING FINANCIALLY TOWARDS THIS PROJECT TO HANDLE THE WATER THAT WAS NOT A PROBLEM FOR THEM BEFORE. COMMUNITY DEVELOPMENT DIRECTOR ADVISED THE NEW DEVELOPERS ARE PUTTING A BERM ALONG THE BACK OF THE PROPERTY LINE SO THAT THE DITCH WILL SERVE AS NOT TO CREATE A NUISANCE FOR THESE LOTS AND THE THREE PROPERTIES FRONTING FM 518 WILL CONTINUE DRAINING TO THE FRONT INTO THE ROADSIDE DITCHES . COUNCILMEMBER FRANKOVICH STATED THEY ARE ONLY SUPPOSED TO BE DRAINING THE FIRST 150 FEET TO THE ROADSIDE DITCHES ACCORDING TO THE STATE HIGHWAY DEPARTMENT AND IF THEY ARE DRAINING MORE THAN THAT , THE STATE HIGHWAY DEPARTMENT NEEDS TO BE NOTIFIED . DISCUSSION WAS HELD REGARDING THE CONCERN OF THE HOMEOWNERS IN SUNWOOD SUBDIVISION REGARDING THE PONDING THAT IS OCCURRING DUE TO THE INCREASED DEVELOPMENT IN THE AREA . 3 44 JANICE LOWE , WITH UNIPLEX STATED SHE WOULD BE GLAD TO DISCUSS THE DRAINAGE FOR THIS COMPLEX WHICH WORKS WELL WITH COUNCILMEMBER FRANKOVICH AND WITH ENGINEER TED BOGREN AT COUNCILMEMBER FRANKOVICHS CONVENIENCE. MAYOR SCHRADER ASKED IF THERE IS A DRAINAGE PLAN ON FILE FOR UNIPLEX AND IT WAS DETERMINED THAT PLANNING AND ZONING COMMISSION DID NOT REQUIRE A DRAINAGE PLAN AS IT WAS PROPOSED THAT PROPERTY WOULD DETAIN THEIR WATER . DISCUSSION WAS HELD REGARDING FM 529 RIGHT-OF-WAY FROM CLEAR CREEK TO I-45 WITH COMMUNITY DEVELOPMENT DIRECTOR PRESENTING MAPS SHOWING CITY LIMITS AND RIGHTS-OF-WAY LOCATED ON THE SOUTH SIDE FOR THE WIDENING PROJECT AND THE OWNERSHIP OF THE VARIOUS PARCELS OF LAND . COMMUNITY DEVELOPMENT DIRECTOR STATED THE APPROXIMATE COST TO ACQUIRE THE RIGHTS-OF-WAY FOR THIS WIDENING PROJECTS WOULD BE $400 THOUSAND . DISCUSSION WAS HELD REGARDING THE CITY WORKING ON ACQUIRING THIS RIGHTS-OF-WAY THROUGH DONATIONS OR BY SWAPPING UTILITY STUB OUTS . COUNCILMEMBER NEWMAN VOLUNTEERED TO WORK ON THIS ACQUISITION WITH MAYOR SCHRADER ADVISING THE RIGHTS- OF WAY MUST BE ACQUIRED NINE MONTHS IN ADVANCE . COMMUNITY DEVELOPMENT DIRECTOR WAS REQUESTED TO OBTAIN PROPERTY DESCRIPTIONS AND SURVEYS OF THE PROPERTY NEEDED FOR RIGHTS OF WAY FROM THE STATE HIGHWAY DEPARTMENT . **MOTION BY . COUNCILMEMBER NEWMAN TO APPROVE ADDITIONAL COMPENSATION TO MELVIN MEINECKE FOR SERVICE AS ACTING CITY MANAGER WITH THE AMOUNT TO BE DETERMINED AT THE TIME A NEW CITY MANAGER IS SELECTED AND ACCEPTS THE POSITION WITH THE CITY.
