HomeMy WebLinkAboutCC Minutes 1990-07-23 Regular 305 REGULAR MEETING FRIENDSWOOD CITY COUNCIL JULY 23 , 1990 MINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD CITY COUNCIL ' THAT WAS HELD JULY 23 , 1990 AT 7 : 00 PM AT CITY HALL , WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR PAUL W. SCHRADER MAYOR PRO-TEM FRANK FRANKOVICH COUNCILMEMBER RON RITTER COUNCILMEMBER BOB WICKLANDER COUNCILMEMBER EVELYN NEWMAN COUNCILMEMBER ED STUART COUNCILMEMBER HAROLD RALEY CITY ATTORNEY JOHN OLSON ACTING CITY MANAGER MELVIN MEINECKE ASSISTANT TO CITY SECRETARY JANE TOLLETT ABSENT FROM THE MEETING WAS DELORIS ARCHER , CITY SECRETARY. INVOCATION WAS GIVEN BY REVEREND MARK DENISON , BAYBROOK BAPTIST CHURCH. MAYOR SCHRADER PROCLAIMED JULY 24 , 1990 AS "TOP GUN DAY" IN THE CITY OF FRIENDSWOOD IN RECOGNITION OF THE FRIENDSWOOD GIRLS SOFTBALL TEAM WHICH WILL COMPETE IN THE NATIONAL TOURNAMENT IN OREGON IN AUGUST . MAYOR SCHRADER ANNOUNCED DELORIS ARCHER , CITY SECRETARY , IS RECUPERATING FROM SURGERY NICELY AND WILL BE BACK TO WORK IN SEVERAL WEEKS . MAYOR SCHRADER ALSO THANKED JANE TOLLETT , ASSISTANT TO CITY SECRETARY , AND ELIZABETH AYERS FOR DOING A FINE JOB IN THE CITY SECRETARY ' S OFFICE WHILE THE CITY SECRETARY IS RECUPERATING. . COUNCILMEMBER NEWMAN ANNOUNCED MARY WARD 'S SON PASSED AWAY AND THE FUNERAL IS TOMORROW MORNING AT FRIENDS CHURCH, NATHAN ROERE HAD SURGERY FOR REMOVAL OF CANCER AND ALSO EVERYONE REMEMBER THE FRIENDSWOOD FAMILY WHO SUFFERED THE LOSS OF THEIR TWO SONS IN AN OUT OF STATE AUTO ACCIDENT. MAYOR SCHRADER STATED THE ROBOT WHICH IS BEING DONATED TO THE FRIENDSWOOD POLICE DEPARTMENT FOR DRUG EDUCATION BY THE KNIGHTS OF COLUMBUS WILL BE PRESENTED TO FRIENDSWOOD AT A LATER DATE BY JOE GONZALES. DISCUSSION WAS HELD WITH THREE MEMBERS OF CLEAR CREEK DRAINAGE DISTRICT AND COUNCILMEMBERS TO DISCUSS FLOOD DAMAGE PREVENTION ORDINANCE AND SINGLE LOT DRAINAGE REQUIREMENTS. MAYOR SCHRADER STATED THE CCDD WAS INVITED TO THE COUNCIL MEETING TO DISCUSS THE 1 306 PROPOSED RUNOFF CONTROLS BECAUSE HE FELT THERE WERE NO ESTABLISHED RUN-OFF CONTROLS IN FRIENDSWOOD AND THERE IS NO FORMAL ORDINANCE IN EFFECT. COUNCILMEMBER FRANKOVICH STATED HE FELT THE PROBLEM IS THAT PLANNING AND ZONING COMMISSION IS CONCERNED THAT REQUIRING THE, SMALL BUSINESSMAN AND SMALL DEVELOPER REQUIRED TO HAVE A DRAINAGE STUDY DONE FOR HIS SIGHT AND SUGGESTED A COMPROMISE THAT THEIR DRAINAGE PLAN BE REVIEWED BY THE CITY ENGINEER . THE ENGINEER WOULD MAKE RECOMMENDATION AND HE COULD WAIVE REQUIREMENT TO HAVE STUDY DONE IF PROPER DOCUMENTATION WERE AVAILABLE . COUNCILMEMBER FRANKOVICH SUGGESTS THIS ORDINANCE TO BE REVISED AND CITY ENGINEER REVIEW AND MAKE RECOMMENDATION TO COUNCIL WHETHER DRAINAGE PLAN NEEDED TO BE SUBMITTED OR HAVING PLANNING ANL ZONING COMMISSION MAKE THIS FINAL RECOMMENDATION AFTER CITY ENGINEER HAS REVIEWED THE PLAN . DISCUSSION FOLLOWED AT LENGTH BETWEEN COUNCIL AND MEMBERS OF CLEAR CREEK DRAINAGE DISTRICT REGARDING VARIOUS ASPECTS OF THE PROPOSAL . CITY ATTORNEY , JOHN OLSON , STATED THE FOCUS NEEDS TO BE ON THE AREA IDENTIFIED AND THE ORDINANCE IN QUESTION DOES NOT CHANGE ANYTHING EXCEPT AREAS OUTSIDE OF 100 YEAR FLOOD PLAIN AND ARE IDENTIFYING A SPECIFIC DRAINAGE STANDARD , CLOSE TO WHAT IS REQUIRED NOW.- DISCUSSION FOLLOWED AT LENGTH. ACTING CITY MANAGER REPORTED ON CLERICAL HELP FOR NARCOTIC TASK FORCE , SUN MEADOW DRAINAGE , STREET PROGRAM AND THE YOUTH PROGRAM BEING USED AT PUBLIC WORKS AND COMMUNITY DEVELOPMENT WHICH IS FUNDED THROUGH THE ED WHITE YOUTH CENTER . ITEM REGARDING RIGHT-OF-WAY, PARCEL ON FM2351 WAS PASSED OVER AT THIS TIME . "COUNCILMEMBER FRANKOVICH MADE THE MOTION TO APPROVE PREPARING GRANT APPLICATION TO STATE OF TEXAS FOR AVAILABLE GRANT FUNDS FOP RECYCLING OF SOLID WASTE. SECONDED BY COUNCILMEMBER NEWMAN . MOTION APPROVED UNANIMOUSLY. "MAYOR SCHRADER MADE THE MOTION TO APPROVE AUTHORIZING THE MAYOR TO EXECUTE CONTRACT FOR CURB RECYCLING FROM BEST WASTE SYSTEMS, INC SUBJECT TO CITY ATTORNEY REVIEWING AND MAKING RECOMMENDATION TO CITY COUNCIL. SECONDED BY COUNCILMEMBER NEWMAN. MOTION APPROVED UNANIMOUSLY. THE AGENDA ITEM REGARDING INCREASING EMPLOYEE AND CITY CONTRIBUTIONS OF EMPLOYEE RETIREMENT BENEFITS TO TEXAS MUNICIPAL RETIREMENT SYSTEM WILL BE ADDRESSED IN THE BUDGET PROCESS. "COUNCILMEMBER RITTER MADE THE MOTION TO APPROVE THE INTERNAL REVENUE CODE SECTION 125 PLAN FOR EMPLOYEES. SECONDED BY COUNCILMEMBER NEWMAN. MOTION APPROVED UNANIMOUSLY. "COUNCILMEMBER NEWMAN MADE THE MOTION TO APPROVE THE SELECTION 2 307 OF ACORDIA INSURANCE COMPANY FOR EMPLOYEE HEALTH INSURANCE WITH THE CITY ABSORBING 100$ OF THE INCREASED RATE . SECONDED BY COUNCILMEMBER RALEY. MOTION APPROVED UNANIMOUSLY. "MOTION MADE BY COUNCILMEMBER STUART TO APPROVE SECOND AND FINAL READING OF ORDINANCE NO. T90-17 , AN ORDINANCE OF CITY COUNCIL OF, FRIENDSWOOD , TEXAS , CHANGING THE ZONING CLASSIFICATION OF PROPERTY BEING A TRACT OF LAND KNOWN AS 1 . 0030 ACRES OF LAND , BEING A PART OF 11 . 4003 ACRES OF LAND OUT OF LOTS 15 AND 16 , BLOCK 5 , FRIENDSWOOD SUBDIVISION, LOCATED ON CASTLEWOOD , FROM COMMUNITY SHOPPING CENTER TO SINGLE FAMILY RESIDENCE; AMENDING THE ZONING DISTRICT MAP OF THE CITY AS ADOPTED BY ORDINANCE NO. 84-15 ; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. SECONDED BY COUNCILMEMBER WICKLANDER . MOTION APPROVED UNANIMOUSLY . "MOTION MADE BY COUNCILMEMBER WICKLANDER TO APPROVED SECOND AND FINAL READING OF ORDINANCE T90-18 , AN ORDINANCE AMENDING CITY COUNCIL OF FRIENDSWOOD , TEXAS , ORDINANCE NO. 84-15 , PASSED AND APPROVED THE 19TH DAY OF NOVEMBER , 1984 , PASSED AND APPROVED THE 19TH DAY OF NOVEMBER , 1984 , AND BEING THE ZONING ORDINANCE OF THE CITY, BY STRIKING ALL OF SUBPARAGRAPH b OF PARAGRAPH 3 OF THE SUBSECTION 0 OF SECTION 7 AND SUBSTITUTING THEREFOR A NEW SUBPARAGRAPH b , BY STRIKING ALL OF SUBSECTION C OF SECTION 11 AND SUBSTITUTING THEREFOR NEW SUBSECTIONS C AND D; PROVIDING THAT BUILDINGS AND STRUCTURES IN ANY ZONING DISTRICT MAY EXCEED THE DISTRICT MAXIMUM HEIGHT REGULATIONS UPON THE GRANTING OF A SPECIAL EXCEPTION BY THE BOARD OF ADJUSTMENT IF SHOWN THAT THE BUILDING OR STRUCTURE WILL FIT UNDER AN IMAGINARY LINE THAT IS 63 . 5 DEGREES, WITH THE HORIZONTAL , AT THE OUTER EDGE OF THE YARD ; PROVIDING THAT THE BOARD OF ADJUSTMENT MAY, APPROPRIATE CASES, MAKE SPECIAL EXCEPTIONS TO THE ZONING ORDINANCE IN ACCORDANCE WITH THE APPLICABLE RULES CONTAINED THEREIN; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $1 , 000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. T90-20 , AN ORDINANCE CHANGING THE ZONING CLASSIFICATION OF PROPERTY BEING A TRACT OF LAND KNOWN AS 3 . 5229 ACRES OF LAND , BEING OUT OF RESERVE "L" , REPLAT OF POLLY RANCH SUBDIVISION , LOCATED AT OAK DRIVE AND FM518 , FROM NEIGHBORHOOD CENTER TO SINGLE FAMILY RESIDENCE ; AMENDING THE ZONING DISTRICT MAP OF THE CITY AS ADOPTED BY ORDINANCE NO. 84-15; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT . SECONDED BY COUNCILMEMBER FRANKOVICH. _ MOTION APPROVED UNANIMOUSLY. "MOTION MADE BY COUNCILMEMBER NEWMAN TO APPROVE FORMALLY CLOSING WINDEMERE ROAD ON A TEMPORARY BASIS UNTIL RESOLVED AND PROVIDING KEYS TO RESIDENTS WHOSE PROPERTY ABUTTS WINDEMERE ROAD . SECONDED BY COUNCILMEMBER WICKLANDER . MOTION APPROVED UNANIMOUSLY. "MOTION MADE BY COUNCILMEMBER RITTER TO APPROVE THE FOLLOWING 3 308 ITEMS ON THE CONSENT AGENDA : APPROVAL OF AGREEMENT BETWEEN FRIENDSWOOD FINE ARTS COUNCIL AND CITY AND EXECUTION THEREOF , APPOINTMENT OF LT . WILLIAMS AND CHIEF STOUT AS THE CITY ' S REPRESENTATIVES TO FORMULATE AN INTERLOCAL AGREEMENT WITH REPRESENTATIVES OF GALVESTON COUNTY REGARDING THEIR REQUEST FOR MICROWAVE COMMUNICATION SYSTEM ANTENNA AND INTERIOR SPACE AT CITY,, HALL , APPOINTMENT OF DR . MICHAEL MEZZINO TO FRIENDSWOOD LIBRARY BOARD , RESOLUTION NO. R90-37 REQUESTING TO BE INCLUDED ON THE ' TEXAS WATER DEVELOPMENT BOARD FISCAL YEAR 1991 INTENDED USE PLAN FOR SECURING FUNDS TO CONSTRUCT WASTEWATER FACILITIES AND TO x APPROVE RECOMMENDATION FROM PLANNING AND ZONING REGARDING SITE PLAN FOR A PROPOSED DRIVING RANGE WHICH WILL BE CONSTRUCTED BEHIND THE BALL FIELDS ON FM528 . SECONDED BY COUNCILMEMBER WICKLANDER . MOTION APPROVE,. UNANIMOUSLY . AT THIS TIME , MAYOR SCHRADER RECESSED THE MEETING IN HONOR OF MELVIN MEINECKE ' S BIRTHDAY AND MELVIN WAS PRESENTED WITH A CAKE AND A CHORUS OF HAPPY BIRTHDAY BY ALL IN ATTENDANCE . MAYOR SCHRADER RECONVENED THE MEETING FOR CONSIDERATION AND POSSIBLE REGARDING THE FY 1990-1991 BUDGET. ROGER ROECKER , FINANCE DIRECTOR ADDRESSED COUNCIL WITH COMMENTS REGARDING THE PROPOSED BUDGET. THE FOLLOWING PERSONS PRESENTED THEIR DEPARTMENTS BUDGET AND WERE QUESTIONED BY COUNCIL REGARDING DIFFERENT ASPECTS OF THEIR BUDGET: FRIENDSWOOD VOLUNTEER FIRE DEPARTMENT , JIM ROBERTSON , PRESIDENT REGARDING ADMINISTRATION ; FRIENDSWOOD VOLUNTEER FIRE DEPARTMENT, RICK MCFEE , CHIEF , REGARDING FIRE DIVISION; FRIENDSWOOD VOLUNTEER FIRE DEPARTMENT , GREG KUNKEL, REPRESENTING EMS; VANCE RILEY - FIRE MARSHAL ; JARED STOUT - POLICE CHIEF; MELVIN MEINECKE - CAPITAL IMPROVEMENTS : 1990- 1991 PROJECTS AND FIVE-YEAR CAPITAL IMPROVEMENTS PLAN; MELVIN MEINECKE - PUBLIC WORKS DEPARTMENT; JIMMY THOMPSON COMMUNITY DEVELOPMENT DEPARTMENT ; CLAUDIE PETTIGREW - LIBRARY DEPARTMENT ; JON BRANSON - PARKS AND RECREATION DEPARTMENT; JON BRANSON - 4TH OF JULY COMMITTEE .
