ROY BAKER, MANAGER ENTEX APPEARED BEFORE COUNCIL TO REQUEST m COUNCIL RESCIND RATE SUSPENSION AS ADOPTED ON APRIL 14, 1986, AS Q THE COST TO THE CUSTOMER ACTUALLY DECREASED BY $4.32 . **MOTION WAS MADE BY COUNCILMAN NEWMAN TO APPRCIVE RESCINDING 1,�� RESOLUTION 86-6 , ENTEX RATE SUSPENSION. � SECONDED BY COUNCILMAN HARRELL. MOTION APPRC7VED UNANIMOUSLY. MAYOR LOWE REPORTED THE HALL IS BEING REMODELED FOR BADLY NEEDED ADDITIONAL OFFICE SPACE WITH THE CITY MANAGER AND THE DIRECTOR OF ADMINISTRATIV E SERVICES COORDINATING THIS PROJECT. MAYOR LOWE REPORTED HE IS WORKING WITH TEXAS HIGHWAY DEPARTMENT FOR TRAFFIC LIGHTS ON FM 528 AT WINDING WAY, CYPRESS FOINT AND SUNMEADOW BOULEVARD AND ALSO A PASSING LANE AT WHISPERING PINES. MAYOR LOWE REPORTED HE HAD OBTAINED PERMISSSON FROP4 HARRIS COUNTY FLOOD CONTROL FOR MS. ROXIE ALDEN� FOREST BEND RESIDENT TO PUT UP A BARBED WIRE FENCE TO KEEP THE MOTORBIKES OFF HER PROPERTY ALONG CLEAR CREEK. MAYOR LOWE ADVISED THE CITY MANAGER THAT MS. ALDEN WILL NEED TO GIV E THE CITY A LETTER STATING SHE WILL TAKE THE FENCE DOWN IF NEEDED UPON TWENTY FOUR HOUR NOTICE. MAYOR LOWE REPORTED THAT COUNCILMAN PRIHODA, COUNCILMAN WICKLANDER AND HIMSELF MET LAST MEET TO TRY TO RESOLV E THE FIRE DEPARTMENT PROBLEM REGARDING THE FIRE STATION IN FOREST BEND. MR. JOHN JONES STATED HE APPRECIATED THE CITY WORKING WITH ALL INVOLVED TO SOLV E TAIS PROBLEM AND STATED HE FELT THEY WERE V ERY CLOSE TO REACHING AN AGREEMENT. MAYOR LOWE STATED A MEETING WAS HELD WITH GULF COAST WASTE DISPOSAL REGARDING REMODELING AND OPENING OF THE EXPANDED BLACRHAWK SEWER PLANT. CITY MANAGER REPORTED THE OPERATING COST IS GOING DOWN BECAUSE OF THE EXPANSION OF THE FLANT AND DURING , THIS MEETING MAYOR LOWE CONVINCED GULF COAST WASTE DISPO5AL TO REFUND ONE MONTH OF THE THREE MONTH OPERATING COST ESCROW ACCOUNT WHICH SHOULD AMOUNT TO APPROXIMATELY $40,000 TO $44, 000 REFUND. MAYOR LOWE REPORTED HE RECEIV ED A CALL FROM JOE ALLEN REPRESENTIV E FROM VIN50N ELKINS WHICH REPRESENTS CDC, THE LARGE DEVELOPERS OF ACREAGE AROUND BAYBROOK MALL, REGARDING A JOINT - PLAN FOR SURFACE FOR CDC, MUD 55 AND FRZENDSWOOD AT A REDUCED PRICE. THE ENGINEER5 HAVE COMPLETED THE SURFACE WATER PLANS AND WILL SEND A COPY TO FRIENDSWOOD. 1 ss MAYOR LOWE R�PORTED THE FLAG IN STFVENSON PARK WAS V ANDALIZED AND 11SKED COUNCIL IF `1'HEY WOULD CONSIUPiR �1 REWIIRD FUR THE APPREHENSION OF THE V ANUALS 11ND SUGGESTED AN �1MOUNT OF $5UO . OU B£ CONSIDERED AT THE NEXT MEETING. , MAYOR LOWE REPORTED HE SPOKE TO JUDGE HOLBROOK AND COLONEL CLARK . ' WITH THE CORPS OF ENGINEERS AND IT APPEARS THE CLEAR CREEK ' PROJECT IS IN MORE DANGER OF BEING TERMINATED THAN ITS EVER BEEN IN ITS HISTORY. THE CORPS TALKED TO HARRIS COUNTY AND IT APPEARS THAT HARRIS COUNTY ,AND GALVESTON COUNTY HAV E EXTREME • ,• DIFFICULTY IN AGREEING ON THE SHARING OF THE COST TO DO TAIS PROJECT. THE COST IS ESTIMATED BY THE CORPS OF ENGINEERS TO BE $34 MILLION FOR LOCAL SHARING AND HARRIS COUNTY WANTS GALVESTON COUNTY TO PAY 1/2 OF THIS COST. MAYOR LOWE SUGGESTED A FIV E MEMBER COMMITTEE SHOULD BE APPOINTED MADE UP OF HIMSELF, HAROLD WALLACE, MARTA GREYTOK, GERRY PATE, AND JUDGE LINDSEY TO APPOINT ONE MEMBER TO WORK OUT THE DIFFERENCES BETWEEN THE. TWO COUNTIES. COUNCIL HAD NO OBJECTIONS TO THIS PLAN AND MAYOR LOWE WTLL BE ON HARRIS COUNTY COMMISSIONERS COURT AGENDA TOMORROW 1 : 30 PM TO PRESENT THIS PLAN. COUNCILMAN WICKLANDER PRESENTED A MAP HE HAD DRAWN WITH � RECC?MMENDATIONS ON THE CURB AND GUTTER ISSUE BEING DISCU5SED BY THE CITY, COUNTY AND THE STATE HIGHWAY DEPARTMENT. COUNCILMAN WICKLANDER STATED HE WOULD BE r1EETING WITH COMMISSIONER CROWDER TO GO OV ER THESE RECQMMENDATIONS AND WOULD REPQRT BACK TO COUNCIL. MAYOR L�WE PRESENTED A PROCLAMATION TO MS. JANE WELLS AS THE 1986 CHAMBER OF COMMERCE SCHOLARSHIP RECIPIENT. MAYOR LOWE CALLED A FIV E MINUTES RECESS. MAYOR LOWE CALLED A JOINT DOCKETED PUBLIC HEARING OF TH� FRIENDSWOOD CITY COUNCIL TO ORDER AND CHAIRMAN DENNIS HOLT CALLED THE PLANNING AND ZONING COMMIS5ION TO ORDER TO OBTAIN PUBLIC INPUT REGARDING THE PROPOSAL TO AMEND THE ZONING ORDINANCE FOR � CLARIFICATI�N OF PORTABLE SIGN USAGE, LANDSCAPING REQUIREMENTS- INDUSTRIAL DISTRICT AND REDEFINING GRAND OPENINGS. A LENGTHY DISCU5SION WAS HELD REGARDING INCREASING THE TIME LIMITATION FOR PORTABLE SIGN USAGE WITH MEMBERS OF COMMUNITY APPEARANCE BOARD AND CITIZENS SPEAKING IN OPPOSITION OF THIS PROPOSAL. MR. HOWARD YEAGER REPRESENTING THE CHAMBER OF COMMERCE AND LOCAL BUSINESSES SPOKE IN SUPPORT OF CHANGING THE PORTABLE SIGN USAGE. VARIOUS BUSINESS OWNERS ALSO SPOKE IN FAVOR OF CHANGING THE TIME LIMITATIONS. THERE WERE NO OBJECTIONS TO CHANGING THE LANDSCAPING REQUIREMENTS IN THE INDUSTRIAL DISTRICT OR IN REDEFINING GRAND OPENINGS. HEARING NO FURTHER PUBLIC INPUT THE PUBLIC HEARING WAS CLOSED. **MOTION WAS MADE BY COUNCILMAN HARRELL TO APPR(7VE PAYMENT FOR t���j� PURCHASE OF FIRE TRUCK AND EQUIPMENT FROM PIERCE INC. IN THE ��� AMOUNT OF $149, 992. 00. SECONDED BY COUNCILMAN WICKLANDER. MOTION APPRC7VED UNANIMOUSLY. FIRE CHTEF KEN BEECH THANKED COUI�CIL FOR PURCHASE OF THIS FIRE TRUCK AND STATED THE TRUCR SHOULD BE ON LINE IN APPROXIMATELY ONE MONTH. COUNCILMAN WICKLANDER LEFT THE COUNCIL CHAMBERS AT THIS TIME. , DISCUSSTON WAS HELD WITH PLANNING AND ZONING COMMISSION CHAIRMAN ' DENNIS HOLT REGARDING EXTENDING SUNSET ACROSS EDGEWOOD INTO A NEW SUBDNISION CALLED LAURAL FIELD AND SHOULD MARY ANN BE EXTENDED , TO SUNSET. A LENGTHY DISCUSSION WAS HELD WITH COUNCILMAN PRIHODA POINTING OUT VARIOUS PROBLEM5 WITH THIS DEVELOPMENT, ONE OF THE PROBLEMS IS THIS WOULD BE A DEAD END STREET WHICH �COULD POS5IBLY BE SOLV ED BY PUTTING IN A CUL-DE-SAC AT THE END OF THE STREET. ANOTHER PROBLEM IS THAT THIS PIECE OF PROPERTY IS LONG AND SKINNY � 2 69 WHICH MAKES IT HARD TO DEVEI�OP WITH 90 ' LOTS. THE DEVELOPER WOULI) LIKE TO F�AVE APPROXIMIITELY 60 LOTS IN TfiIS SUBI)TVISIUN. PLANNING AND ZONING WILL LUOK AT `I'HI5 PROPOSAL AGAIN ANU WILL KEEP COUNCIL ADVISED. COUNCILMAN WICKLANDER RETURNED TO THE CHAMBERS AT THIS TIME. _. MR. J . D. BURNS APPEARED BEFORE COUNCIL TO DISCUSS PROPOSING AN ORDINANCE WHICH WOULD PROHIBIT A PROPERTY OWNER FROM RAISING ELEVATION OF HIS LAND. MR. BURNS STATED HE IS CONCERNED WITH . ,, FLOODING DUE TO THE NEW CONSTRUCTION IN THE AREA AROUND HIS HOME. COUNCILMAN WICKLANDER STATED THESE ELEVATIONS WERE IMPLEMENTED TO MEET THE FEMA REQUIREMENTS IN ORDER TO KEEP OUR FLOOD INSURANCE. COUNCIL REQUESTED THE CITY MANAGER TO LOOK INTO THIS MATTER AND REPORT BACK TO COUNCIL. CITY MANAGER ADVISED COUNCIL OF HIS PRpPOSAL TO LEASE ADDITIONAL OFFICE SPACE IN THE SAVARD ELECTRICAL COMPANY BUILDING ADJACENT TO CITY HALL. THIS SPACE WILL ALLOW THE WATER DEPARTMENT TO BE RE-LOCATED INTO THREE SMALL OFFICES WITH A CENTRAL CASHIER AT CITY HALL IN THE EXI5TING COURT CLERKS OFFICE AND MOVE THE COURT ' CLERKS OFFICE INTO THE EXISTING WATER DEPARTMENT OF�FICE. THE COST � WILL BE $375 .00 PER MONTH FOR EIGHT MONTHS NOT T(J BE PAID UNTIL � JANUARY 1987 . COUNCIL HAD NO OBJECTIONS TO THIS PROPOSAL BY THE (� CITY MANAGER AND THE DYRECT�R OF ADMINISTRATIV E SERVICES. � m **MOTION WA5 MADE BY COUNCILMAN NEWMAN TO APPRUVE THIRD AND FINAL READING OF ORDINANCE T86-6 , AN ORDINANCE UF THE CITY OF 'r✓ " ' Q FRIENDSWOOD AMENDING .ORDINANCE N0. 85-15 PASSED AND APPRCJVED AS OF NC7VEMBER 19, 1984,� AND KNOWN AS THE ZONING ORDINANCE OF THE CITY, BY CHANGING THE ZONING OF CERTAIN PARCELS OF LAND LOCATED AT 1206 WINDING WAY FROM SINGLE FAMILY RESIDENCE TO SPECIFIC USE - CHURCH. SECONDED BY COUNCILMAN JORDAN. MOTION APPR(7VED UNANIMOUSLY. COUNCILMAN LEE LEFT THE COUNCIL CHAMBERS AT THIS TIME. � **MOTION WAS MADE BY COUNCILMAN PRIHODA TO TABLE THIRD AND FINAL READING OF ORDINANCE T86-7 , AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE I�IO. 85-19� PASSED AND APPROVED THE 23RD OF SEPTEMBER, 1985, AND BEING AN ORDINANCE PRC7VIDING REGULATIONS FOR SUBDIVISION DEVELOPMENT� BY ADDING A NEW SENTENCE TO SUBPARAGRAPH B OF PARAGRAPH 3 OF SUBSECTION E OF SECTION III : PROVIDING A MINIMUM BUILDING SETBACK OF TEN (10) FEET FROM ANY PIPELINE EASEMENT: AND PRC7VIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $200 (TWO HUNDRED DOLLARS) FOR EACH DAY OF VIOLATION OF ANY PROVISION THEREOF. SECONDED BY COUNCILMAN JORDAN. MOTION APPRCN ED UNANIMOUSLY. COUNCILMAN PRIHODA WILL WORK WITH THE CITY ATTORNEY ON WORDING OF , THIS AMENDMENT AND WILL REPORT BACK TO COUNCIL AT A LATER DATE. COUNCILMAN LEE RETURNED TO THE CHAMBERS AT THIS TIME. **MOTION WAS MADE BY COUNCILMAN PRIHODA TO TABLE THIRD AND FINAL READING OF ORDINANCE NO. 86-8, AN ORDINANCE AMENDING THE FRIENDSWOOD CITY CODE BY STRIKING THEREFROM THE THIRD PARAGRAPH OF 19-11 THEREOF AND SUBSTITUTING THEREFOR A NEW THIRD PARAGRAPH OF SECTION 19-11; PR(7VIDING MINIMUM BUILDING SETBACKS OF TEN (10) , FEET FROM ANY PIPELINE EASEMENT: AND PRaVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED TWO HUNDRED DOLLARS ($200) FOR EACH DAY OF VIOLATION OF ANY PRaVISION THEREOF. CITY MANAGER REPORTED ON ELE'VATED STORnGES STILL UN G0, 14-INCH WATERLINE CONTRACTOR IS MAKING THE CUT TO EXCAV ATE INTO CLEAR CREEK THIS WEEK AND PUTTING PIPE TOGETHER AND WILL BE PUTTING THIS TOGETHER THIS WEEK, WATER WELL #5 HAS ALL THE PIPING COMPLETED, THE PUMPS ARE INSTALLED BUT LACK THE ELECTRICAL, THE CONTRACT(.?R HAS BEEN ASKED TO GIV E AND ESTIMATE TO CONNECT POLLY RANCH SUBDIVISION, THE STREET PROGRAM IS ONGOING AND THE COUNTY • .� CONTRA.CT SHOULD BE COMPLETED AND READY FOR THE NEXT AGENDA. MAYOR LOWE ADVISED COUNCTL HE HAS BEEN WORKING WITH HOUSTON REGARDING DISANNEXATION OF PROPERTIES FOR THE NEW CLEAR CRE�K SCHOOL AND THE CITY WILL HAV E TO DECIDE IF THEY WANT TO ANNEX THE LAND AND FURNI5H WATER AND SEWER. MINUTES OF MARCH 10 WERE CORRECTED AND APPROVED AND MINUTES OF MARCH 21 WERE APPROVED AS PRESENTED. MAYQR LOWE ADDRESSED THE OPINION'S BEING EXPRESSED BY CITIZENS REGARDING THE PROPOSED CITY HALL DESIGN AND ASKED COUNCIL THEIR OPINION. IT WAS THE UNANIMOUS OPINION OF COUNCIL THE EXTERIOR OF THE CITY HALL WAS NOT WHAT THEY WANTED. IT WA5 AGREED TO MEET WITH THE ARCHITECT AS SOON AS POSSIBLE REGARDING THIS MATTER. COUNCIL CONVENED IN EXECUTIVE SESSION ACCORDING TO TEX�1S OPEN MEETINGS LAW ARTICLE 6252-17 , TEXAS V ERNONS CIVIL STATUTES (g) PERSONNEL.
