General Warranty Deed

Consideration:
Good and valuable consideration consisting of.
(1)Grantee's dedication by plat to Grantor of a step of land along the east side of the center
line of Mary's Creek "as an easement for drainage purposes and giving the Galveston
County Consolidated Drainage District the right to enter on the easement at any and all
times for the purposes of construction and maintenance of canals, drains, ditches and
levees, and other improvements of the district and to keep them in repair as provided by
Texas Water Code Subchapter D. Sec 56 111." Such easement is to be commensurate
with the unrecorded Drainage Easement as shown by C L Davis & Co Land Surveying
drawing dated 7-01-2008 for the Galveston County Consolidated Drainage District of
1.0774 acres;
(2) Grantee's dedication by plat to Grantor providing an access easement for Galveston
County Consolidated Drainage District's employees, contractors, or agents along the
northwest corner of the property along FM 2351 for ingress to and egress from the
drainage easement. The access easement will consist of a 10' wide strip of land, running
along the property line adjacent to FM 2351 between the drainage easement on Mary's
Creek to the northwest curb cut for the existing driveway. Grantee will also allow the
Galveston County Consolidated Drainage District to have reasonable use upon
reasonable notice of the driveway and adjacent parking spaces which may be on or
immediately adjacent to the access easement, for ingress or egress to the access easement
Such dedications and easements as described in (1) and (2) above will be shown on the
final plat to be submitted for approval by the City of Fnendswood of Grantee's land out of
Lot 1,Block 2,Friendswood Subdivision,Volume 254,Page 37,G.0 D.R.,
(3) that Grantee's use of property within the drainage and access easements shall be
restncted to keeping such drainage and access easements free and clear of fences,buildings,
new plantings and other obstructions to the operations and maintenance of the drainage
facilities and that such abutting property shall not be permitted to dram directly into the
easement except by means of an approved drainage facility. Existing live trees with trunks
larger than 10" in diameter, along with other smaller healthy trees where feasible,
shall be remain on the drainage and access easements except by mutual agreement
between Grantee and Grantor, which will not be unreasonably withheld;and
(4) Grantee's covenant that any replat will not attempt to alter, amend or remove the
dedication of the easements without the consent of the Grantor
Property Conveyed by Grantor to Grantee(including any improvements):
Certain real property, consisting of a 15' X 282' strip of land, or 4,230 square feet out of
Lot 4, Block 9, JR Williams League, in Freendswood, Texas according to the plat filed in
Volume 254, Page 37, G.C.D R, and described in that Warranty Deed from Helen
Bowles Sommers to Clear Creek Drainage District, G C C.F. Number 9617414 filed at
011-06-2113 to 011-06-2115, and, certain real property, consisting of a 15' X 282' strip
of land, or 4,230 square feet out of Lot 4, Block 9, JR Williams League, in Friendswood,
Texas according to the plat filed in Volume 254, Page 37, G C D R, and described in
Deed Without Warranty from Joseph P. Fowler and Frances B. Fowler to Clear Creek
Drainage District, G.C.C.F Number 9637778 filed at 011-33-2150 to 011-33-2152 which
legal descriptions are incorporated herein
Reservations from Conveyance:
None.
Exceptions to Conveyance and Warranty:
None.
Restrictions:
Grantor, for the Consideration and subject to the dedications and covenants set out above,
grants, sells, and conveys to Grantee the Property, together with all and singular the rights
and appurtenances thereto in any way belonging, to have and to hold it to Grantee and
Grantee's heirs, successors, and assigns forever Grantor binds Grantor and Grantor's heirs
and successors to warrant and forever defend all and singular the Property to Grantee and
Grantee's heirs, successors, and assigns against every person whomsoever lawfully claimmg
or to claim the same or any part thereof,except as to the Reservations from Conveyance,the
Exceptions to Conveyance,and Warranty, and the Restrictions.
When the context requires, singular nouns and pronouns include the plural.
