§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF GALVESTON §
That Walter G. Grimes, of Galveston County, Texas, hereafter called "Grantor," for and
in consideration of Ten Dollars ($10.00) and other good and valuable consideration, cash in hand
paid, receipt of which is acknowledged, does GRANT and CONVEY to Clear Creek Drainage -

District of Galveston County, located in the County of Galveston, State of Texas, its successors
and assigns, hereafter called "Grantee," an easement (the "easement") forty (40) feet in width to
inspect, construct and maintain facilities for drainage, in the location described in Exhibit "A,"
which is attached and incorporated.
Grantor further grants the right of ingress and egress to and from the land for any purpose
necessary and incident to the exercise by Grantee of the rights granted by this agreement.
Grantor retains to itself, its successors, tenants, sub-tenants, agents, and licensees, the
right to use and enjoy all of the easement; provided, however, Grantor shall not exercise such use
and enjoyment in a manner that will interfere with the rights granted. Any structure including
fences shall not be erected in or across the easement which will inhibit the free flow of water, or
access to the easement by drainage crews or equipment.
This Agreement is subject to any prior existing easements, leases, or other agreements
affecting the easement and Grantor's adjacent properties, including without limitation, any
matters of record in the Official Real Property Records of Galveston County, Texas.
TO HAVE AND TO HOLD said easement perpetually to the said Grantee, and Grantee's
successors and assigns, subject, however, to automatic termination, extinguishment, and
reversion to Grantor in the event Grantee should ever abandon and cease to use the easement for o

All that certain 0.2730 acre being a 40' drainage easement out of Lot 2,
Block "G", Central Park Subdivision according to the plat thereof filed in
Volume 105, Page 151 Galveston County Map Records and being out of
that certain tract described in a deed dated 1-16-1978 from John J. Van
Bockel, et ux to Walter R. Grimes, et ux filed in Book 2943, Page 96
Galveston County Deed Records and being more particularly described by
metes and bounds as follows;
Commencing at a found 1/2" iron rod marking the intersection of the
northwest right-of-way line of Coward's Creek Court (50' wide) and the
southwest right-of-way line of Greenbriar Drive (70' wide); Thence S 45°
