That Clarence O. Gordon, of Galveston County, Texas, hereafter called "Grantor," for
CCP
and in consideration of Ten Dollars ($10.00) and other good and valuable consideration, cash in ,-31-1
hand paid, receipt of which is acknowledged, does GRANT and CONVEY to Clear Creek c'
Drainage District of Galveston County, located in the County of Galveston, State of Texas, its
successors and assigns, hereafter called "Grantee," an easement(the "easement") fifty (50)feet in
width to construct and maintain facilities for drainage, in the location described in Exhibit "A,"
which is attached and incorporated. Within the 10 feet in width of the easement that is most
distant from the centerline of the creek, the existing trees that have been banded will remain in
place and not be removed.
Grantor further grants the right of ingress and egress to and from the land for any purpose
necessary and incident to the exercise by Grantee of the rights granted by this agreement.
Grantor retains to itself, its successors, tenants, sub-tenants, agents, and licensees, the
right to use and enjoy all of the easement; provided, however, Grantor shall not exercise such use
and enjoyment in a manner that will interfere with the rights granted. Any structure including
fences shall not be erected in or across the easement which will inhibit the free flow of water, or
access to the easement by drainage crews or equipment.
This Agreement is subject to any prior existing easements, leases, or other agreements
affecting the easement and Grantor's adjacent properties, including without limitation, any
matters of record in the Official Real Property Records of Galveston County, Texas.
TO HAVE AND TO HOLD said easement perpetually to the said Grantee, and Grantee's
successors and assigns, subject, however, too automatic termination, extinguishment, and

reversion to Grantor in the event Grantee should ever abandon and cease to use the easement for
drainage purposes.

All that certain 0.3337 acres being a 50' foot drainage easement out of Lot
4, Block "B", Central Park Subdivision according to the plat thereof filed in
Volume 105, Page 151 Galveston County Plat Records and being out of that
certain 1 .274 acre tract described in a deed dated 1-20-1986 from Oscar
Buel Smith, et ux to Clarence 0. Gordon as filed in Official Records of Real
Property of Galveston County, Texas at Clerk's File Number 86-02640, Film
Code Number 004-35-2234 and being more particularly described by metes
and bounds as follows;
Commencing at a call and found 1/2" iron rod marking the south corner of
said Gordon Tract and being on the northeasterly right-of-way line of
Greenbriar Drive (70' wide); Thence N 44° 49' 33" W - 185.40' to a set
5/8" iron rod marking the POINT OF BEGINNING of herein described tract;
Thence N 44° 49' 33" W continuing with the northeasterly right-of-way line
