GRANT AND CONVEY, unto CLEAR CREEK DRAINAGE DISTRICT, of the County of Galveston, State of Texas, its successors and assigns, a non-exclusive easement (hereinafter "Easement") for the purpose of constructing, maintaining, repairing, servicing, operating, repairing and re-constructing a drainage canal, including ditches, laterals and levees, upon, over, through and across that certain tract of land described on Exhibit "A" attached hereto and made a part hereof for all purposes. TO HAVE AND TO HOLD the Easement, together with all and singular the rights and appurtenances thereto in any manner belonging, unto Grantee, its successors and assigns; and Grantors do hereby bind themselves, their heirs, executors and administra- tors, to WARRANT AND FOREVER DEFEND all and singular the Easement unto Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, and it does hereby covenant that it is lawfully seized of the afore-described premises and that it does have authority to grant the Easement for the purposes heretofore expressed. The Easement hereby granted shall terminate and revert to Grantors, their heirs, executors, and administrators, upon the permanent and intentional abandonment of said Easement by Grantee. Grantors retain, reserve and shall continue to enjoy the use of the surface of such property for any and all purposes which do not interfere with and prevent the use by Grantee of the within Easement.
