DRAINAGE EASEMENT RECORDER'S MEMORANDUM:
At the time of recordation,this Instrument
was found to be inadequate for the best

egibility,carbon or photo copy,discolored
paper, etc. All blockouts, additions and
COUNTY OF GALVESTON § changes were present at the time the instru-
ment was flied and recorded.
That the undersigned (herein called "Grantors") , for and in
consideration of the sum of Ten and No/100 Dollars ($10.00) and
other good and valuable consideration to Grantors in hand paid by
the Grantee named herein, the receipt and sufficiency of which
is hereby acknowledged, have SOLD, GRANTED AND CONVEYED, and by
these presents do SELL, GRANT AND CONVEY, unto CLEAR CREEK DRAINAGE
DISTRICT, of the County of Galveston, State of Texas, its successors
and assigns, a non-exclusive easement (hereinafter "Easement")
for the purpose of constructing, maintaining, repairing, servicing,
operating, repairing and re-constructing a drainage canal, including
ditches, laterals and levees, upon, over, through and across that
certain tract of land described on Exhibit "A" attached hereto
and made a part hereof for all purposes.
TO HAVE AND TO HOLD the Easement, together with all and
singular the rights and appurtenances thereto in any manner
belonging, unto Grantee, its successors and assigns; and Grantors
do hereby bind themselves, their heirs, executors, administrators,
assigns and legal representatives, to WARRANT AND FOREVER DEFEND
all and singular the Easement unto Grantee, its successors and
assigns, against every person whomsoever lawfully claiming or to
claim the same or any part thereof, and they do hereby covenant
that they are lawfully seized of the afore-described premises and
that they do have authority to grant the Easement for the purposes
heretofore expressed.
The Easement hereby granted shall terminate and revert to
Grantors, their heirs, executors, administrators, or assigns,
upon the permanent and intentional abandonment of said Easement
by Grantee.
Grantors retain, reserve and shall continue to enjoy the use
of the surface of such property for any and all purposes which do
not interfere with and prevent the use by Grantee of the within
Easement.

This Easement shall not be assignable by the Grantee, and
any assignment shall terminate the Easement.

A strip of land 50 feet wide, out of Lot 8 and 9, Imperial Gardens, a
subdivision in Galveston County, Texas, according to the map or plat thereof
recorded in Volume 254-A, Page 88, in the Office of the County Clerk, Galveston
County, Texas, and out of Lot 4, Block 1, Liberty Tree Estates, a subdivision
of 27.6585 acres of land, according to the plat as recorded in Map Record 18,
Page 37, in the Office of the County Clerk, Galveston County, Texas, situated
in the Sarah McKissick or J. R. Williams Survey, Abstract 151, Galveston County
Texas, and being more particularly described by metes and bounds as follows:
BEGINNING at a point for corner in the west line of Lot 9 of Imperial Gardens,
being located North 16 deg. 06 min. West a distance of 245.59 feet from a 1
inch iron pipe found for the southwest corner of said Lot 9;
THENCE North 16 deg. 06 min. West along and with the west line of Lot 9, a
distance of 58.89 feet to a point for corner in the proposed centerline of
Cowart creek;
THENCE along and with the proposed centerline of Cowart Creek with the
following courses and distances:
North 42 deg. 00 min. 42 sec. East a distance of 58.88 feet;
North 55 deg. 31 min. 53 sec. East a distance of 32.42 feet;
North 69 deg. 32 min. 58 sec. East a distance of 48.37 feet;
