RE: Maintenance Easements Along
Clear Creek and Chigger Creek
Dear Mr. Chris.:ian:
Polly Ranch Estates, Inc. will agree to provide a maintenance easement

along both the aforementioned creeks as long as it is the authorized govern-
mental agency nr its duly constituted representative involved in maintaining
clear flow of :he creeks within their existing natural banks and for clearing
any flow imped ments, not so done by the property owner, for a distance of
150 feet from :he center line of the creek, except in the instances of that
creek frontage of commercial Reserves K and L, whereby we propose no easement.
Each dee•I transferring title to property that borders either creek,
with the excep ;ion as noted above, will contain the following easement:
So that ;he water flow of (name of creek) may be maintained, a
maintenance ea;ement of 150 feet in width, measured from the centerline of
the creek is p.ovided for any and all types of equipment necessary for the
removal of exi ;ting flow obstacles; said work shall be done by the appropriate
governmental unit(s) or agent(s) . The record owner shall not erect any
permanent stru:ture within the boundaries of this easement except for those
boating facilities approved by the Corps of Engineers. Any fence or other
property improiement that impedes such work will be removed and replaced
by the record )wner at record owners expense; however, the governmental
unit(s) or agent(s) shall be required to clean up all trash and residue
collected, and fill in all tracks and/or smooth out all mounds or what-so-ever
else may be necessary so that all evidence of the work is eliminated. A tree
less than six(5) inches in diameter may be removed if it interfers with the

work in progress; however, any tree removal of a tree greater than six (6)
inches in diameter must have the record owners consent. No person shall
construe from this easement the right to widen either Clear Creek or Chigger
Creek from its existing natural banks before negotiating with and purchasing
such right from the record owner.
Hopefully, this will meet with your approval so the subdivision plat
can be finalized and we can proceed.
