HomeMy WebLinkAboutCC Minutes 1982-10-11 Special .�6 d MINUTES OF A SPECIAL MEETING OF THE FRIENDSWOOD CITY COUNCIL October 11 , 1982 A Special Meeting of the Friendswood City Council was held at the City Hall on Monday , October 11 , 1982 , at 7 : 30 p . m, with I the following members present : � Mayor Ralph Lowe City Manager Jim Morgan Councilmen : Todd Stewart City Sect. Bobbie Henry Jan Jordan Loren Wood Evelyn Newman Leon Brown With a quorum present, and with Councilman Wicklander absent , the following business was transacted; � CLEAR CREEK DRAINA6E DISTRICT - Commissioner Jim Vogas said he � caanted to clear up a possible misunderstanding regarding delay � in information from the District reaching city engineers who are working on plans for, the Greenbriar bridge . He said he believes � the problem was a lack of communication , but stated that the ,� Distriet agrees with the alignment by Collins and Roberts . He asked that care be taken by the city' s building inspector not to issue permits within drainage easements , and �that all new non-residential development in the city be required to get approval of the drainage District prior to being issued a permit . In response to a question from Councilman Wood, Vogas stated that I the creeks .and tributaries in the city are the responsibility of I the Drainage District . � - Vogas stated that the District has essentially finished their work on Clear Creel< ; that specs are now being drawn up by the Disrtrict and the Brazoria Drainage District for work on Mary ' s Creek , then they will be ready to start s-taking for the realignment . Asked by P4ayor Lowe if the Distric-t anticipated help from the city on the Mary ' s Creelc project , Vogas said possibly with dirt moving . . PRESENTATION OF PLAQUES - A plaque was presented to former Mayor Dale Whittenburg, and a plaque and portrait were presented to former Councilman Paul Schrader. INDEPENDENT AUDIT OF BLACKHAWK PLANT - Mr. Quick has requested }��� that Lairson & Williams be authorized to audit the records of the��� Blackhawk Plant construction . MOTION : (Jordan) To authorize the Blackhacak audit . ��u/ Second : Brown �� Vote : Unanimous FOR MOTION CA�tRSED MOVING OF �XXON PIPELINE DAMAGED flY STREET CQNSTRUCTION CREW ! Mr. Morgan reported that the original roadway existed when EXXON laid the line , but 20 ' additional feet of right-of-way was acquired after the I.ine was laid, thus by mutual agreement placing two-thirds responsibility for `the line being in -the roadway on EXXON and one- third on the city . EXXON estimates cost of moving the line out � of the roadway wi7.1 be $].6 , 641, and asks the city to pay one-third ,���" of that amount. ,�- � MOTIOPI : (Stewart) To authorizc: shar.ing cost of moving pipeline with EXXON with a r_•eilin.g of $6 , 000 . / Second: Brown �� Vote : Unanimous FOR MOTION CARRIED � �68 POLICY FOR DEVELOPP4ENTS OUTSIDE CITY LIMITS - DISCUSSION 4dITH PLANNING & ZONING COMMISSION Several recent requests for the city to furnish water and sewer service to developments outside the city limits prompted Council � to invite the Commission to discuss formulation of a policy on "' such requests . The Commission seemed to generally feel that the ��� city should not encourage development just outside the city `which would not be permitted in �the city. Mr. Morgan , in a memo , ��stated some of his ooan recommendations on these developments . �This memo is attached hereto and made a part of these minutes . Mayor Lowe read a letter from Jim Balcer withdrawing his request for utility service from the city , ' Further study will be made on u ° -.� mal policy for such requests . � PROPOSAL FOR HANDLING WRITING OP C)RDINANCES - Councilman Stewart proposed that legal fees may be rni.n.imized by council members who wish to introduce .a new ordinance , do so as far as possible with the help of the city staff , i. e . acquire similar ordinances from other cities , determine just what the ordinance is to accomplish, and write the new ordinance . Copies wou].d t�� rnade available to other Council members for workshop purposes , �nd would go to the attorney after context has been determined , Por his approval as to legality . Council agreed with this procedure . DELINQUENT TAX LETTERS - Alta Carbone has asked if the City would li]<e thes.e letters sent out by -the same �:at�.orney who is doing the School District letters . No decision was made . Councilman Jordan plans to look into the matter. MINUTES FOR APPROVAL (Carried over ' rom Oct.ober 4 meeting) . Second : Newman Vote : Unanimous FOR MOTION CARRIED COMMENDATION - Paul Schrader commended the Friendswood police and ambulance crews , as well as those of Forest Bend and others in attendance for efficient handling of a serious auto accident at Clear Creek bridge on PM 528 this week-end .
