! MINUTES OF A SPECIAL MEETING OF THE FRIENDSWOOD CITY COUNCIL
June 14 , 1982
I A Special Meeting of the Friendswood City Council was held in
the City Hall on Monday, June 14 , 1982 , at 7 : 30 p.m. with the
following members present :

With a quorum present , and with none absent , the following
business was transacted:

� ANNOUNCEMENTS & COMMUNICATIONS FROM THE MAYOR - Mayor Lowe told
� the Council the "Vote Today" Banner had been purchased at a
� cost of $275 . 90 .
`� DRAINAGE DITCH IN WINDSONG - Melvin� Meinecke presented a map and o�
C[ memo to Council saying the ditch could be improving by acquiring tk"{�
a 40 ` drainage easement from Windsong to Chigger Creek. Malcolm 1a
Collins visually inspected the proposed 40 ' drainage easement and
agreed this would improve the drainage in this area. Council
agreed the next step would be to acquire the name of the owners
and proceed with obtaining the rights-of-way.
LOREN WOOD COMMERCIAL FOR YNQC - Couneilman Wood ask for everyone
� to particlpate in the YNOC hire-a-teen program.
I,__' SYVIA FOLETT - Mrs . Follett addressed the Council pertaining to a

noisy rock band that pYdra(etices across the street from her home
3 or 4 times a week. The Mayor ask for a volunteer from the
Council to look into the situation and Councilman Stewart volunteered.
STAN BRANHAM - Mr. Branham told Council he felt he was treated un-
�ustly by a police officer. He told them he received a ticket �i"�, �
for 72 in a 55 mile an hour zone and when asking to see the radar � '
read out was told no. He also told then he was treated like a
criminal rather than a person receiving a ticket.
STATUS REPORT BY CITIZENS ADVISORY COMMITTEE - UPPER MARY"S CREEK

Council heard a report from Chairman Linn Eignus , the committee
including representatives from Village Green and Kingspark/Whitehall
areas .
i Mr. Eignus told Councl rthe Committee or a representative of
i the committee had met with the Clear Creek Drainage Dis-trict ,
i Malcolm Collins , Consulting Engineer for Brazoria County Drianage
District #�+ , the City of Friendswood, Ted Bogren, Consulting
Engineer for Clear Creek Drainage Disrtrict , Omer Poorman, Distriet
Engineer With Texas Department of Highways , and each had been
helpful and infonmative. They have established a plan of develop-
ment schedule to be brought to a joint meeting of the City Council
and representatives on October 18 , 1982 .
The Committee agreed to furnish the City with a ball park cost by
mid-July so funding could bebudgeted in the next fiscal year.

Mr. Eignus ask Council to appoint 2 representatives from
Dunbar Estates and one replacement £rom Whitehall. The
Committee recommended Tom White from the Whitehall area.
Mayor Lowe said that he and Linn Eignus have met with the
Brazoria County Drainage District #4 to discuss ways in which rthe
.; City can assist the Drainage District on reaehing a conclusion
�� as soon as possible on the flooding problems along Mayx�' s Creek
^, through Village Creek and Dunbar Estates . It was agreed that
Lloyd Yost, Superintendent , would come to the City for an
appraisal of the outfall points of Mary ' s Creek and Coward' s "-
Creek where they discharge into Clear Creek with the intention ; i
of improving the discharge flow characteristics of these creeks .
�Mayor Lowe asked Dale Anna of CCDD to contact Yost in an effort
to expedite this proposes program.
SUBDIVISION ORDINANCE #210
On May 24 , 1982 , a committee was appointed to review the
subdivision ordinance #210 . The members were Councilmen Wicklander,
and Stewart , from the Planning and Zoning Commission Glen Cress ,
and from the Drainage District , Hooks and Bell. Councilman
Wicklander submitted the ordinance with several recommendations
for review by the Council , the City Engineer and City Attorney for
a workshop in two weeks on July 12 and a lst reading of the
['y��� ^ revised Ordinance on July 19 .

MOTION: (Jordan) To adopt the time table as a goal as out-
lined in Council Wicklanders cover letter. ' '

Vote : Unanimous FOR MOTION CARRIED '
DRAINAGE DISTRICT - Drainage Members present were Vogas , Smith,
Anna, Hooks , and Bell. Vogas made a film presentation on the
history of the Drianage District. He also included information
on the projects , number of employees , equipment and funds . , �.
��DRAINAGE DISCUSSION - Mayor Lowe reiterated his proposal that the �
� City deepen Cowards Creek between Castlewood and Sunset Bridge �
and that the City Council ,proceed to acquire right-of-way to
'� perform this work.
Brown stated he felt it is the City' s responsibility to open
the Creek all the way through. He ask Malcom Collins what the c
engineering would cost to properly carr�y the water between the
two bridg,es and asked the Clear Creek Dl2ainage District look at
the areas downstream of �astlewood and above Sunset immediately
after so when we go for bids between the two bridges this could
be included. Malcolm Collins said the engineering, surveying and
design would cost $11 , 000 and take about 2 months . He would need
the right-of-way before surveying is begun . Mr. Smith of the CCDD
agreed with the concept and will so indicate by letter to City
Council. CCDD wanted it made clear to the citizens that work
performed by the City or CCDD on any creek or tributary wi11 be
a part of the overall plan for creek improvments throughout the City.
MOTION: (Newman) The the City to fund $11 , 000 , for Malcolm
I��`� Collins to do the survey and design between Castlewood
and Sunset Bridges taking 2 months . Then proceed with
the survey and engineering .desing from the entrance of
Clear Creek to the Brazoria County line . — ,
Second: Wood
Vote : FOR ( 6) Wood, Jordan, Newman, Wicklander, Brown , Lowe
A�AINST (1) Stewart MOTION CARRIED '
The Clear Creek Drainage District asker�,each Councilman individually
if they could support a tax increase and how much : The consensus
was "yes" in the range of . 20 to . 25 per $100 . 00 evaluation .
Several members indicated they would want to see at least part of
the funds used in acquiring right-of-way.

, REQUEST FOR RETURN OF LAND
I — Mr. Herb McDonald of Gene Branscome Investments , the developer
iof Regency Estates , regarding the park property given to the
City . U . S . Homes is no longer involved in that subdivision
i and the developers are now negotiating oiith another purchaser.
', One of the points of negotiation is sufficient land for a home-
owners association swimming pool . Mr. Morgan stated that he ` "�
has discussed this with the city attorney and has learned the �" �
� city cannot give any portion back ; it must be appraised and sold
� for the appraisal value . If this must be legally construed
(� as parkland it cannot be sold without the citizen ' s favorable
vote . The two tracts were p atted as Recreation Reserves "A"
('� and "B" . Mr. Morgan has aske�ythe city attorney to rule on
�( whether or not they would be construed as parks .
