HomeMy WebLinkAboutCC Minutes 1979-10-15 Regular 35� MINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD CITY COUNCIL October 15 , 1979 A Regular Meeting oP the Friendswood City Council was held at the City Hall on Monday, October 15 , at 7 : 30 p.m. with the following members present : Mayor Ralph Lowe City Attorney John Olson Councilman Paul Maaz City Manager Jim Morgan Councilwoman Vicki Black City Secretary Bobbie Henry Councilman Tom Lay Councilman Dale Whittenburg Councilman Loren Wood Councilman Ed Zeitler With a quorum present , and with none absent , the following o business was transacted: �' INVOCATION by Reverend John Cartmill , Friends Church � � MINUTES - No minutes were available for presentation. � ANNOUNCEMENTS & COMMUNICATIONS FROM THE MAYOR l. Proclamation setting aside this week as "Beat Bay City Week" read by Mayor Lowe and .accepted by Loy Trevino of the Friendswood High School Student Council. 2 . Proclamation declaring "International Friendship Day" in honor of foreign exchange students in this area, accepted by Ruby Ross . 3 . Presentation of his portrait to former Councilman R. J. -- Blanken by Mayor Lowe. PETITIONS & COMMUNICATIONS �G^ � q l. Glenn Lunney informed Council that when he divided his / , property into four parcels , he built on one , held one for future use , sold one to Sanborn who built on his lot , and sold one parcel to Patterson. In approving the subdivision of the land at the end of a private road, P&ZC stipulated that only four building permits were to be allowed. Recently Patterson requested permission to subdivide his plot into two lots . P&ZC gave approval with the understand- ing that this would complete the four �uilding permits allowable for the entire subdivision. The request Lunney was making of Council was to increase the allowed building permits to five so that he would still be able to sell or build on his extra lot at some future time. With Patterson' s concurrence , Lunney stated that the two of them would make whatever legal commitment acceptable that no further dividing of land or request for building permits would be made in the future . The City Attorney stated that the subdivision ordinance does not , authFi�cjize subdividing on a private road, but since this has already been done , P&ZC could possibly, under the same variance power they used to permit the subdivision, approve one additional building permit for future use by Lunney. He advised that this decision would fall under� the authority of P&ZC as a variance rather than a decision of the Council . MOTION: (Wood) To inform the Planning Commission that � because of the unusual circumstances involved, � Council would have no objection to P&ZC granting � Mr. Lunney ' s request . �j� Second : Zeitler / Vote : Unanimous FOR MOTION CARRIED 358 2 . Lloyd Rathburn has requested permanent public access via Bellmar Street to his 20-acre property just inside Brazoria County. The City Attorney was asked to research the situation and recommend means of protecting the city ' s interest in this situation; meanwhile, Rathburn will be allowed unofficial entry to his land via Bellmar for his use , not for development purposes . 3 . Bill Murphy, developer of Sunpark Estates , has requested ! I reimbursement from the city for certain utility lines he has laid in connection with this subdivision, namely : ' $943 . 00 at $9 . 43/ft for the first 100 feet of 10" sewer line ; $4 , 554. 02 for 414 of 10" sewer line and one manhole (which he states was required by P&ZC but not necessary to the subdivision) ; and $670 . 00 for the first 100 feet of 8" water line at $6 . 70 per foot . Council postponed any action on this item pending research on why the oversizing and extEnding of these lines were required and by whom this request was made , since the P&ZC chairman was present and denied that such requirements had been made by the Planning Commission. 4 . Rancho Vehjo I residents have requested that the city parti- cipate in laying a 6" water line through the subdivision now that city water is available. Mr. Morgan, explaining that present policy is to participate in water lines only in those subdivisions which were annexed to the city and thus had no city water facilities , and recommended that the request be denied. �,0,���//y MOTION : (Lay) That the request be denied in keeping �� with the recommendation of the City Manager. Second : Zeitler ' Vote : Unanimous FOR MOTION CARRIED i 5 . Soccer Program Representatives Tom Grace and Garth Wood reported that the lighting of the soccer fields has been completed and thanked Council for their support of the soccer program which now involves 475 young people. They also ex- pressed their appreciation for the help of Phyllis Lee , Parks Director. 6 . Wilderness Trails Subdivision - A request for aceeptance of facilities by the developer revised the question of a 20 ' additional right-of-way for the road located along the southwest boundary of this subdivision. Planning Commission had required that the developer furnish this r-o-w as a condition for approval of the subdivision plat based on the fact that 80 ' is needed to make this street a thoroughfare to give adequate access to Wilderness Trails . Dr. Boone explained why he had not been abel to acquire the needed 20 ' . Council agreed that the City probably is in a better position to negotiate for the land, that Mr. Morgan was instructed to make the necessary contacts , and if the land can be purchased that Dr. Boone would be responsible for furnishing the necessary money for this acquisition. SPECIAL REPORTS l. Ron Neighbors of the Subsidence District gave a slide pre- sentation of the subsidence si�uation in the district ' s jurisdiction. He urged Friendswood to proceed on their arrangements for converting to surface water as required. He stated that he felt elected officials could bring about a definite quote from the City of Houston as to the price of treated water for this city and other members of the "Consortium. " 35�1 MOTION: (Lay) To authorize the Mayor to write a letter ��^ �� to the Mayor of Houston asking that he get involved in �� supplying surface water to the Friendswood area. Second: Whittenburg r�� Vote : Unanimous FOR MOTION CARRIED � REPORT ON DATA PROCESSING EQUIPMENT - Bill Thompson stated that after a thorough study of the various systems , he recommends , the city go with IBM for in-house data processing from the stand- point of capability and cost. Mr. Morgan confirmed this recom- mendation. s/- �9 MOTION : (Zeitler) To proceed with a lease contract for the IBM System 32 computer. �� Second : Wood � Vote : Unanimous FOR MOTION CARRIED '7� LIBRARY FLOOD LOSS - Bruce Goss of the Library Board presented a written report showing the materials lost during the recent flood (� as $1, 489 . Patrons who reported books which they had cheeked out ,�. as being ruined by the flood will not be charged for replacement. � MOTION: (Zeitler) To accept the report from the Library Board. � Second : Black � �[ Vote : Unanimous FOR MOTION CARRIED �/ � CONSENT AGENDA /9 MOTION: (Lay) To add "Reimbursement for Boat Lost During Flood" and delete "Award of Bid on Police Cars" and approve the Consent Agenda as ehanged. Resolution No. R8-79 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS , MAKTNG CERTAIN FINDINGS CONCERNING CERTATN LANDS DESCRIBED IN SAID RESOLUTION; DETER- MINING THAT SUCH LANDS ARE NEEDED FOR PUBLIC USE FOR SANITARY SEWER PURPOSES FOR THE INSTALLATION OF INTERCEPTOR LINES TO THE BLACKHAWK REGIONAL SEWAGE PLANT; AND AUTHORIZING THE CITY MANAGER TO .MAKE FINAL OFFERS TO THE OWNER OR OWNERS OF SUCH TRACTS . 4 • Payment to William A. Connery $2 , 000 as reimbursement for his boat which was atolen while on loan to the city during the recent flood. Second: Black Vote : FOR (6 ) Whittenburg, Black, Lowe � Lay, Wood, Zeitler ! � AGAINST (1) Maaz MOT�ON CARRIED ORDINANCE PROHIBITING USE OF WOOD SHINGLES - The Planning Com- mission has requested that Council pass an ordinance prohibiting . the use cf wood shingles on new construction in Friendswood due -to the fire: hazard. Council opinion was that more expensive Tiomes on extra large lots might be exempt , but were unanimously in favor in the case c�f multi-family units and houses on minimum size lots . Commiss:icn Chairman Spears said that controls might be affected by requiri.r_g fire proofing of wood shingles . He was requested to discuss the subject with the Fire Department before an ordinance is written.
