MINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD CITY COUNCIL February 7 , 1977 A Regular Meeting of the Friendswood City Council was held at the City Hall on Monday, February 7 , 1977 , at 7 : 30 p ,m. with � the following members present: I — Mayor Ralph Lowe Councilman Paul Maaz Couneilman Tom Lay Councilman Richard Haken Couneilman Benny Baker With a quorum present, and with Councilmen Patton and Zeitler absent , the following business was transacted: � READING AND APPROVAL OF MINUTES - Minutes of a Regular Meeting �" of January 10 , approved as corrected; Minutes of a Special � Meeting of January 17 , approved as read; Minutes of a Regular � Meeting of January 24 , approved as read. a ANNOUNCEMENTS & COMMUNICATIONS FROM THE MAYOR - 1 . Mayor Lowe called attention to the up-coming council election and the filing deadline of March 2 at 5 p .m. 2 . Bids were opened today on rehabilitation of the sewer lines , and the bids turned over to Engineering Scienee for tabula- tion. Mr. Frank Coe requested a decision from Council regarding G77�- 77 Harris II Subdivision, question being ingress using land acquired by the City in 1964 for street purposes but whieh has never been opened as a street. The City Attorney stated "The division of the larger piece of property for the purpose of sale , building, etc. is in violation of the statutes and our subdivision ordinance and that has alredy been done by the deeds , and until it has been platted both statutes and the subdivision ordinance state that it shall be unlawful to extend any city-owned utilities to the property. " The matter of opening a street to Whispering Pines by the owner was discussed , and an estimate from Jim Gertrell of turning the corner from Castlewood onto this "extension" of Quaker. Consensus of the Council was that Mr. Harris should come before the Planning Commission and do whatever is necessary to comply with the subdivision ordinance in the division of the property. 2 . Mr. George Barrell, on behalf of Frank Willaert, owner of °� 7� 7 � _ a private water system in Tower Estates , has requested per- mission to lay additional lines in city right-of-way. Mr. Barrell was told that the City will have no objection if plans are presented to the city which conform to city specifications , and city approval has been given. Mr. Olson informed Council that a franchise agreement should be executed with Mr. Willaert, and he is to draw up such an agreement. _ --- _ � � _ -- BUSINESS 'TTEMS n� 1 . Mustan'g M'ea'dows - Acceptaiice of Street's & Utilities �� MOTION: (Lay) To accept the facilities on condition of com- pliance with the City Engineer' s requirements : <1) Clean and shape ditches according to approved typical section; ( 2) Furnish City copy of disinfection test on water lines ; ( 3) Submit to City a check to cover cost of street signs ($103 . 40 ) ; (4) Locate I all valve boxes ; and ( 5) Remove excess excavation at intersection of A-Bar and Falling Leaf. Second: Baker - Vote : Unanimous FOR MOTION CARRIED ,�.9`77 2 . Bids on City Cars MOTI'ON : (Maaz) That , on recommendation of the City Manager, the bid for two police units be awarded to Jack Sollock Chrysler Plymouth as the low bidder at $9 , 503 . 55 for the two . Second: Baker Vote : Unanimous FOR MOTION CARRIED �o -1'T 3 . Excused absence for Councilman Zeitler MOTI'ON: (Haken) To excuse the absence of Councilman Zeitler from meetings due to illness . Second: Lay Vote : Unanimous FOR MOTION CARRIED ,�( - 7 7 4 . Tax Exemption for Over-65 �itizens MOTION: (Maaz) To authorize a $6 , 000 exemption on ad-valorem taxes for citizens over 65 years of � age, for the tax year 1977 . Second: Baker Vote : Unanimous FOR MOTION CARRIED „3a -7� 5 . Crown Centra'1 Petroleum Company - Exception - The city' s Oil Inspector, Clyde Raney has recommended approval of a request £rom Crown to continue use of a temporary compressor with an increased noise level beyond that authorized in Ordinance #�187 MOTION: (Lay) To grant the exception to Crown through December 31 , 1977 . Second: Baker Vote : Unanimous FOR MOTION CARRIED ��3�7� 6 . Community P'ublic Service Interim Rate Increase Re uest CPS has requested this increase pending a decision on their earlier overall rate increase . On advice of the Attorney, the following action was taken: MOTION : (Baker) To accept the recommendation of the City Attorney and deny the request. Second: Haken Vote : Unanimous FOR MOTION CARRIED i 3'�f��, 7 . Bntex 'Rate Increase Request - The City Attorney recommended � that a letter be written stating that " . . the City finds that the proposed new rates . . .are excessive and not sufficiently supported; therefore their operations is suspended for a period of 120 days beyond the ' date on which such schedule of rates would otherwise go into effect. " MOTION ; (Lay) That the increase be denied by way of a letter as recommended by the attorney, and that a public hearing on the question be called for March 7 . Second: Maaz Vote : Unanimous FOR MOTION CARRIED _ __ � � � 8 . Rezoning of Methodist Church Property - The Planning Commission advises that a request has been made to rezone °�'S` 7'�/ this church property on Edgewood to "Specific Use - Church" and they have called a public hearing on the matter. They asked that Council also call a public hearing. MOTION : (Maaz) That a public hearing be called for 7 : 30 p .m. on Monday, March 21 for the purpose of considering rezoning oF the Methodist Church property. Second: Lay - Vote : unanimous FOR MOTION CARRIED 9 . Proclamation - National Engineers Week - Feb . 20-26 , 1977 was read by the Mayor. 10 . New Director of Public Works - Mr. Morgan introduced Bakeer Naseef as the new Director of Public Works . 11 . Community Counseling Service Board Ap ointments 3(_ 77 � �' MOTTON: (Lay) To approve the appointment of Robin ) Manison, Dick Atcheson, and Louise MeClure to ;a the Counseling Board. s] Second: Baker Vote : Unanimous FOR MOTION CARRIED 12 . Juvenile Vandalism - Mr. Morgan asked if there is some way '3 �� 7 7 that damages can be recovered which result from acts of juvenile vandalism. He named several cases of property damage in city parks as well as to private citizen' s property. The City Attorney said that he will give Council a written interpretation of what can be done in these cases under the law. 13 . Hospitalization Insurance for City Employees - Mr. Morgan '3 � 77 reported that because of the high cost with the present insurance company for dependent coverage , he has had some other programs presented to the employees and they have elected a policy with Cal-Western Insurance Company. He asked that Council approve the change . Since the new policy costs the city $7 . 00 less for each employee , the Council felt they would like this savings to the city to apply to the dependent coverage which is paid by the employee . MOTION: (Baker) To approve Cal-Western for health insurance for city employees , and to apply the savings by the city to the employee dependent coverage payment.
