Lowe Councilman Paul Maaz Councilman Milton Windler � Councilman Benny Baker Councilman Richard Haken � Councilman Edwarc� Zeitler With a quorum present , and with Councilman William Patton absent , the following business was transacted. READING AND APPROVAL OF MINUTES - Minutes of a Regular Meeting � of Feb�uary 1,6 , approved as corrected. Minutes of a Special �.y Meeting of February 23 not presented. � � � ANNOUNCEMENTS � COMMUNICATIONS FROM THE MAYOR � l. Senator Schwarts , scheduled to be present tonight , will `"� be in attendance at the meeting of March 15 . 2 . The Court of Appeals has supported Texas City (Olson, Attorney) in the electrical rate injunetion hearing against CPS . Refunds to customers may be in order. 3 . Mayor Lowe attended a meeting in Forest Bend on Thursday with Harris County Drainage a�ith`�'orities discussing flood control measures on Clear Creek. All agree� that cooperation among all concerned is essential for any action. ' 4. Filing for office in April 3 City Election closes at 5 P.M. ' on Wednesday, March 3 . Drawing for place on ballot to be ' held on Thursday, March 4 , at 5 p.m. in the Secretary' s office , ' _ 5 . The Highway Department has notified us that the overhead "Friendswood" sign on the Gulf Freeway at FM 2395 has been appr.oved and. is being fabricated for erection. 6 . Bob Wright of KTRH called to commend the Friendswood Police on activities relative to the Kerr kidnapping last week. 7. A deed to the lot in Quaker' s Landing has been received from Amoco, and method of sale will be investigated. 8. An injunction has been issued by the Court in the case of CCBA vs . the City. It states : . . . . It is accordingly ordered . . . .that the Clerk of this Court issue an injunction pending final ,�earing o� this cause that the defendent . . . . .be temporarily enjoined from causing. . . . . . discharge of any waste into Cowards Creek and Clear Creek . . . in violation of the TWO Act and waste control orders #10175-01 and 10175-02 . " TNTERIM MODIFICATIONS TO SEWER PLANTS - Tn view of the injunetion, Engineering Science (James Bright) presented proposals and costs for modifications . It was agreed to request a meeting with the Texas Water Quality Board to discuss the modification as proposed and City' s sewer permits . BUILDING PERMIT - APPEA�. - Bob Doss has been refused a building ��"7�' permit since the lot he recently purchased is not in a subdivision � approval by the Planning Commission. Doss presented documentation that his purchase was for a parcel of land in its entirety as it was recorded years ago , thus does not constitute "subdividing" of land at �the time of the purchase. Council. , un.der these conditions , ruled that the permit should be issued. 1 -- - - . . ----- - ---_. - - - - -- - - - -� - � ---- -- . - - - � � �. ��-'�" �� REPAIR TO SUBSIDING STREETS - John Williams of Quaker' s Landing asked when the work would be done to stop the sinking of his street. Mr. Morgan outlined cost for thi.s project and other similar situations throughout the City at an estimated $7 ,000 . Council was favorable to using- current street repair funds to do this work. FINANCIAL REPORT FROM THE CITY MANAGER - Deferred till copies can be furnished to Council. �w,�� AWARDING OF BIDS ON DUMP TRUCK - Mr. Morgan recommended that � � the bid be awarded to Bud Brown Ford, third highest bidder, since the low bid not in accordance with specs , and the second highest bidder has not done satisfactory service on city vehicles in the recent past, and some charges are now being protested by the City. MOTION: (Zeitler) That the bid be awarded to �he second lowest bidder, South Loop Truck Sales , at $11 ,456 . 68 along with negotiation of #350 repair bill pending against the City. Second: Maaz Vote : UNANIMOUS FOR MOTION CARRIED AWARDING OF BIDS ON CITY CARS - Mr. Morgan recommended that the ' �-�'7"'7�' bid for two new city cars from Norm Livermore Dodge be accepted. MOTION: (Haken) To accept recommendation of the City Manager , and award the bid to the low bidder, Norm Livermore Dodge , for $9 ,384 . 85 . Second : Windler Vote : Unanimous FOR MOTION CARRIED SUBDZVIDING SMALL PARCELS OF LAND WITH EXISTING CITY SERVICES C���-�1� Council being agreeable with the proposed procedure , asked that the City Attorney be requested to write a revision to the subdivision Ordinance if he feels this is required. lfR����P LOVACA GATHERING COMPANY LINE '`C MOTION: (Windler) To give approval for installation of a gathering line as requested by Lovaca. Second : Baker Vote : Unanimous FOR MOTION CARRIED 5��,�� AMOCO GATHERING LINE - Amoco has requested permission to lay a gathering lin.e in the Sunmeadow area. Inspector Raney will be � asked to give an opinion, and action will be taken at a ��,,.- apecial meeting next week. ��I `7� LIBRARY BOARD APPOINTMENT - �Aeverley Koos has resigned from the Board, and it is` recommended that Phyllis Rummel be appointed i�o replace Koos . MOTION: (Zeitler) To appc5int Phyllis Rummel to complete the Library Board term of Beverly Koos . Second : Haken Vote : Unanimous FOR MOTION CARRIED WARRANTS FOR. APPROVAL G�A #1660 - Hills Sand Company 546 . 50 1661 - Safety Light Company 1 ,080 . 15 M�0 #756 - Meter Repair Service 996 . 00 MOTION: (Maaz) To approve these warrants . Second: Baker Vote : Unanimous FOR MOTION CARRIED � � � Mara�hon-Mischel - Final payment on street `'S��,� paving program $51 ,591. 05 MOTION: (Haken) To approval final payment subject to Mr. Olson ' s approval to the bond furnished by the contractor, and finalizing of the drainage at shadowbend and Morningside.
