Chamber at City Hall ; at 7:30 p.m. on December 2, with the following members present: M�yor Edward F. Stuart i �, Councilman James Mager Councilman William Patton Councilman Ralph Gonzalez —1 Councilman Ralph Lowe � Councilman Richard Haken Councilman Ronald Hamil With a quorum present, and none absent, the following business was transacted: , � READING AND APPROVAL OF,MINUTES of a Regular Meeting of November 18. Two corrections were made: 1 ) ANNOUNGEMENTS #2: change Corporation Court ' �.,s to read Commissioner's Court; (2) under ORDINANCES 3. Ordinance No. 159: � Jack Laws�on s ou d be Jack Lousman. Minutes approved as corrected. � 6� ANNOUNCEMENTS & COMMUNICATIONS FROM THE MAYOR �"'�� � 1 . Letter from TW�setting forth a new Order in compliance with Senate Bill 835 enacted by t e 72nd Legislature, and requesting comments on the proposed order 7 days prior to the December 16 Board meeting, when the Order will be fina1ly approved. 2� Letter from D. G. Romeike requesting repairs on his road 3. Letter from Rad�er Ko,�pa, Secretary of the Planning & Zoning Commission, giving t Ce ommission s recommendation on request for a specific use � ���� permit by the Church of the Nazarene to build a church on Shadowbend between Sunset and Garden Drive in a residential zone. A hearing was held by the Commi'ssion on November '30, and the recommendation resulting stated that the Commission recommends, "that the Church of the Nazarene petition not be granted in light of strenuous opposition of the affected residents and property owners and the likelihood, in the Commission 's opinion, of bad church-neighborhood relations. " PETITIONS AND COMMUNICATTONS � Nazarene Church Re uest: Reverend Land appealed to Council to allow the specific use permit requeste . Several other members of the church spoke on� the subject as we11 as Mr. Flippin, owner of the property, and several property owners in the area who are opposed to granting of the permit. SPECIAL SUBJECT Mr. MalGOlm Co1lins, representing Polly Ranch Estates property owners, appeared before Council to discuss the proposed sewer treatment plant and how it will effect this area. Decision was made to defer this discussion until next Workshop � when the architect for the group will be available. ` DEPARTMENTAL REPORTS i Police: Chief Wright requested that "No Parking" signs be posted on the /�=;��? left hand side of Laurel Drive during certain heavy traffic hours, to prevent traffic snarls during school piak-up times. He also gave a review of �he State Certification program for �policemen and how it will effect the City's auxiliary policemen. ��6)� -- - -----;--------- �r COUNCIL REPORTS 1 . Councilman Patton reported that the oil spill on the creek last week as een virtually cleaned up. He also gave a brief report on work of the Water and Sewer Department. 2. Councilman Hamil reported on street sign installations made by the Street Department. lie stated that the Air Conditioning and Heating Ordinance is in the hands o�f the Fire Department for review; and presented an aerial photo to the City. ���f 3. Councilman Lowe, replying to a request from the Library Board, recommended ' tFiat Council reappoint Mrs. ,Ruth Maloney to the Board for a three-year term. 4. Councilman Ma er reported that the auditors are nearing completion of their work in the office; also that a monthly report of City finances will be forthcoming soon. 5. Councilman Haken stated that he attended the hearing held by the Planning Commission on request for a specific use permit by the Nazarene Church and on proposed changes to the Zoning Ordinance. He gave a brief report on this meeting and the reason for the Commission's recommendation to Cquncil regarding the Church's request. � UNFINISHED BUSINESS 1 . F�re H drant Bids MOTION: (Gonzalez) That the City go out for bids on fire hydrants and insta1lation, and that a copy of the bi.d request be made available to the Fire Department and other concerned departments. Second: Mager; Vote: Unanimous 2. Librar�r Board A�pointment - Upon recommendation of Mayor Stuart: MOTTON: (Patton) That Mrs. Ruth Maloney be reappointed to the Library � Board for a three-year term. Second; Mager; Vote: Unanimous 3. Nazarene Church Re uest for S ecific Use Permit - A motion to authorize the City Attorney to raw up an ordinance granting the permit prompted a iy�� lengthy discussion of whether or not Council should reverse a decision of the P1anni�ng Commission, whether or not this would set a precident regarding location of church buildings, whether another hearing should be held to hear new evidence. This motion was defeated by a four to three vote. . MOTION: (Lowe) That the request of the Church of the Nazarene for a specific use permit be granted for the site on Shadowbend between Sunset and Garden Drive. Second: Mager" VOTE: YES (4) Mager, Lowe, Hamil , Stuart NO (3) Patton; Naken, Gonzalez MOTION FAILS TO PASS � MOTION: (Haken) That Council direct the Planning Commission to reconsider this matter in light of the additional evidence and in light of requesting written protests from those who wish to protest, and specifically following Section 15 of Ordinance #132.
