HomeMy WebLinkAboutCC Minutes 1968-10-21 Regular Approved as corrected - 11/4/68 4 r STATE OF TEXAS COUNTY OF GALVESTON CITY OF FRIENDSWOOD MINUTES OF THE REGULAR COUNCIL MEETING OCTOBER 21 , 1968 A regular meeting of the Friendswood City Council was held October 21 , 1968, at 7:30 P.M. in the City Hall with the following members present: Ralph W. Somers Mayor James E. Mager Councilman George F. Prude Councilman Ronald G. Hamil Councilman Thomas F. Woods Council-man Edward F. Stuart Councilman Pat Gillespie Asst. City Secretary Ody Jerden, City Attorney with the following members absent to wit: . NONE, constituti-ng a quorum at which the following business was transacted. CORRECTION AND APPROVAL OF MINUTES: October 7, 1968: Approved as :read. ANNOUNCEMENTS AND COMMUNICATIONS FROM.THE MAYOR: A few weeks ago a question came up as to who is the owner, of the triangular plot of land near the City's Sewer Plant #1 . Mayor Somers advised that after some investigation of the deeds it appears this land is owned by C. C. "Red" Bost. Mayor Somers has been .in contact with the Mayor- of Pearland. concerning Mrs. John Moore's request to the City of Friendswood to accept a petition from the residents of a portion of-West Friendswood to annex with the City. Mayor Keller advised Mayor. Somers .that Mrs. Moore had discussed this verbally with the City of Pearlandtand they had asked Mrs. Moore to present this to their Council in writing. Part II of the Application for the $50,000 grant from the Texas State Library will be submitted this week. PETITIONS AND COMMUNICATIONS: The Bovay Interim Report No. III was presented to Council by Mr. Harold Barr . of Bovay Engineers. After some questions concerning- this report, Council decided not to accept it due to portions of the report .being compiled from data that is not current. Mr. Barr informed Council that new data would be ium/u6: reg: page z gathered and the report resubmitted at the earliest possible date. Mr. Rex Clawson appeared before Council in regards to a .letter concerning the weeds on his property. Mr. Clawson felt 'it was an undue burden for the City to place a requirement as set out in our Ordinance No. 79 on. such large tracts of land. After it was discussed with Council it was decided to table any action until the following City Council meeting. The following letter was read by Councilman Mager to be included in the minutes and to be voted on by the Council : "BEING THAT THE CITY COUNCIL OF FRIENDSWOOD had previously approved the extending of coverage under the City Insurance Policy providing Workmen's Compensation and Liability to the Auxiliary Police Depart- ment and approved administrative action to place this coverage into force, Councilman Mager met with the Auxiliary Police Department to determine those personnel who are .to be placed on the City'.s payroll in order to comply with the Royal Globe Insurance Company's require- ments to extend the City's .insurance coverage ,to this group. The administrative action taken will be re-affirmed by the City Council at its next regular meeting. The remuneration for those Auxiliary Policemen- to be covered will be in the form of a uniform allowance The personnel to be covered under the City's insurance policy and whom should immediately be placed on the City of Friendswood payroll is as follows: Joe Kallus Hayden Maxwell Jim Botsford Louis Crespo Ray Carney Manuel Crespo A. J. Harper Skip Davey Donald Green Betty Merchant Tom Crook Betty Harkleroad Frank Smith Artha Wright The amount of uniform allowance shall be established by the Friends- wood Chief of Police and the Mayor of Friendswood through adminis- trative action. It is my opinion that the women of the organization should be covered also by the City' s insurance since there is the possibility of them being called on duty for such items as prisoner custody, etc." Councilman Mager made a motion that this coverage be approved. The motion was seconded by Councilman Hamil and carried by unanimous vote. UNFINISHED BUSINESS: The Bond Election will be called at the Regular City Council meeting on November 4, 1968. 10/21/68: reg: page 3 35. STANDING COMMITTEES AND DEPARTMENTAL: Streets: Councilman Hamil - A letter of acceptance for the work completed on Brigadoon Lane from Mary Ann Drive to FM 1959 and Mary Ann Drive from Stadium Lane to the Subdivision Southern boundary has .been requested from George Kennedy & Son, Inc. A report on- the testing analysis of the streets also was received. Councilman Hamil made a motion that these streets bed/ accepted for continuance maintenance on condition they are paved as the letter states and upon inspection by the City- Inspector. A letter would then be sent to the Federal Housing Administration from the City accepting these streets. Motion was seconded by Councilman Prude and -carried by unanimous vote. Councilman Woods stated he would like this letter of acceptance to be made a part of the minutes. See letter attached. .. . Health/Safety-. Councilman Prude - Fire extinguishers have been installed in t e City .vehicles. ORDINANCES: Third and Final Reading - Ordinance No. 110 AN ORDINANCE PRESCRIBING PENALTIES FOR TRESPASSING; MAKING UNLAWFUL THE ENTRY OF ANY PERSON ON THE PREMISES OF ANOTHER AT NIGHT, UNDER SUSPICIOUS CIRCUMSTANCES; MAKING UNLAWFUL A TRESPASS UPON SCHOOL PREMISES WITH THE CITY OF FRIENDSWOOD; PROVIDING PENALTIES FOR THE FOREGOING. f Motion to approve Ordinance No. 110 on third and final reading was made by Councilman Mager, seconded by Councilman Woods. Before the vote was - taken Councilman Prude asked the difference between "BE IT ENACTED and "BE IT ORDAINED" . Ody Jerden, City Attorney, had not yet arrived at the meeting , and a motion to table the motion was made by .Councilman Hamil until an opinion could be obtained from Mr. Jerden.' Motion to table was seconded by Councilman Prude and carried by unanimous vote. After Mr. Jerden .arrived, he stated that the validity of the ordinance was the same using either clause. ��„Z Councilman Mager made the motion to untable the motion, and to approve the Ordinance as read. Motion was seconded by Councilman Woods and carried by unanimous vote. Second Reading - Ordinance No. 115 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701D, �VERNON-S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF FRIENDSWOOD, AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIOLATION OF THIS ORDINANCE. (Annalea) . Motion to approve Ordinance No. 116 on second reading .was made .by Council-,, , man Woods, seconded by Councilman Prude and carried by unanimous vote. ���` First Reading - Ordinance No. 117 AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, DECLARING THAT GALVESTON COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 21 HAS BEEN COMPLETELY ANNEXED; PROVIDING THAT THE CITY SHALL TAKE OVER ALL PROPERTIES AND ASSETS OF THE DISTRICT; PROVIDING THAT THE CITY SHALL BE LIABLE FOR ALL DEBTS AND OBLIGATIONS OF THE DISTRICT AND CONTAINING OTHER MATTERS RELATING TO THE SUBJECT. Motion to approve Ordinance No. 117 on first reading was made by Council- I )j man Hamil , seconded by Councilman Mager and carried by unanimous vote. Second Reading - Ordinance No. 113-Al AN ORDINANCE AMENDING ORDINANCE NO. 113 DECLARING THE CITY OF FRIENDSWOOD TO BE A BIRD SANCTUARY AND MAKING UNLAWFUL THE ACTS OF TRAPPING, HUNTING, SHOOTING OR ATTEMPTING TO SHOOT OR MOLEST IN ANY MANNER ANY BIRD OR WILD FOWL; MAKING UNLAWFUL ROBBING OF BIRD NESTS OR WILD FOWL NESTS; PROVIDING A PENALTY. Motion to approve Ordinance No. 113-Al on third and final reading was made by Councilman Woods, seconded by Councilman Prude and carried by unanimous vote. RESOLUTIONS:. Motion to table the. Resolution making certain findings of the violation of r Ordinance No.. 79 (Weed Ordinance) concerning the hearing on Mr. Rex Clawson , �- was made by Councilman Mager, seconded by Councilman Prude and carried by unanimous vote. NEW BUSINESS: A motion was made by Councilman Stuart to include-on the ballot for the Bond Election another issue which would be a local option to sell beer and wine for off-premises consumption in the City of Friendswood. Motion was ® seconded by Councilman Prude. I A lengthly discussion followed with Councilman Woods stating that he did-not favor putting this issue on the same ballot with the Bond issue. 10-J2T/6$ re-� page 5 Councilman Stuart stated that he feels that after 5=1/2 years since the last local option election it is time to let the people make- a decision again. Councilman Stuart stated that it was immaterial . to.him as to the City being "wet or dry" , but that one business establishment should not have a monopoly on the selling of beer and wine within a city, which is happening now since the annexation of Water District #21 . Councilman Stuart made another motion to withdraw his motion until certain legal technicalities could be determined in organizing and planning such an election. Councilman Prude seconded the motion of withdrawal . Motion carried by unanimous vote. WARRANTS: Motion to approve Warrants Nos. 2473-2484, Warrants 3956-3965 was made by �/�� Councilman Stuart, seconded by Councilman Mager. Motion carried unanimously. ADJOURNMENT: Meeting adjourned.
