HomeMy WebLinkAboutCC Minutes 1968-10-07 Regular Approved as read - 10/21/68f STATE OF TEXAS COUNTY OF GALVESTON CITY OF FRIENDSWOOD MINUTES OF THE REGULAR COUNCIL MEETING OCTOBER 7, 1968 A regular meeting of the Friendswood City Council was held October 7, 1968, at 7:30 P. M. in the City Hall with the following members present: Ralph W. Somers Mayor James E. Mager Councilman George F. Prude Councilman Ronald G. Hamil Councilman Thomas F. Woods Councilman Edward F. Stuart Councilman Pat Gillespie Asst. City Secretary Ody Jerden City Attorney with the following members absent to wit: NONE, constituting a quorum at which the following business was transacted. CORRECTION AND APPROVAL OF MINUTES: September 16, 1968: Regular: Approved as read. September 30, 1968: Special : Approved as read. ANNOUNCEMENTS AND COMMUNICATIONS FROM THE MAYOR: The $47,950 grant payment on the WPC-Tex-464 project has been received. The principal due Mercer Construction Companye,on the Quakers Landing project has been paid leaving approximately $5000 interest due on that project. The official notice from the Moody Foundation denying the requested grant made by Friendswood for the Friendswood Library project has been received, stating that they could not contribute due to having already granting over $2,000,000 to schools and libraries this year. The library project is progressing. Part II of the application will be ready to submit within the next few weeks. The City was informed by Mr. Lee Brawner of the Texas State Library that federal funds have been temporarily frozen, but that we should continue with the application as scheduled. The City has placed its Workmen's Compensation and General Liability insurance through Truman Taylor Agency with the Royal Globe Insurance Group. These policies will for the first time cover the volunteer policemen in their personal automobiles while in City service. 10:7:68 reg: Page 2 There is planned an approximate $700,000 revenue bond election to be held on November 23, 1968. Councilman Tom Woods was appointed to represent Friendswood on the Legislative Committee of the Galveston County Mayor's and Councilmen's Association. PETITIONS AND COMMUNICATIONS: The following letter of intent was read by Mayor Somers to the Council for their approval and to Messrs. Ray Reed, Henry Howard and Ray Kaulhold, members of the WCID #21 Board: "This letter will confirm for your records the intent of the City of Friendswood to provide funds for the payment on WCID #21 bonds which is due August 1 , 1969. This payment is in the amount of $15,000. The money will be delivered to the WCID #21 Board of Directors on or before July 15, 1969. The funds for this payment are to be derived from utilities revenue received from citizens living within the WCID #21 boundaries. It is the understanding that by presenting this letter to the Water Board, the necessity for that Board to levy a real estate tax in the district will be eliminated and that there will be no tax levy by the Board of Directors to the citizens of WCID #21 for the year 1968." The Water Board members attending this meeting approved this letter. Councilman Stuart made a motion that this letter of intent be approved '7'-1' as read and moved that Mayor Somers be authorized to sign it. Motion was seconded by Councilman Mager and carried by unanimous vote. In accordance with Ordinance No. 99, the following persons were sworn in as Electrical Board members: Edward F. Stuart, K. B. Jones, Wiley Murrell and Truett New. Charles Mills with Community Public Service has been asked to serve on this board, but could not attend this meeting; therefore, he will be sworn in at a later date. A formal request was made by Mrs. John M. Moore for the City to annex a 50 acre tract located on the City's southwest buffer strip. The tract concerned lies southeast of the Hastings-Friendswood Road (FM 2351 ) in Brazoria County between the Brazoria=Galveston county line and Coward Creek. Resident property owners are Jim Baker, James T. Baker and John Moore, who own all the property except a-triangle of about two acres which belongs to Cecil Brown, Jr. 10:7:68 reg: page 3 Mrs. Moore stated that the only technical problem involved is that the City of Pearland would have to agree to adjust its buffer zone so this property would legally be adjacent to the Friendswood buffer zone, and that several members of the Pearland city- administration have indicated that they would be willing to adjust their boundary provided that there are no legal impediments. After discussing this request, Councilman Woods made a motion that Council authorize Mayor Somers to negotiate with the City of Pearland in annexing this tract of land. Motion was seconded by Councilman Stuart and carried by unanimous vote. Mr. C. C. "Red" Bost made q request to the Council for City sewer services to be extended to a proposed subdivision he is going to develop near the intersection of Briarmeadow and Merriewood Drive. Mayor Somers pointed out that this area would be included in the proposed sewer line expansion program if the planned revenue bond election passes on November 23rd. Mr. Bost stated that he would like to have City sewer services whether or not the revenue bond election succeeded or not. After much discussion, Councilman Mager entered a motion to provide /I sewer service to Mr. Bost's proposed subdivision if the proposed revenue bond issue should fail . Motion was seconded by Councilman Hamil , and carried unanimously. NEW BUSINESS: Councilman Stuart moved that the $15,000 required for WCID #21 August 8, 1969 bond interest payment be paid to the Water Board out of water and sewer- revenue paid to-.the City from- that area and the $15,000 shown previously in the budget from taxes to be used for that obligation be transferred to- the General Fund to the Budget Adjustment Account. Motion was seconded by Councilman Woods and carried by unanimous vote. After some discussion, a motion was made by Councilman Prude to move the salary adjustment from January 1 , 1969 to coincide with the City's fiscal year of October 1 , 1968 thru September 30, 1969. Motion was seconded by Councilman Stuart and failed by the following vote: For - Councilman Stuart, Councilman Prude, Against - Councilmen Woods, Hamil , Mager. Mayor Somers stated that he favored the motion. It was suggested to Council by Ken loon and L. B. Cline rather than to fill the vacancy left by Junior Abbott in the Water Department that the water and sewer taps could be contracted at $25.00 for single and $35.00 for a double, including boring under the street. The material would be furnished by the City with the machinery and labor furnished by the 10:7:68 reg: page 4 contractor. After discussing this possibility, Councilman Woods made a motion to authorize the City Coordinator to contract in making water and sewer taps at the quoted price. Motion was seconded by Councilman Mager and carried unanimously. After a lengthly discussion concerning the planned Revenue Bond Election to be held on November 23, 1968, Mayor Somers polled members of the Council on the number of issues that should be placed on the ballot. For one issue - Councilmen Woods, Hamil , Mager. For two issues - Council - men Stuart, Prude. ORDINANCES: Second Reading: . AN ORDINANCE PRESCRIBING PENALTIES FOR TRESPASSING; MAKING UNLAWFUL THE ENTRY OF ANY PERSON ON THE PREMISES OF ANOTHER AT NIGHT, UNDER SUSPICIOUS CIRCUMSTANCES: MAKING UNLAWFUL A TRESPASS UPON SCHOOL PREMISES WITHIN THE CITY OF FRIENDSWOOD: PROVIDING PENALTIES FOR THE FOREGOING. Motion to approve Ordinance No. 110 on second reading was made by Council- man Mager, seconded by Councilman Woods and passed by unanimous vote. Third Reading: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF FREENDS- WOOD, GALVESTON COUNTY, TEXAS, APPOINTING THE MEMBERS OF THE BOARD OF EQUALIZATION FOR SAID CITY FOR THE CURRENT YEAR AND SETTING THE TIME FOR THE MEETING OF SAID BOARD. Motion to approve Ordinance No. 114 on third reading was made by Council ' man Hamil , seconded by Councilman Stuart and passed by unanimous vote. First Reading: AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS EST- ABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 67701 D, Vernon's TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF FRIENDSWOOD, AS SET OUT IN THE ORD- INANCE: AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIOLATION OF THIS ORDINANCE. HUNTING,. SHOOTING OR ATTEMPTING TO SHOOT OR MOLEST IN ANY MANNER ANY BIRD OR WILD FOWL: MAKING UNLAWFUL ROBBING OF BIRD NESTS OR WILD FOWL NEST: PROVIDING A PENALTY. Motion to approve Ordinance No. 113-Al was made by Councilman Stuart, G' — seconded by Councilman Woods and passed by unanimous vote. RESOLUTIONS: No. 16-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS APPROVING AND ADOPTING A STATEMENT OF POLICY OF THE LIBRARY BOARD OF THE FRIENDSWOOD PUBLIC LIBRARY. Motion to approve the above resolution was made by Councilman Woods, seconded by Councilman Stuart and passed by unanimous vote. No. 17-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE THE ATTACHED DEEDS CONVEYING TWO TRACTS OF LAND TO COMMUNITY PUBLIC SERVICE COMPANY OF TARRANT COUNTY, TEXAS. Motion to approve the above resolution was made by Councilman Woods, _2 6 M seconded by Councilman Stuart and passed by unanimous vote. A RESOLUTION MAKING CERTAIN FINDINGS OF VIOLATIONS OF ORDINANCE NUMBER 79 (WEED ORDINANCE) on the property of Kenneth Smith, Lot 2 of Friendswood Gardens Subdivision. Motion to approve the above resolution was made by Councilman Prude, seconded by Councilman Mager and passed by unanimous vote. UNFINISHED BUSINESS: Motion to approve the contract of Matt E. Howard and associates as architects for the proposed Friendswood Library was made by Couhcilman Stuart, seconded by Councilman Prude and carried by unanimous vote. ;_ L,.� WARRANTS: Motion to approve Warrants Nos. 3927-3939 and 3941-3946, and Warrants Nos. 2430-2443 and 2445 - 2455 was made by Councilman Stuart, seconded byi�0 _ 7 Councilman Mager and carried by unanimous vote.
