IN THE COUNCIL CHAMBERS OF THE FRIENDSWOOD CITY HALL, LOCATED AT 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE FOLLOWING MEMBERS PRESENT, CONSTITUTING A QUORUM: John Ellisor Trish Hanks Sally Branson Robert J. CALL TO ORDER Councilmember Councilmember Councilmember Councilmember Mayor Pro Tern Councilmember City Manager City Attorney Deputy City Secretary Mayor Pro Tern Matranga called the meeting to order, with a quorum present at 5:30 P.M. All members were present with the exception of Mayor Mike Foreman who was absent. 2: INVOCATION The invocation was led by Pastor David Lorenz of First Baptist Friendswood. 3. PLEDGE OF ALLEGIANCE - United States and State of Texas Mayor Pro Tern Matranga led the Pledge of Allegiance to the United States and the Texas State Pledge. 4. COUNCIL COMMENTS AND REPORTS Mayor Pro Tern Matranga opened the item by inviting the Councilmembers to provide their comments. Councilmember Hanks initiated the comments by stating that she attended the Mary Poppins musical at Friendswood High School and encouraged everyone to attend their future production as well as the Education Foundation Gala coming up this weekend. She commented over the Parks Department Daddy - Daughter Dance was a great event that brought the City together to form a stronger community. On March 8', she noted the Friends of the Friendswood Library will have a fundraising gala at the library that is open to the public with this year's theme being based on the book Camelot Beckons. She commended City Staff as well as the Library Director Matt Riley for all their efforts in planning the fundraiser event. Councilmember Branson encouraged citizens to serve the city and volunteer their time to serve on boards and commissions as it is a great way to get involved and engaged and help mold the future of Friendswood. Currently, they have openings on the Community Economic Development Commission. City Council Regular Meeting February 3, 2025 Page 2 of 13 Councilmembers Ellisor and Griffon shared that they also attended the Friendswood High School Musical of Mary Poppins. Councilmember Griffon stated that February 19a' is the IV" anniversary of the Republic of Texas becoming a State and spoke a bit about Anson Jones Day and noted they would be holding a ceremony at Glenwood Cemetery, at which he will be participating. Councilmember Erenwert commented that they planned to view the Friendswood High School Musical this coming weekend. Mayor Pro Tern Matranga closed the comments by recognizing the dedication and professionalism of city staff and thanking them for all their efforts behind the scenes in the recent freeze events in January to keep the community safe. 5. PUBLIC COMMENT Mayor Pro Tern Matranga announced the following citizens had signed up to provide a public comment Mr. Frank Urbanic, a retired Air Force fighter pilot, shared his concerns over the proposed new trash bins. He requested that those bins be displayed out in the lobby of City Hall where people could see them. He additionally noted that he and his wife conducted a survey on the trash bins in Friendswood. Comments that came up with respect to senior citizens is that the trash bins were bulky, heavy, and hard to maneuver. He asked that staff reconsider the trash bins and make sure they fit the needs of the people. Mr. Rob Roy wished to bring to the Council's attention his particular Animal Control case that was rejected because Animal Control had not observed the misdemeanor. Fortunately, his issue was resolved as the owners of the animals in question were evicted a couple of weeks ago. However, he noted people having similar problems would not get a satisfactory response as they would have to present evidence for prosecution. Mr. Tom Hinkley introduced himself and announced his candidacy for City Councilmember Position 6 in the upcoming election. He noted that he had been volunteering for the past six years by serving on several boards and commissions. He is a father, local businessman and looks forward to serving our community further. 6. WATERWORKS & SEWER SYSTEM REVENUE BONDS A. Discuss the Waterworks & Sewer System Revenue Bonds, Series 2025. City Manager Morad Kabiri opened the item by recalling that the City recently adopted a utility rate study that would include a number of projects over the next five years. The bond issuance that is going to be discussed will be for the first year of those projects. Mr. Kabiri then turned the floor over to the speaker. BOK Financial Securities Representative John Robuck proceeded to present the first phase of the bond issuance plan. Mr. Robuck noted that municipal bond rates are 4.35%, which is higher than average due to market volatility. Mr. Robuck stated the principal is $20,395,000 and these bonds would generate $20,500,000 for the City. (Bond Counsel) UW - Underwriters (ro Be Determined) Mr. Robuck stated that they are asking the City Council to give them the green light to move ahead so they can have the rating calls, the diligence calls, and then bring the results of the sale to their next meeting on Monday, March 3rd, for approval. If approved then, they will then close on March 27", at which point the city will receive the funds for those water and sewer projects. There was a brief discussion as to when was the last time they issued water and sewer bonds and why they needed to issue new debt at this time. Mr. Kabiri indicated that the last issuance of bonds was in 2021, however, the water and sewer working capital, above the 90 days is not nearly enough to tackle the scheduled list of projects and may have a situation where the city's water and sewer system would start to degrade. B. Consider approving the schedule for the City's Waterworks & Sewer System Revenue Bonds, Series 2025. However, there was discussion prior to the vote. Councilmember Griffon asked about past 2014 and 2016 refunding and general obligation bonds. Would those go away once they issue these new revenue bonds? BOK Financial Securities Representative John Robuck clarified these bonds are new debt. They would still have those past bond obligations. They are refunding bonds from previous water and sewer debt issuance. The debt will be paid from the Water and Sewer Fund. City Manager Morad Kabiri additionally noted they have no more proceeds from those past bond issuances as those projects have been completed. ZONE CLASSIFICATION CHANGE FROM MULTI -FAMILY -MEDIUM DENSITY TO DOWNTOWN DISTRICT — 311 LAUREL A. Conduct a public hearing regarding a request for a zone classification change for property located at 311 Laurel, 0.289 acres of land, more or less, being a part of Lot 16 of the Harvey and Stout Subdivision of Lots 6, 7, and 8, Block 2 ofFriendswood Subdivision of the Sarah McKissick or J.P. Williams League of Land, Friendswood, Galveston County, Texas, to change from Multi - Family Residential -Medium Density (MFR-M) to Downtown District (DD). At 5:55 P.M, Mayor Pro Tern Matranga opened the public hearing and requested that Staff give the Council an overview of the item. Community Development Department (CDD) Director Aubrey Harbin relayed the hearing is a property rezone request from Multifamily Residential Medium Density (MFR-M) to Downtown District (DD). She explained that the property displayed before Council lies within their Downtown District boundary. She stated that the long-term plan is to rezone all properties within said boundary to be rezoned. She noted this request complies with the city's future land use map, the required notices were given, and the Planning and Zoning Commission approved it unanimously. City Council Regular Meeting February 3, 2025 Page 5 of 13 Mayor Pro Tem Matranga announced the following citizens had signed up to speak: • Mr. Troy Kennedy, the applicant, spoke on behalf of the property owner and voiced his support for the change as it meets Downtown District (DD) guidelines and aligns with the 2008 program. and • Ms. Tracine Poti spoke to oppose the change. She said the drawings in the agenda packet are inaccurate and will negatively impact her property. She mentioned issues with drainage, traffic, and construction. At 6:01 P.M., with no one else desiring to speak, Mayor Pro Tem Matranga closed this public hearing. B. Consider an ordinance regarding a proposed zone classification change for property located at 311 Laurel, 0.289 acres of land, more or less, being a part of Lot 16 of the Harvey and Stout Subdivision of Lots 6, 7, and 8, Block 2 of Friendswood Subdivision of the Sarah McKissick or J.P. Williams League of Land, Friendswood, Galveston County, Texas, to change from Multi - Family Residential -Medium Density (MF'R-M) to Downtown District (DD). Councilmember Erenwert asked what would be built on the rezoned property. Community Development Department (CDD) Director Aubrey Harbin answered that a mixed -use development was planned in compliance with Downtown District (DD) regulations. Councilmember Griffon questioned the zoning history of the property and the mapping overlay error, as pointed out in the public hearing by a citizen. Ms. Harbin explained that the overlay is a visual error from the aerial maps and will not affect the citizen's private property. Further discussion ensued over what would be permitted under a "mixed -use" development and the processes it would take to get those developments approved. A motion was made by Councilmember Branson and seconded by Councilmember Griffon approving Ordinance No. 2025-04, related to Item 7.b., as submitted. ORDINANCE NO.2025-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF FRIENDSWOOD TO CHANGE THE ZONING CLASSIFICATION OF PROPERTY LOCATED AT 311 LAUREL DRIVE, BEING 0.289 ACRES OF LAND, MORE OR LESS, BEING A PART OF LOT 16 OF THE HARVEY AND STOUT SUBDIVISION OF LOTS 6, 7, AND 8, BLOCK 2 OF FRIENDSWOOD SUBDIVISION OF THE SARAH MCKISSICK OR J.P. CITY MANAGER'S REPORT A. Present and update regarding the winter storm event. City Manager Morad Kabiri reported that the past winter storm, on January 201h through the 22nd, produced approximately 2.5 to 3.5 inches of snow. Friendswood maintained power throughout the event, and he commended the first responders and the Emergency Operations Center (EOC) Staff. B. Present an update regarding the City's Touch -A -Truck and Winter Weather Event on Saturday, February 8, 2025. City Manager Morad Kabiri announced a Touch -A -Truck event would take place on February 8dr. Residents are invited to come out view the City's Public Works, Parks, Police, and Fire trucks. C. Recognize Library Director Matt Riley for thirty-five years of service. City Manager Morad Kabiri recognized Library Director Matt Riley for 35 years of service. Mr. Riley gave a few words and thanked his family and colleagues for their support. D. Recognize Director of Engineering Jil Arias for his appointment for the newly created Small Municipalities board position at the San Jacinto Regional Flood Planning Group (SJRFPG). City Manager Morad Kabiri recognized Engineering Director Jil Arias for his recent appointment to the San Jacinto Regional Flood Planning Group (SJRFPG). E. Recognize Deputy City Secretary Raquel Martinez and CSO Administrative Assistant Linda Newsted for graduating from the Texas Municipal Clerk's Association (TMCA) certification program at the Election Law Conference held on January 23-24, 2025, and for each receiving a 2025 Texas Municipal Clerk's Certification Program (TMCCP) Seminar Scholarship in the amount of $500 to attend said event. City Manager Morad Kabiri recognized Deputy City Secreatary Raquel Martinez and City Secretary's Office (CSO) Administrative Assistant Linda Newstead for completing their Texas Municipal Clerk's Association (TMCA) certification, both receiving scholarships for their training. 9. PROPOSED ORDINANCES & RESOLUTIONS A. Consider on first reading an ordinance amending Appendix D "Schedule of Fees, Rates, Charges, Deposits, Bond and Insurance Amounts" of the Friendswood City Code to update fees for "Buildings and Building Regulations," "Peddlers, Solicitors, Canvassers and Itinerant Vendors," "Wrecker Service Towing Fees," and "Credit Card Payment Processing Convenience Fees." Community Development Department (CDD) Director Aubrey Harbin presented the fee update summary to the Council. Ms. Harbin explained that the fee schedules need a major overhaul. She stated that fees City Council Regular Meeting February 3, 2025 Page 7 of 13 will now switch to flat rates for trade permits as well as a slight increase to cover personnel time. She compared fees from other cities and showed the City of Friendswood's current fees versus proposed fees. Consider the first reading of an ordinance amending Chapter 2 "Administration," Article II "Boards, Committees and Commissions," Division 4 "Community and Economic Development Committee," Section 2-41(b) "Membership" of the Friendswood City Code to add two new positions to the committee and establishing terms of office for the newly created positions in order to effectively stagger the terms of the Committee's members. A motion was made by Councilmember Branson and seconded by Councilmember Hanks approving the first reading of the proposed ordinance related to Item 9.B., as submitted. However, there was discussion prior to the vote. The Councilmembers discussed the year -long commitment required for these roles along with the added scope. Thus, the Council agreed to move forward with expanding the Community and Economic Development Committee (CEDC) from seven to nine members. Mayor Pro Tern Matranga raised a question regarding the $2.85 million allocation for Whitcomb Terracing. City Manager Morad Kabiri explained that the funds cover engineering costs for flood mitigation. The funds will transfer from bond proceeds to the general budget.
