THAT Red Ball Oxygen Co., Inc., a Louisiana Corporation located in Caddo 3DULVK
Louisiana ("GRANTOR"), owner of the below-described property, for and in consideration of the
sum of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable consideration paid
in hand by GRANTEE herein named, the receipt and sufficiency of which are hereby
acknowledged and confessed by GRANTOR, has GRANTED, SOLD, and CONVEYED, and by
these presents does hereby GRANT, SELL, and CONVEY unto the CITY OF FRIENDSWOOD,
a home rule municipal corporation of the State of Texas ("GRANTEE"), a perpetual utility
easement in, under, over, along, upon, and across that certain tract of land, being more particularly
described in Exhibit “A,” attached hereto and incorporated herein for all intents and purposes (the
"Easement").
TO HAVE AND TO HOLD the above-described Easement, together with all and singular
the rights and appurtenances thereto in any wise belonging, together with the rights of ingress and
egress to and from the Easement for the purposes of constructing, inspecting, reconstructing,
repairing, relocating, altering, and maintaining sanitary sewer lines and related facilities, unto the
said GRANTEE, its successors and assigns forever.
GRANTOR binds itself as well as its successors and assigns, to warrant and forever defend
all and singular the Easement unto GRANTEE and GRANTEE'S successors and assigns against
every person whomsoever lawfully claiming or to claim the same or any part thereof.

10' SANITARY SEWER EASEMENT
Field notes of a Sanitary Sewer Easement (10 feet wide) situated in the Perry & Austin League,
Abstract No. 55, Harris County, Texas, being out of that certain called 9.2562 acres of land
conveyed to Red Ball Oxygen Co., Inc., as described in the deed recorded under Clerk's File No.
RP-2020-287699 of the Harris County Official Public Records of Real Property
(H.C.O.P.R.R.P.), also being out of Reserve "A", Block 1, RBO DEVELOPMENT, according to
the map or plat thereof recorded in Film Code No. 698515 of the Harris County Map Records
(H.C.M.R.), said Easement being more particularly described by metes and bounds as follows:
COMMENCING at the common north comer of said 9.2562 acres and said Reserve "A", same
being situated in the southwest right-of-way line of Beamer Road (60 feet wide according to the
deed recorded in Volume 661, Page 567 of the Harris County Deed Records and the plat
recorded in Volume 3, Page 65 of the H.C.M.R.);
THENCE South 41 deg. 32 min. 44 sec. West, departing said southwest right-of-way line of
Beamer Road, along and with the common northwest line of the 9.2562 acres and Reserve "A", a
distance of 10.00 feet to the north comer and POINT OF BEGINNING of the herein described
Easement;
THENCE South 48 deg. 27 min. 16 sec. East, over and across the 9.2562 acres and Reserve "A",
10.00 feet southwest of and parallel with the southwest right-of-way line of Beamer Road, a
distance of 640.00 feet to a point in the common southeast line of the 9.2562 acres and Reserve
"A" at the east comer of the herein described Easement;
THENCE South 41 deg. 32 min. 44 sec. West, along and with said common southeast line of the
9.2562 acres and Reserve "A", a distance of 10.00 feet to the south comer of the herein described
Easement;
THENCE North 48 deg. 27 min. 16 sec. West, over and across the 9.2562 acres and Reserve
"A", 20.00 feet southwest of and parallel with the southwest right-of-way line of Beamer Road, a
distance of 640.00 feet to a point in the common northwest line of the 9.2562 acres and Reserve
"A" at the west comer of the herein described Easement;
THENCE North 41 deg. 32 min. 44 sec. East, along and with the common northwest line of the
9.2562 acres and Reserve "A", a distance of 10.00 feet to the POINT OF BEGINNING and
containing within these metes and bounds 0.1469 acre (6,400 square feet) ofland.
This Easement has not been staked on the ground. This description is based on a sketch of a 10'
Sanitary Sewer Easement prepared by The Pinnell Group, LLC; filed in job number 20-160.
