A regular meeting of the Friendswood City Council was held November 7, 1966: . 7:30 PM at City Hall. Present were Mayor Ralph L. Lowe; Councilmen Marvin L. Childers, William E. Davidson, Harry M. Hatcher, Wiley W. Murrell, and Ralph W. Somers; City Secretary Artha Wright; City Legal Advisor Ody Kent Jerden. Also present were Marie Moor, Dick Kennedy, Leon Smith, Mr-:- & Mrs. Kenneth D. Cashion, Betty Merchant, Elda Matheny, D'Eva Luthringer, Lou Wortham, Mary Acuff, Nena Cryar, Sam Tilotta, Jim Shore, Marl W. Horton, Joyce Horton, C. G. Jarris, S. R. New, Sam Nassiff, Genny Cunningham, Donna Thompson, Ray Nelson, Tom Davis, P. R. Maloney, P. L. Jacobs, G. B. Cunningham, Robert R. Jones, John Cryar, Norine Matthews, Ray Reed, T. V. (41) Approval and Correction of Minutes: October 17, 1966: Regular: approved after correction. October 24, 1966: Executive: stood approved as read. Communications from the Mayor: Mayor and Mrs. Lowe, and all the Councilmen and their wives attended the first social function of the Galveston County Mayors and Councilmen's Association, November S, in Galveston. The General Election will be held Tuesday, November 8, 1966 from 7:00 AM to 7:00 PM, at City Hall, for voters in Precinct 40. The State Highway Department reports that the plans for Choate Road paving are complete except for the layout of all utilities. 11-7-66: reg: 2 Halloween, this year, was marred only by several instances ` of the throwing of water filled balloons which did bodily damage to several of our young people. Councilman Childers agreed to work with the Police Department to formulate some legislation that will prevent further occurrences of this nature. Even though many of these pranks are done in fun, under some circumstances, they can be dangerous or harmful. Petitions and Communications: James B. Shores Friendswood Drainage District, read a letter to Mayor and Council, dated ; Re: Financial Assistance Request. (attachment #1) Councilman Childers made a motion, seconded by Councilman Murrell, that the City honor the request of the Friendswood Drainage District to underwrite the cost of mailing and the election expenses per their request; that these funds be paid back to the City if and when the money is available. Motion carried by unanimous vote. Clarification of the Cit 's Position on the Beer Situation: There was a lengthy and broad discussion of the.-,many points of . view of the residents of Friendswood and the residents of the Friendswood area concerning the selling of beer and wine in the immediate area. The City of Friendswood legally acted as an intervener in the appeal and, therefore, is the only party legally entitled to pursue further appeal. The businesses of the area under the chairmanship of J. R. May have pledged their financial support of further appeal efforts. Councilman Davidson made a motion, seconded by Councilman Murrell, that the City pursue the appeal of the issuance of a Beer and Wine Retailer License to Stop N Go Market (FM 518) in the Court -2- 11-7-66: reg: 3 of Civil Appeals {Cause # ) ; that the cost of the further action be born by:_;J. A. May and Associates. Motion carried by unanimous vote. Mayor Lowe approved wholeheartedly of this council action. Fi$ Bowl - Bpnefi�me: On Tuesday, November 15, 1966, 6:30 PM, the Baby Oilers of Houston and the Friendswood 8th grade team, which is undefeated, will play a benefit football game. All proceeds will be donated to the Friendswood Volunteer Fire Department, for rescue and salvage equipment. On Tuesday, November 8, 1966, 6:00 - 6:30 PM, there will be a meeting of all interested citizens in front of City Hall: purpose- a rally to start program of selling donation tickets by firemen, students, citizens, etc. Councilman Davidson made a motion, seconded by Councilman Murrell, that the City of Friendswood waive the last water bill of the Maul. Stapp family, whose home burned down last month. Motion carried by unanimous vote. Discussion ofW.C. & I .D. #21: There was discussion by all present concerning the facets of annexation, the recently defeated bond issue of the district, water rates, tax ratios, etc. Special Committees: Beautification: Councilman Murrell reported that there was no meeting in October; that October was cleanup month; and he thanked all those who assisted in this project. especially Mrs. Jean Welch for her preliminary work, and programming of clean-up time. -3- 11-7-66: reg: 4 Gas: Councilman Somers reports that since the Gas Committee had submitted their report October 17, 1966, which recommended investigation of a municipally owned gas system, he has written to thirteen cities in Texas who own their own gas systems asking for their experience and possible recommendations. Personnel: Councilman Hatcher reports that the personnel policy is about three- fourths compl.ete,,.::.and should be finalized at the workshop, November 14, 1966. Bids: Lori Woods Fire Hydrant: Bids were opened.- Mora Construction Co. 651.00 Brown and Hoot no bid i Councilman Davidson made a motion, seconded by Councilman Murrell, that we accept the bid from Mora Construction Co. for $651.00 for complete installation of Fire Hydrant in Lori Woods; providing contractor agrees to all terms of the bid specifications; that payments be made only upon satisfactory completion of the contract. Motion carried by unanimous vote. Standing Committees and Departmental: Fire Department: Councilman Hatcher made a motion, seconded by Councilman Somers, that the City Legal Advisor be authorized to prepare an ordinance, for enactment, concerning Fire Department and emergency vehicles. r Motion carried by unanimous vote. Finance: Councilman Davidson reports that we must watch our spending very -4- 11-7-606: reg: 5 carefully for . the rest of the year. It was agreed, however, that the probability of our comprehensive plan being approved by the State and work being initiated this year is now very remote . Accordingly, Councilman Davidson made a motion, seconded by Councilman Somers, that $1,000 be transfer•r•ed from G & A Miscellaneous to Streets, et al, to be utilized as Council sees fit . Motion car•r•ied by unanimous vote. Garbage : There was discussion of Mr.Saund-`ersl request to solicit commercial accounts for• garbage collections . Councilman Hatcher "because of Mr•. Barton' s five year, garbage contract with the city; and because he has given satisfactory service, I recommend Mr•. Saunders not be given consideration until the expiration of Mr. Barton ' s five year contract, at which time he may make b.id. " Councilman Hatcher made a motion, seconded by Councilman Murrell, that we deny Mr. Bobby Saunders ' request to solicit commercial garbage/trash accounts at this time . Motion carried by unanimous vote. Health and Welfare : Councilman Hatcher• reported that letters have been written to several people requesting compliance with our ordinance which requires connecting to City Sewer System. If compliance is not forithQoming, the County Health Department will be notified for further action. Streets, et al: Councilman Somers reports that the patching program is progressing. Councilman Somers read two letters to Leon Brown, dated November• 1, 1966. Re : Castlewood Street; Re : Streets in Imperial Gardens . (Attachments #2 & #3) -5- 11-7-66: reg: 6 Councilman Hatcher reports that he has talked to J. A. May about overflow of effluent into open ditches. By next year they hope to improve this situation, possibly by a choke overflow line into sewer system and air stack. Friendswood Forest Sewera&e: Councilman Childers asked for further consideration of sewerage service to Friendswood Forest. There is sewerage in ditches now which could become a serious health hazard. There was discussion of the necessary steps needed to obtain matching funds for such a project. If lines are sized to handle an additional 70%, we could be eligible for retroactive participating funds. Councilman Childers made a motion, seconded :by Councilman Davidson, that the city authorize the City Engineer to lay out final plans to serve Friendswood Forest/Leisure Lane with sewerage service as part of the Master Sewer Plan for Friendswood; that the engineering cost of this will be born by future grant. Motion carried by unanimous vote. Ordinances and Resolutions: Councilman Childers made a motion, seconded by Councilman Somers, that we authorize City Legal Advisor to prepare an ordinance for enactment setting forth a Master Speed Limit Plan. Motion carried by unanimous vote. An ordinance on Conflict of Interest will be ready for first reading November 28, '1966. An ordinance on Initiative and Referendum was discussed based wholly on the National Municipal League Model City Charter, 6th edition. Water Cooler -6- Ze��ll-7-66: reg: 7 Councilman Childers made a motion, seconded by Councilman Davidson, that A.rtha Wright be authorized to pursue purchase of the water cooler we are now leasing as per letter from Puro Filter Corporation. (attachment .- ) Councilman Somers reported that he had attended a meeting of the Clear Creek Basin Authority earlier this evening; that he had indicated to that group that Friendswood was most interested in participation in their program. The Clear Creek Basin authority was invited to send a representative to meet with the Friendswood City Council, and they did accept the invitation, date pending. Warrant;; Approval : Councilman Somers made a motion, seconded by Councilman Childers, that Warrants #2697 through #2728; and #1180 through #1214 be approved. Motion carried by unanimous vote.
