R2025-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, DELEGATING AUTHORITY TO THE CITY MANAGER IN ACCORDANCE WITH SECTION 2269.053 OF THE TEXAS GOVERNMENT CODE TO SELECT DELIVERY METHODS FOR PUBLIC WORK CONTRACTS WHICH PROVIDE THE BEST VALUE FOR THE CITY AND TO TAKE OTHER ACTIONS AUTHORIZED OR REQUIRED BY CHAPTER 2269; AND PROVIDING AN EFFECTIVE DATE. ****************************************************************************** WHEREAS, the City of Friendswood is a home-rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council has an ongoing goal of seeking the best value for the expenditure of City monies; and WHEREAS,Chapter 2269 of the Texas Government Code provides for alternative delivery methods,other than traditional competitive bidding,for contracts for construction of certain public works and facilities; and WHEREAS, in addition to competitive bidding, alternative delivery methods under Chapter 2269 include the competitive sealed proposal method, the construction manager-agent method, the construction manager-at-risk method, the design-build method, and the job order contracting method; and WHEREAS, in order to consider construction contracts using such an alternative delivery method, the City Council or its designee must, before advertising, determine which alternative method provides the best value for the City; and WHEREAS, Section 2269.053 of the Texas Government Code permits the City Council to delegate its authority under Chapter 2269 to a designated representative; and WHEREAS, the City Council desires to delegate its authority to the City Manager to determine which alternative delivery method provides the best value for the City for such construction contracts;NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDS WOOD, STATE OF TEXAS: Section 1. That the facts and recitations set forth in the preamble of this resolution be, and they are hereby adopted,ratified, and confirmed. Section 2. In accordance with Section 2269.053 of the Texas Government Code, the City Council hereby delegates to the City Manager the authority to determine which delivery method for a public work project under Chapter 2269 provides the best value for the City. Section 3. Except as provided in Section 5, the City Manager is granted the authority to take all actions authorized or required by Chapter 2269 in connection with the procedures mandated for an approved delivery method. Section 4. This resolution shall constitute notice by rule of the delegation of authority to the City Manager in connection with the delivery methods authorized by Chapter 2269. Section 5. No delegation of authority under this resolution will limit the City Council's ultimate authority to select an offeror and approve a contract pursuant to Section 2269.155 of the Texas Government Code. Section 6. This resolution shall take effect immediately from and after its passage by the City Council of the City of Friendswood.
