TEMPORARY
CONSTRUCTION EASEMENT
THAT, City of Friendswood , hereinafter referred to as Grantor, for and in consideration of the
performance of maintenance of the outfall channel HCFCD Unit A115-00-00 adjoining Grantor’s
property by the Harris County Flood Control District, a body corporate and politic under the laws
of the State of Texas, hereinafter referred to as "District," does by these presents grant unto the
District a non-exclusive, temporary construction easement in, over, along, upon and across the
following described parcel or tract of land situated in the Robert Wilson, Abstract No. 88, Harris
County, Texas, hereinafter referred to as the "Property", more particularly described as:
Being a portion of a 0.4017-acre tract of land located in the Sarah McKissick
Survey, Abstract No. 549, Harris County, Texas, H.C.A.D. No. 1022300000027,
adjoining the south-east line of that certain fee tract previously conveyed from
Harris County Water Control and Improvement District #108 and Forest Bend
Homeowners’ Association to HCFCD by deed recorded in HCCF# F585938 of the
Harris County Real Property Records. Said 0.4017-acre tract of land depicted on
Exhibit “A” attached hereto and made a part hereof is for descriptive purposes only.
This temporary construction easement is for the purposes of providing the District ingress and
egress to and conducting construction activities for drainage and flood control on the District's
property. Such easement is made subject to the following:
1. This instrument does not convey title in or to any part of the Property or minerals therein or
thereunder.
2. This temporary construction easement is made subject to all prior rights or record granted
by Grantor or Grantor’s predecessors in title affecting the Property.
3. The Improvements contemplated herein will be made at the sole cost and expense of the
District, and no charge or assessment will be made by the District for installation of such
improvement.
4. The temporary construction easement granted herein shall expire 180 days from the date
of execution. Upon expiration of such easement, if the District’s use of the Property altered
the condition of the Property, the District shall, to the extent reasonably practicable, restore
the Property to the same condition as existed at the time of execution of this temporary
construction easement.
5. All activities conducted by the District pursuant to this temporary construction easement
shall be in compliance with all applicable laws. Grantor reserves for itself the reasonable
right to use the Property; provided that the reasonable right to use the Property does not
unreasonably interfere with the District's use of the Property for the purposes stated herein,
unless the prior written consent of the District is obtained, such consent not to be
unreasonably withheld, delayed or conditioned.
6. This conveyance shall be binding upon and shall inure to the benefit of the parties hereto.
