A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS, AMENDING RESOLUTION NOS. R2008-54 AND
R2008-103 TO FURTHER DEFINE IMPROVEMENTS THAT ARE ELIGIBLE
FOR INCENTIVES IN NEIGHBORHOOD EMPOWERMENT ZONE #1 AND
TO REFINE THE INCENTIVES AVAILABLE; REPEALING RESOLUTIONS
INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.

WHEREAS, on June 16, 2008, after making the requisite findings, the City Council of
the City of Friendswood created Neighborhood Empowerment Zone #1 (the "Zone") via
Resolution No. R2008-54 to increase economic development in the Zone; and
WHEREAS, the City Council amended the Downtown District Boundary via Ordinance
No. 2008-30; and
WHEREAS, thereafter, on December 15, 2008, the City Council of the City of
Friendswood expanded the Zone's geographical boundaries via Resolution No. R2008-103 in
accordance with Ordinance 2008-30 to include any current and future properties that are zoned
Downtown District (DD) within the Downtown District and made provisions for projects to be
eligible for certain incentives; and
WHEREAS, the City Council amended the Downtown District Boundary again via
Ordinance No. 2019-16; and
WHEREAS, the City Council desires to further define improvements that are eligible for
incentives in the Zone; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. That the City Council hereby amends Section 1 of Resolution No. R2008-
54, dated June 16, 2008, and Section 1 of Resolution No. 2008-103 dated December 15, 2008, to
establish the boundaries of the Zone as depicted in Exhibit "A," which is attached hereto and
incorporated herein for all intents and purposes. Furthermore, the Zone shall be automatically
expanded to include future properties that are zoned Downtown District (DD) by the City
Council.
Section 2. That the City Council hereby amends Section 4 of Resolution No. R2008-
54, dated June 16, 2008, and Section 2 of Resolution No. 2008-103 dated December 15, 2008, to
read as follows:
The City Council hereby declares that the following incentives will be
provided within the Zone:
The City shall waive one hundred percent (100%) of all applicable zone
change fees, plat fees, and site plan fees for new developments or
developments that have lost their nonconformity as further defined in
Appendix C, Subsection 6.1) of the Friendswood City Code, if such
developments:
(1) incorporate the Downtown District Amenities, found in
Appendix E of the City's Design Criteria Manual, into their
development,
(2) are used as commercial for -profit purposes, and
(3) are zoned Downtown District (DD).
Section 3. That the City Council hereby repeals Section 3 of Resolution No.
R2008-103 in its entirety.
Section 4. That Resolution Nos. R2008-54 and R2008-103 and all other
resolutions or parts of resolutions inconsistent or in conflict herewith are, to the extent of
such inconsistency or conflict, hereby repealed.
Section 5. That this resolution shall be effective immediately upon its passage and
approval.
INTRODUCED, READ AND PASSED by the affirmative vote of the City Council of the
