ORDINANCE NO.2009-11 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2008-33, PASSED AND APPROVED SEPTEMBER 22, 2008, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2008-2009, BY APPROVING `BUDGET AMENDMENT H" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2008-2009"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2008-33, the City Council of the City of Friendswood, Texas, adopted its"Original General Budget for Fiscal Year 2008-2009'; and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting; and WHEREAS, the City Council desires to amend said Original General Budget to reflect I such supplemental appropriation and/or transfer in the fiscal year 2008-2009; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2008-2009," is hereby amended as shown on `Budget Amendment II" to the. "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2008-2009" attached hereto. Said Budget Amendment II shall be attached to and made a part of such Original General i Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits"A" and`B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part i thus declared to be invalid or unconstitutional,whether there be one or more parts. Re-appropriate funds approved in fiscal year 2008 for furnishings and equipment needs for Fire Station #4. The furnishings and equipment were not purchased by year- end and were unencumbered, resulting in the Funds lapsing to undesignated general fund balance. Furnishings and equipment for Fire Station #4 living space and the apparatus bay areas have been identified and purchased by the Friendswood Volunteer Fire Department in fiscal year 2009. The City will reimburse Friendswood Volunteer Fire Department for the expenses. 2 ExxonMobil Donation. $1,000. Appropriate ExxonMobil donation for Senior Program activities. Donated funds were received on January 30, 2009. 3 Edward Jones Donation, $150. Appropriate Edward Jones donation for Senior Program events; specifically, the Valentine's Day Dance. Donated funds were received on January 21, 2009. 4 Centennial Park Field Lighting, $6,570. Re-appropriate funds authorized in fiscal year 2008 for Centennial Park field lighting. Funds were not spent and not encumbered at year end, September 30, 2008 and lapsed to undesignated general fund balance. The field lighting was installed and expensed in fiscal year 2009. Funding source for the re-appropriation will be undesignated general fund balance. 5 Movies in the Park equipment and services, $9,500. Appropriate funds for movies in the park program equipment and services. Funds will be used to purchase a projector, inflatable screen, side-by-side DVD player, cables, video switcher and movie showings license. The program will begin in fiscal year 2008 — 2009. City Council authorized the acceptance of a $6,000 donation from the Friendswood Rotary Club and the use of$3,500 from undesignated general fund balance on March 2, 2009. 6 Friendswood Link Road Engineering and Environmental Assessment Services. $69,355. Appropriate funds for engineering and environment assessment services related to the Friendswood Link Road project. The services will be performed by HDR-Claunch & Miller to position the project for potential federal funding through the economic stimulus plan in fiscal year 2009. Reimbursement funding in the amount of $34,014 is available to the City through a 2003 contract with TXDOT and will be requested by the City upon completion and payment of the services. City Council authorized the contract and the appropriation of funds from undesignated general fund balance on March 2, 2009. 7 Law Enforcement Officers Supplemental Education Grant. $871. Appropriate grant funds received for Fire Marshal's Office personnel continuing education. The grant period spans fiscal year 2008 - 2009 and the funds will be used for training and travel reimbursement for Fire Marshal personnel. The funds from the Texas State Comptroller's Office were received in February 2009. ! 8 Insurance Reimbursement. $4,192. Appropriate insurance reimbursement for damaged Friendswood Police Department vehicle. Damages occurred in a January 2009 vehicle accident. Police Department operating funds were used for the vehicle repairs. Reimbursement funds from Texas Municipal League Intergovernmental Risk Pool were received in February 2009. 9 Cowards Creek Tributary Improvements, $46,040. Re-appropriation of funds authorized by City Council in fiscal year 2008 for the City's portion of the interlocal agreement with Galveston County Consolidated Drainage District to complete the Cowards Creek Tributary Improvements project. Funds were unencumbered at the fiscal year end September 30, 2008 and lapsed to undesignated general fund balance. The final invoice for the project totaling $46,040 was received in March 2009. The funding source will be undesignated general fund balance. 10 2009 Bond Election Educational Consulting Services, $1,740. Appropriate funds for initial consulting services related to educational information for the 2009 Bond Election. On March 23, 2009, City Council approved funding in the amount of$15,000 for consulting services. However, only initial consulting services were provided and educational materials for the 2009 Bond Election were prepared by City Staff. 11 South Friendswood Sports Complex Waterline Extension, $10,330. Appropriate funds for waterline extension to the 60 acres of parkland near FM 528 and Mandale. Completion of this project results in reduced costs for utilities to the City's new sports complex. On March 23, 2009, City Council approved the use of Water and Sewer working capital as the funding source for the project. 12 Texas Office of the Attorney General Reimbursements, $1,297. Appropriate reimbursement funds received from the Texas Office of the Attorney General for assault victim examination expenses incurred by the City of Friendswood Police Department's Criminal Investigation Division in April and May of 2009. The City submitted reimbursement requests to the Texas Office of the Attorney General and funds were received in April and May of 2009. 13 Entry Sign Donation. $690. Appropriate donation for a City of Friendswood entry sign to be placed at Bay Area Boulevard and FM 528. Donated funds I from a citizen were received in April 2009. The sign was installed in May. i 14 Public Safety Building Pay Phone Vending Commission. $2,378. Appropriate funds received by the City from JCW Electronics for vending commission from a pay phone located at the Public Safety Building. The funds will be used to supplement the Police Department Patrol Division's operating supplies expenses. The vending commission funds were received in October 2008 through April 2009. 15 Police Department 800 Radio Airtime. $11,340. Appropriate funds for Police Department 800 radio airtime. Ongoing funding for radio airtime was approved in the operating budget in fiscal year 2006; but was inadvertently omitted in subsequent years. Radio airtime for Patrol Officers totals $11,340 for fiscal year 2009. The funding source will be undesignated general fund balance. 16 West Ranch Management District Legal Research Services. $5,802. Appropriate funds for legal service expenses incurred in fiscal years 2007 and 2009 for research on the financing options for development of the West Ranch Management District. The firm completed research in 2007 and did not invoice the City for the work, totaling $1,561.25, until March 2009. Additional research on the project has been provided in 2009. The funding source will be undesignated general fund balance. 17 2009 Spring Sparkle and C.A.B. Garage Sale Revenue. $325. Appropriate revenue collected by the Community Appearance Board at its 2009 Spring Sparkle and Garage Sale. Funds received in April 2009 will be used to offset the purchase of Community Appearance Board supplies purchased in February 2009. 18 Forest Bend Homeowners Association/Fire Station #3 Property Exchange, $82,000. Appropriate funds for the expenses related to the property exchange between the Forest Bend Homeowners Association and the City of Friendswood. City Council approved the execution of eminent domain proceedings regarding the land exchange in July 2008. The funding source for the purchase of the property will be undesignated general fund balance. 19 Senior Activity Center Donations, $3,048. Appropriate funds donated to the Senior Activity Center. Funds were received during December 2008 through April 8, 2009 and will be used for Senior Activity Center activities, trips and special events.
