HomeMy WebLinkAboutResolution No. 2009-28 RESOLUTION NO.R2009-28 A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON MAY 9, 2009, FOR THE PURPOSE OF ELECTING THE MAYOR AND TWO (2) COUNCILMEMBERS TO THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD; CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A SPECIAL ELECTION HELD ON MAY 9, 2009, REGARDING ONE (1) PROPOSITION RELATING TO AMENDMENT OF THE HOME RULE CHARTER OF THE CITY; AND CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD ON MAY 9, 2009, REGARDING TWO PROPOSITIONS RELATING TO ISSUANCE OF BONDS FOR PARK AND RECREATION PURPOSES AND FOR A NEW LIBRARY AND CIVIC CENTER FACILITY. * * �: * * WHEREAS, a general election was held within the City of Friendswood, Texas, on May 9, 2009, for the purpose of electing the Mayor and two(2) Councilmembers; and WHEREAS, a special election was also held within the City, on May 9, 2009, one special election regarding amendment section 4.01(a)of the City's home rule Charter; and WHEREAS, a special bond election was also held within the City, on May 9, 2009, regarding issuance of $3,100,000 in bonds for parks and recreation purposes and issuance of $6,500,000 for a new library and civic center facility; and WHEREAS, said elections were duly and legally held in conformity with the election laws of the State of Texas, and the results of said elections have been verified and returned by the proper judges and clerks; and WHEREAS, it appears that a total of 1835 votes were cast in said elections;now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. The facts and matters set forth in the preamble of this Resolution are hereby found to be true and correct. Section 2. The official canvass of the returns of the general election held on May 9, 2009, reflects that the following named persons received the number of votes set opposite their names in the respective positions to be filled: Mavor Candidate Votes Received David J.H. Smith 12�2 Councilmember-Position No. 1 Candidate Votes Received Michael E. Barker 1217 Councilmember-Position No.3 Candidate Votes Received Jim Hill 1235 Section 3. The official canvass of the returns of the general election held on May 9, 2009,reflects that the following persons were duly elected to the respective positions shown: Mavor- David J.H. Smith Councilmember-Position No. 1 - Michael E. Barker Councilmember-Position No.3— Jim Hill Section 4. The official canvass of the returns of the special election held on May 9, 2009, at which one (1) proposition was submitted to the duly qualified, resident electors of the City for their action thereon, relating to a proposed amendment to section 4.01(a) of the City's home rule Charter, reflects the number of votes cast"for" and"against" said measure as follows: PROPOSITION NO. 1 FOR THE PROPOSED AMENDMENT OF SECTION 4.01(a) OF ARTICLE IV OF THECHARTER..............................................................................................................1163 votes R2oo9-28 2 AGAINST THE PROPOSED AMENDMENT OF SECTION 4.01(a) OF ARTICLE IV OF THECHARTER................................................................................................................621 votes Section 5. The special election held within the City, on May 9, 2009, which is more fully described in the preamble of this Resolution, was called and notice thereof was given in accordance with law. Only qualified, resident electors of the City voted in the special election. Returns of the special election have been lawfully made by the proper officials. The special election has resulted favorably to the adoption of Proposed Amendment No. 1 to the Home Rule Charter of the City with a majority of the qualified voters voting at the special election having voted in favor of Proposition No. 1 submitted at such special election. Section 6. Proposed Amendment No. 1, as approved and adopted by a majority of the qualified voters voting at such special election, shall become a part of the Charter of the City, and it is hereby declared that the amendment to said Charter, as fully set out in the Resolution calling said charter amendment election, is hereby adopted. Section 7. The official canvass of the returns of the special bond election held within the City, on May 9, 2009, at which two (2) propositions were submitted to the duly qualified, resident electors of the City for their action thereon, relating to the issuance of bonds for parks and recreation purposes and for a new library and civic center facility, reflects the number of votes cast"for" and "against" each measure as follows: PROPOSITION NO. ONE FOR THE ISSUANCE OF $3,100,000 BONDS FOR PARKS AND RECREATION FACILITIES, INCLUDING NATURAL PARKS ANDATHLETIC FIELDS................................................................................................705 votes AGAINST THE ISSUANCE OF $3,100,000 BONDS FOR PARKS AND RECREATION FACILITIES, INCLUDING NATURAL PARKS ANDATHLETIC FIELDS..............................................................................................1115 votes PROPOSITION NO. TWO FOR THE ISSUANCE OF $6,500,000 BONDS FOR A NEW LIBRARY AND CIVIC CENTER FACILITY...................................................................................876 votes R2009-28 3 AGAINST THE ISSUANCE OF $6,500,000 BONDS FOR A NEW LIBRARY AND CIVIC CENTER FACILITY...................................................................................952 votes Section 8. The special bond election held within the City, on May 9, 2009, which is more fully described in the preamble of this Resolution, was called and notice thereof was given in accordance with law. Only qualified, resident electors of the City voted in the special bond election. Returns of the special bond election have been lawfully made by the proper officials. The special bond election has resulted unfavorably to the adoption of Proposed No. 1 with a majority of the qualified voters voting at the special bond election having voted against Proposition No. 1 submitted at such special election. Section 10. It is hereby found and determined that the NOTICE OF MEETING relating to the meeting of the City Council at which this Resolution was considered and the posting thereof, was proper and said notice and posting are hereby authorized, approved, resolved, ratified, and confirmed.
