FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR DAVID SMITH MAYOR PRO-TEM ANDY RIVERA COUNCILMEMBER MICHAEL BARKER COUNCILMEMBER JIM BARR COUNCILMEMBER JIM HILL COUNCILMEMBER LESLIE REID COUNCILMEMBER BILL HOLBERT CITY ATTORNEY BOBBY GERVAIS ACTING CITY MANAGER ROGER ROECKER CITY SECRETARY DELORIS MCKENZIE Mayor Smith called the meeting to order. SPECIAL SESSION ...... A discussion was held regarding Landscape Irrigation regulations. Interim Community Development Director Morad Kabiri presented information that is required by law. Discussion was held that permits will be pulled by the Plumber and that is how fines will be assessed. Council asked that notices be posted in CDD in the Permit Department, send out on groupbuilder and send out a news release. Mr. Kabiri stated the homeowner can continue to repair without a licensed irrigator and will track cost to citizens. Mr. Kabiri stated all entities are under same guidelines except those under 20, 000 population. CLOSED EXECUTIVE SESSION Council convened into Executive Session in Accordance with the Texas Government Code, pursuant to Section 551.071 — Consultation with attorney concerning pending or contemplated litigation; a settlement offer; or a matter in which the duty of the attorney requires it and Section 551.072 - Deliberation regarding real property. Council convened into Regular Session at 7:00 pm with no action taken later in the meeting. RECONVENE INTO OPEN SESSION 7:00 PM—REGULAR SESSION The invocation was given by Deacon Robison with Mary Queen Catholic Church. Mayor Smith led the Pledge of Allegiance to the United States and to the State of Texas. ,.�.�. 01/26/2009 3068 ..,. COMMUNICATIONS FROM THE PUBLIC Fred Krch, Friendswood resident, addressed Council and presented information on the environment, climate news and the greening of planet earth and also spoke on Co2 being an advantage to the world. He stated a letter was sent to him from Mayor Smith regarding his volunteer application on file and noted there are 10 volunteer committees and would like to know when he will be hearing back from the Mayor on the application, also presented an environmental advocate newsietter article on Wastewater treatment, Bill of Rights information. CITY MANAGER'S REPORT The Acting City Manager Roger Roecker recognized Deputy City Secretary Melinda Welsh on her recent certification in the Texas Municipal Clerks Certification Program. Melinda has worked very hard to complete this professional development program. It covers four courses and over 200 hours of study including municipal finance, municipai law, election law, public economics, public administration, human resource management, public and press relations, communications, office administration and municipal court administration. Melinda was also required to attend eight related seminars totaling over 100 contact hours of instruction. This is quite an accomplishment and recognizes Melinda's professional status as a Texas Registered Municipal Clerk. ACTION ITEMS **Councilmember Barr moved to approve up to $15,000 for repairs to Renwick Park with invoices '"""'" submitted by the Friendswood Little League Baseball Association. Seconded by Councilmember Hill. The motion was approved unanimously. **Councilmember Reid moved to approve the purchase of two 2009 Ford Expeditions for the Friendswood Volunteer Fire Department and expansion of the Friendswood Volunteer Fire Department fleet. Seconded by Councilmember Hill. The motion was approved unanimously. **Councilmember Reid moved to approve for the Friendswood Volunteer Fire Department (EMS Division) to trade-in Ambulance 49. Seconded by Councilmember Hill. The motion was approved unanimously. No action was taken on a discussion with the Planning and Zoning Commission on the following: A. Home Occupation regulations, Staff and Planning and Zoning Commission (P&Z) presented recommended changes, addressed the number of trips per household with 16 trips per day, number of allowed employees per home, suggested one non-family member, with enforcement by the City while homeowners association (HOA) enforces Deed Restrictions. B. Amendments to the Design Criteria Manual for Parking Group Table, Staff and P&Z presented recommended changes based on National trends, changes will be in the Design Criteria Manual and will be enforceable, addressed junk vehicles and how to clean up commercial sites that are violating the spirit of the law. C. Special Exceptions for Zoning Board of Adjustment, Council requested P& Z to review the language that is proposed by Zoning Board of Adjustment (ZBOA) giving them more latitude to grant exceptions, Council is very interested in creating this possibility to allow this authority and asking for recommendation from P&Z. Council thanked the Planning and Zoning Commission for their time and efforts for the job that they do for � the City. 01/26/2009 3069 � '`'`Councilmember Reid moved to approve creating a five member Homeowners' Association (HOA) Board as a new City Committee with responsibility to organize quarterly meetings and provide a form of communication for HOA's. Seconded by Councilmember Holbert. Councilmember Reid was asked about having the Homeowners Association (HOA) creat a board rather than a City appointed board. With a self regulating board, the City could provide a meeting space and could assist the HOA in the formation of by laws and getting organized. There are fifty three HOA's and Council is supportive of the concept. Mayor Smith stated a Council liaison position is very important to maintain and suggest having a City committee and allow the board to appoint their own members and determine the lengths of terms, all City committees have Staff liaisons and if this is a self regulating board then it would not be in a box as far as avenues of process, appointed committees are subject to an adopted policy and subject to open meetings. ***Councilmember Rivera moved to table the motion of a Homeowners' Association (HOA) Board as a new City Committee. Seconded by Councilmember Barker. The motion was approved unanimously. **Councilmember Rivera moved to approve Bid No. 2009-01 for the Deepwood Force Main Replacement and authorize the Mayor to execute the contract with BRH-Garver Construction, L.P. ***Councilmember Rivera moved to reject all bids and re-bid project with changes to the project. Seconded by Councilmember Barker. T;he motion was approved unanimously. ..,_, **Councilmember Rivera moved to approve Bid No. 2009-02 for the 16" Transmission Waterline from Sunset Drive to Sunmeadow and authorize the Mayor to execute the contract with TRCU, Ltd. Seconded by Councilmember Barr. The motion was approved unanimously. ORDINANCE "*Councilmember Reid moved to approve the First and Final reading of Ordinance No T2009-01, An Ordinance amending City of Friendswood, Texas, Ordinance No. 2008-33, passed and approved September 22, 2008, same being an ordinance approving and adopting the City's General Budget for Fiscal Year 2008-2009, by approving "Budget Amendment I" to the"Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2008-2009"; providing for supplemental appropriation and/or transfer of certain funds; providing for severability; and providing other matters related to the subject. Seconded by Councilmember Rivera. The motion was approved unanimously. COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Councilmember Barr reported on the Community Appearance Board tree giveaway and how successful it was, announced Sherry Goen the new president of CAB and stated the Fourth of July Steering Committee has already started gearing up for another spectacular festivity. Councilmember Reid reported on the surgery of the Faulk family and offered up prayers for Bryon and Carol Faulk. Councilmember Barker, Hill, Holbert, Rivera and Mayor Smith had no report. Acting City Manager Roger Roecker reported on the former City Manager Ron Cox and asked everyone — to pray for him in the passing of his mother in law. 01/26/2009 3070 ..., CONSENT AGENDA Councilmember Rivera moved to approve the Consent Agenda as presented A. Ratify and confirm the Mayor's execution of a grant application for Economic Development. B. Accept November and December 2008 Property Tax Reports. Seconded by Councilmember Hill.
