A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS, APPROVING THE SUBMISSION OF A
GRANT APPLICATION TO THE UNITED STATES DEPARTMENT OF
COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION, FOR
THE BEAMER PHASE I WATER AND SANITARY SEWER PROJECT;
DESIGNATING THE MAYOR AS THE CITY'S REPRESENTATIVE IN
SEEKING ELIGIBLE GRANT FUNDS UNDER THE ECONOMIC
DEVELOPMENT ADMINISTRATION (EDA) FOR FISCAL YEAR 2009
ECONOMIC ADJUSTMENT ASSISTANCE PROGRAM — DISASTER
APPROPRIATIONS; AGREEING TO PROVIDE APPLICABLE
MATCHING FUNDING FOR THE PROJECT, AS REQUIRED BY THE
TERMS OF THE EDA GRANT.

WHEREAS, the City Council of the City of Friendswood, Texas hereby determines that
an application for funding assistance far FM 2351 infrastructure (Beamer Phase I Water and
Sanitary Sewer Project) will be submitted for consideration to EDA, for the 2009 fiscal year; and
WHEREAS, still financially recovering from Hurricane Ike, these grant funds will help
restore, replace and expand economic activity in the region as in the best interest of the City and
its residents; and
WHEREAS, the City agrees to provide applicable matching funds for the said program
as required by the EDA grant application; and
WHEREAS, the City Council hereby further finds and determines that the person
serving as Mayor of the City is the appropriate individual to act as the City's authorized official,
and as such should be given the power to apply for, accept, reject, alter or terminate the grant on
behalf of the City, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. The facts and matters set forth in the preamble of this Resolution are
hereby found to be true and correct.
Section 2. The City Council of the City of Friendswood, Texas, hereby authorizes
and approves the submission of a grant application to the United States Department of
Commerce, Economic Development Administration for the Beamer Phase I Water and Sanitary
Sewer Project.
Section 3. The City Council hereby authorizes the Mayor to apply for, accept, reject,
alter, or terminate the grant on behalf of the City.
Section 4. The City Council hereby agrees to provide applicable matching funding
for the project, as required by the terms of the EDA grant.

Re: Letter of Financial Commitment
Dear Mr. Garza:
This is in response to your letter dated February 23, 2009, by which EDA extended a formal invitation for
our city to apply for funding assistance through the Second Supplemental Appropriations Disaster Relief
Opportunity, under the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act,
2009, Pub. L. No. 110-329, 122 Stat. 3574 (2008) for presidentially declared disasters of 2008 for the
City of Friendswood,Texas"FM 2351 Project."
Please consider this letter along with the attached Resolution R2009-13, approved by City Council on
March 2, 2009, as our financial commitment of matching funds for the aforementioned project. Through
this resolution, the City of Friendswood has allocated matching funds of $1 million from the City of
Friendswood water and sewer working capital fund for the non-EDA funded portion of this proposed
project to be matched with$2 million EDA funding assistance.

project.

and/or waste is a material representation of�fact upon which EDA relies when tnaking
and executing an award. EDA reserves the right to terminate any award made in
conjunctfon with the representations contained herein if, at any time during the useful
life of the project, EDA becomes aware of the presence of hazardous materials or
waste at the site, or that hazardous materials or waste have been inappropriately
handled there.on. � •
Further, if it is determined at any time that the presence of hazardous materials or
waste, or handling thereof, has been misrepresented, EDA majr pursue other
available legal remedies against the applicant. �
