R2008-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE, AND THE CITY SECRETARY TO ATTEST, A MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITY AND THE FRIENDSWOOD INDEPENDENT SCHOOL DISTRICT FOR ISSUES RELATING TO TRAFFIC STUDIES, PERMIT AND INSPECTION FEES, JOINT USE AGREEMENTS OF SCHOOL DISTRICT AND CITY FACILITIES, AND THE SHARING OF MAINTENANCE RESPONSIBILITIES OF CERTAIN FACILITIES. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: SECTION 1. That a Memorandum of Understanding by and between the City and the Friendswood Independent School District for issues relating to traffic studies, permit and inspection fees, joint use agreements of school district and city facilities, and the sharing of maintenance responsibilities of certain facilities is hereby approved. SECTION 2. That the Mayor and City Secretary are authorized and directed to execute and attest, respectively, the Memorandum of Understanding by and between the City and the Friendswood Independent School District in substantially the same form as is attached hereto as Exhibit "A" and made a part hereof for all purposes. Smith ATTEST: Mayor ' f101 pd OA. 4Deoris McKenzie, T C cr Oa City Secretary Exhibit A (R2008-41) CITY OF FRIENDSWOOD FRIENDSWOOD INDEPENDENT SCHOOL DISTRICT MEMORANDUM OF UNDERSTANDING Immediate Budgetary Obligations 1. Joint Traffic Study — The cost of a traffic analysis of the high school area, Centennial Park, and Stadium Drive shall split fifty-fifty between the District and the City. 2. The City shall waive all permit and inspection fees for the new District facilities constructed as part of the 2007 Bond Package. The District shall grant necessary utility easements needed to serve the City's 16- Inch Water Transmission Line Project. In exchange, the City agrees to enter into a license agreement with District to permit the expansion of the high school parking lot within the right-of-way of Mustang Dr. The District shall be responsible for the construction of the parking lot and the installation of any necessary culverts and/or drainage improvements associated with the expansion. 4. The District shall build and maintain a competition running track around a multipurpose field at Centennial Park across from the property of the proposed new Junior High School or adjacent to the football field. There is no expectation of the District to always provide a track. The track will be accessible to the City when it is not in use by the District. The City also grants land use for small bleacher seating and/or concessions if the school decides to build such. No lights will be installed by the District. Possible Future Budgetary Obligations — The City and District intend on pursuing the following as future budgets permit. 1. The District shall build tennis courts at the new Junior High, at Centennial Park, and make them available for City use when not in use by the District. If so desired by the City, the City is responsible for lighting the courts. 2. The City football field at Centennial Park may be used by the new Junior High for practice after school and for use games as needed. 3. The property on Hackney Road, if obtained by the District, may be used for baseball fields or soccer fields by the High School and be made available to the City when not in use by the District. The City shall provide parking on the adjacent property and the District shall build restrooms, concessions, and storage to serve the facility. 4. The District shall build a natatorium on a site near the High School and allow use by the City during the day, evenings, and on the weekends. The District shall have first use of the pool. The City shall share in the costs of pool maintenance on a usage or pro rata basis and supply life guards when open to the City and provide staff members for City programs.
