Ordinance No. E2008-32 AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, ADOPTING A TEMPORARY EMERGENCY CURFEW DUE TO THE EXPECTED CONDITIONS FOLLOWING TROPICAL STORMIHURRICANE IKE; AND PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF. WHEREAS, by proclamation issued September 09, 2008, the Mayor declared a state ofl disaster for the City of Friendswood as a result of the pending dangers to life and property from, Tropical Storm/Hurricane Ike; and WHEREAS, said state of disaster requires that certain emergency measures be taken pursuant to the Executive Order of the Governor Relating to Emergency Management; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The following regulations shall take effect immediately upon adoption hereof, and shall remain in effect until the state of disaster is terminated: A. CURFEW. It shall be unlawful for any person to remain or travel upon any public or private property, between the hours 10:00 pm to dawn on September 11, 2008 and dusk to dawn on September 12 and 13, 2008 , in the following described area(s), to wit: throughout the City of Friendswood. Section 3. this Subsection A shall not apply to: Section 3. a person authorized by the Emergency Management Director to assist in the production of the health, safety, or welfare of the public; or Section 3. a person who remains or travels upon private property which is owned by him or upon which the person has been invited. Section 2. Any and all emergency curfew regulations heretofore entered by the Mayor in connection with the disaster declaration of September 09, 2008, are hereby in all things approved,ratified, and confirmed. Section 3. The City Council of Friendswood hereby declares that a state of emergency — exists, and that in accordance with §3.11(b) and 3.12 of the City Charter, this ordinance is passed as an emergency ordinance,and shall take effect immediately upon passage.
