THAT the undersigned, PEAR ONE CORR6eN-, hereinafter ?-
called "Grantor, " for and in consideration of the sum of Ten
Dollars ($10. 00) and other good and valuable consideration, to it
in hand paid by the City of Friendswood, a municipal corporation of /
the Counties of Galveston and Harris, State of Texas, hereinafter
called "Grantee, " the receipt and sufficiency of which is hereby
acknowledged, has GRANTED, SOLD, and CONVEYED, and by these
presents does GRANT, SELL, and CONVEY unto the said Grantee, its
successors and assigns and legal representatives, all of that
certain 1, 652 square foot tract of land, more or less, situated in
I - Harris County, Texas, being more particularly described on Exhibit
A attached hereto and for all things made a part hereof, together
with all improvements thereon.
TO HAVE AND TO HOLD the above described premises,
together with all and singular the rights and appurtenances thereto
in any wise belonging, unto the said Grantee, its successors and
assigns and legal representatives forever. And Grantor does hereby
bind itself, its successors and assigns, to warrant and forever
defend, all and singular, the said premises unto the said Grantee,
its successors and assigns and legal representatives, against every
person whomsoever lawfully claiming or to claim the same or any
part thereof, by, through or under Grantor, but not otherwise.

This conveyance is made and accepted subject to any and
all validly existing restrictions, mineral reservations and
interests, conditions, covenants, easements and rights-of-way, if
any, applicable to and enforceable against the above described real
property as now reflected by the records of the County Clerk of
Harris County, Texas, or which may be apparent from a physical
inspection of the property.
THE GRANTEE HEREBY EXPRESSLY ACKNOWLEDGES AND AGREES THAT
THE GRANTEE HAS BEEN USING THE PROPERTY AS A LIFT STATION, AND,
THEREFORE, IS THOROUGHLY FAMILIAR WITH THE PROPERTY TO THE EXTENT
DEEMED NECESSARY BY THE GRANTEE IN ORDER TO ENABLE THE GRANTEE TO
EVALUATE THE TRANSFER OF THE PROPERTY. THE GRANTEE HEREBY FURTHER
ACKNOWLEDGES AND AGREES THAT THE GRANTEE IS RELYING SOLELY UPON THE
INSPECTION, EXAMINATION, AND EVALUATION OF THE PROPERTY BY THE
GRANTEE AND THAT THE GRANTEE IS PURCHASING THE PROPERTY ON AN "AS
IS, " "WHERE IS" AND "WITH ALL FAULTS" BASIS, WITHOUT
REPRESENTATIONS, WARRANTIES (OTHER THAN THE LIMITED WARRANTY OF
TITLE SET FORTH HEREIN) OR COVENANTS, EXPRESS OR IMPLIED, OF ANY
KIND OR NATURE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING,
THE GRANTEE HEREBY FURTHER ACKNOWLEDGES AND AGREES THAT WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE
EXCLUDED FROM THE TRANSFER HEREBY, AS ARE ANY WARRANTIES ARISING
FROM A COURSE OF DEALING OR USAGE OF TRADE, AND THAT THE GRANTOR
HAS NOT WARRANTED, AND DOES NOT HEREBY WARRANT, THAT THE PROPERTY
OR THE PROJECT NOW OR IN THE FUTURE MEETS, WILL MEET OR COMPLY WITH
THE REQUIREMENTS OF ANY BUILDING OR SAFETY CODE OR REGULATION OF

ANY OTHER AUTHORITY OR JURISDICTION. WITHOUT LIMITING THE
GENERALITY OF THE FOREGOING, THE GRANTEE HEREBY ASSUMES ALL RISK
AND LIABILITY AND INDEMNIFIES AND HOLDS GRANTOR HARMLESS OF AND
FROM ANY AND ALL LIABILITIES, CLAIMS, DEMANDS, AND EXPENSES, OF ANY
KIND AND NATURE, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND
ATTORNEYS' FEES AND AGREES THAT THE GRANTOR SHALL NOT BE LIABLE FOR
ANY SPECIAL DIRECT, INDIRECT, CONSEQUENTIAL, OR OWNERSHIP, USE,
CONDITION, LOCATION, MAINTENANCE, REPAIR, OR OPERATION OF THE
PROPERTY AFTER THIS DEED. WITHOUT LIMITING THE GENERALITY OF THE
FOREGOING, THE GRANTEE ACKNOWLEDGES THAT THE GRANTOR HAS MADE NO
WARRANTIES OR REPRESENTATIONS REGARDING THE ENVIRONMENTAL CONDITION
OF THE PROPERTY; AND GRANTEE HEREBY ASSUMES ALL RISK, OBLIGATION
AND LIABILITY BEFORE AND AFTER THIS DEED FOR ANY AND ALL SPECIAL
DIRECT, INDIRECT, CONSEQUENTIAL OR OTHER DAMAGES OR EXPENSES OF ANY
KIND WHICH ARE OR MAY BE ASSOCIATED WITH OR ARISE OUT OF ANY
ENVIRONMENTAL CONDITION OF THE PROPERTY.
Current ad valorem taxes on the above described property
as of the date hereof are assumed by Grantee and Grantee covenants
and promises to pay the same.IN WITNESS WHEREOF, this instrument is executed this l6
