TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in any wise belonging, unto the said Grantee, its successors and assigns and legal representatives forever. And Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend, all and singular, the said premises unto the said Grantee, its successors and assigns and legal representatives, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under Grantor, but not otherwise. • 4 20C 590319 This conveyance is made and accepted subject to any and all validly existing restrictions, mineral reservations and interests, conditions, covenants, easements and rights-of-way, if any, applicable to and enforceable against the above described real property as now reflected by the records of the County Clerk of Harris County, Texas, or which may be apparent from a physical inspection of the property. THE GRANTEE HEREBY EXPRESSLY ACKNOWLEDGES AND AGREES THAT THE GRANTEE HAS BEEN USING THE PROPERTY AS A LIFT STATION, AND, THEREFORE, IS THOROUGHLY FAMILIAR WITH THE PROPERTY TO THE EXTENT DEEMED NECESSARY BY THE GRANTEE IN ORDER TO ENABLE THE GRANTEE TO EVALUATE THE TRANSFER OF THE PROPERTY. THE GRANTEE HEREBY FURTHER ACKNOWLEDGES AND AGREES THAT THE GRANTEE IS RELYING SOLELY UPON THE INSPECTION, EXAMINATION, AND EVALUATION OF THE PROPERTY BY THE GRANTEE AND THAT THE GRANTEE IS PURCHASING THE PROPERTY ON AN "AS IS, " "WHERE IS" AND "WITH ALL FAULTS" BASIS, WITHOUT REPRESENTATIONS, WARRANTIES (OTHER THAN THE LIMITED WARRANTY OF TITLE SET FORTH HEREIN) OR COVENANTS, EXPRESS OR IMPLIED, OF ANY KIND OR NATURE.
