R2008-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, EXPRESSING SUPPORT OF A PROPOSED DICKINSON BAYOU CLEARING AND DE -SNAGGING PROJECT — PHASE 2 FOR FISCAL YEAR 2009. WHEREAS, the Dickinson Bayou Watershed is a major drainage artery that drains 95.5 square miles of land in Galveston, Harris and Brazoria Counties and includes the jurisdictions of four (4) drainage districts and seven (7) cities; and WHEREAS, in 1992, pursuant to the Interlocal Cooperation Act, Chapter 791, et. Seq., Texas Government Code, and amended (the "Act"), the City of Friendswood and other cities, counties and special districts of the State of Texas entered into an interlocal agreement regarding governmental functions and services as set forth in the Act; and WHEREAS, the parties to the Agreement recognize that Dickinson Bayou is a unique regional resource that provides outfall drainage capacity in the heart of a growing Metroplex; that local governments are responsible for the overall health, safety and welfare of their citizens and thus must take the lead as stewards of flood plains in the Dickinson Bayou Watershed; and that actions of upstream and downstream communities within the Dickinson Bayou Watershed directly affect each other such that individual local goals for flood protection and abatement, drainage, transportation, greenway establishment and protection, waste management, conservation and development can only be achieved through cooperative management of the Dickinson Bayou Watershed; and WHEREAS, the parties to the original Agreement understand that entering into the Agreement in no way obligated any party to implement any project recommended from any planning studies and that separate agreements may be negotiated and executed in that regard; and WHEREAS, the Dickinson Bayou Watershed Steering Committee (DBWSC) in execution of its assigned duties per the Agreement has previously contracted for professional studies and implementation of a Dickinson Bayou — Clearing and De -Snagging Project, Phase 1 for certain areas above the tidal reaches of Dickinson Bayou; and WHEREAS, the DBWSC has proposed for FY 2009 a Dickinson Bayou — Clearing and De -Snagging Project Phase 2 for reaches upstream of the current Phase 1 project, and has established a proposed pro-rata budget which is attached as Exhibit "A"; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. The facts and opinions in the preamble of this Resolution are true and correct. Section 2. The reaches of Dickinson Bayou to be addressed by the proposed Dickinson Bayou — Clearing and De -Snagging Project Phase 2 are largely within the city limits of League City but will improve upstream drainage due to the removal of the overgrowth of vegetation in these reaches. Section 3. The proposed FY 2009 for the Dickinson Bayou — Clearing and De -Snagging Project Phase 2 budget, as shown on Exhibit "A", is a fair and equitable distribution of project costs. R2008-51 2 Section 4. The combined share of the project for the City of Friendswood and the Galveston County Consolidated Drainage District is $48,806.00, which is 7% of the total project cost as determined by our combined area in the Dickinson Bayou Watershed area. The City's portion of the 7% cost is approximately $13,945.00. Section 5. City staff has requested $13,945.00 to be budgeted in the FY 2009 budget as the City's share of the project. Section 6. The City of Friendswood affirms its support of the FY 2009 Dickinson Bayou — Clearing and De -Snagging Project Phase 2 and budget as presented. The total area of the Dickinson Bayou Watershed is 61,141 acres for the purposes of these calculations. 2. The "Pro -rats Area, is the area of responsibility for each entity within the Dickinson Bayou Watershed taking into account overlapping jurisdictions, . Responsibility, is shared between overlapping jurisdictions as follows: a. Unincorporated county area within drainage districts assigned .to county at 40% and to drainage district at 600/a. : b. City area within drainage districts assigned to the city at 60% and to drainage district at 40%. 3-. The "Participation Percentage" is the actual percentage rounded up to the nearest whole number. The minimum for participation was set at I% per agreement between prospective member entities.
