HomeMy WebLinkAboutResolution No. 74-?? - BOND ELECTION CANVASS THE STATE OF TEXAS 0 COUNTY OF GALVESTON 0 CITY OF FRIENDSWOOD 0 On this, the 8th day of April, 1974 , at '7 :30 o' clock P M. , the City Council of the City of Friendswood, Texas , convened for a special meeting in the City Hall within said City , which meeting was at all times open to the public , and the roll was called of the duly constituted officers and members of said City Council, namely: RALPH L. LOWE MAYOR MILTON L. WINDLER COUNCILMAN WILLIAM B. PATTON, SR. COUNCILMAN RALPH G. GONZALES COUNCILMAN EDWARD 0. ZEITLER COUNCILMAN BENNY BAKER COUNCILMAN RICHARD L. HAKEN COUNCILMAN . AND BOBBIE C . HENRY CITY SECRETARY and all of said persons were present with the exception of the following: None , thus constituting a quorum. Whereupon, among other business, the fol- lowing was transacted at said meeting : A written resolution CAN- VASSING THE RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION was introduced for the consideration of the Council and read in full. It was then duly moved and seconded that said resolution be adopted; and, after due discussion, said motion, carrying with it the adoption of said resolution, prevailed and carried by the fol- lowing vote : . • AYES: All members of said City Council shown present above voted "AYE" ; NOES: None . A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN SAID CITY ON THE 6TH DAY OF APRIL, 1974 . 7F****7e****9F******* **** F9'******** r*3;yE*:Fir***k7F*a:7:*7ek9c3:*******:4** WHEREAS, there came on to be considered the returns of a bond election duly and legally held in the City of Friendswood, Texas, on April 6, 1974, at which election there were submitted to all resident qualified electors of the City of Friendswood, Texas , who own taxable property in said City and who have duly rendered the same for taxation, and to all other resident qualified electors of said City, voting separately, for their action thereupon, the following proposition, to-wit : PROPOSITION • "Shall the City Council of the City of Friendswood, Texas , be authorized to issue bonds in the principal amount of SEVEN HUNDRED THOUSAND DOLLARS ($ 700 ,0.00 ) , for the purpose of constructing permanent street improvements in said City; said bonds to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than forty (40) years from their date ; and any is- sue or series of said bonds to bear interest per annum , (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Coun- cil of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds ; and shall the City Council be authorized to - levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said ' bonds as the same accrues , and to create a sinking fund sufficient to pay the principal thereof as the same matures , as authorized by the Constitution and laws of the State of Texas?" , WHEREAS, this City Council has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to this City Council by the Judges and Clerks holding said election; said poll lists and official election re- turns showing separately the votes cast in said election by all those resident qualified electors of said City who own taxable pro- perty therein and who have duly rendered the same for taxation, and the votes of all other resident qualified electors of said City , voting separately in said election; and WHEREAS, from said returns, this City Council hereby af- firmatively finds that there were cast in said election by those voters who were resident qualified electors of the City of Friends- wood, Texas, who owned taxable property in said City which had been duly rendered for taxation, the following votes FOR and AGAINST the proposition submitted as follows , to-wit : FOR the issuance of AGAINST the issuance 700 ,000 of $ 700 ,000 Street Improvement Street Improvement Bonds and the levy and Bonds and the levy and pledge of the tax in pledge of the tax in payment thereof, as payment thereof, as submitted in the submitted in the POLLING PLACE Proposition. Council Chambers City Hall 294 votes 200 votes Cafeteria, Junior High School Campus 246 votes 129 votes Absentee Poll 45 votes 20 votes TOTAL 585 votes 349 votes and WHEREAS, from said returns , this City Council hereby af- firmatively finds that there were cast in said election by those voters who were otherwise resident qulaified electors of said City, that is , by those persons who were resident qualified electors of said City but who did not meet the requirement of owning taxable property in said City which had been duly rendered for taxation, the following votes FOR and AGAINST the proposition submitted as follows, to-wit : FOR the issuance of AGAINST the issuance $ 700 ,000 of $ '700 ,000 Street Improvement Street Improvement Bonds and the levy and Bonds and the levy and pledge of the tax in pledge of the tax in payment thereof, as payment thereof, as submitted in the submitted in the POLLING PLACE Proposition. Council Chambers City Hall 57 votes 20 votes Cafeteria, Junior High School Campus 29 votes 7 votes 6 3 Absentee Poll votes votes TOTAL 92 votes 30 votes and WHEREAS, this City Council hereby affirmatively finds that there were cast in said election by both classes of voters voting in said election, in the aggregate, FOR and AGAINST the proposition sub- mitted, the following votes, all being cast by persons who were legally qualified resident electors of the City of Friendswood, Texas, as follows, to-wit : FOR The issuance of $ 700 ,000 Street Improvement Bonds and the levy and pledge of the tax in payment thereof, as sub- mitted in the Proposition. 677 votes AGAINST The issuance of $ 700 ,000 Street Improvement Bonds and the levy and pledge of the tax in payment thereof, as sub- mitted in the Proposition. 379 votes NOW, THEREFORE, BE IT FOUND AND DECLARED AND BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS : I . That a majority of the resident qualified electors of the City of Friendswood, Texas, who owned taxable property in said City and who had duly rendered the same for taxation, voting in said elec- tion, having voted FOR the authorization and issuance of $ 700 ,000 of General Obligation Bonds to construct permanent Street Improvements in said City and the levy of the tax in payment thereof as submitted . , . r in the Proposition, and that a majority of all those persons voting in said election, both those persons who were resident qualified electors of said City who owned taxable property in said City which had been duly rendered for taxation and those persons who were other- wise resident qualified electors of said City but who did not meet the requirement of owning taxable property in said City Which had been duly rendered for taxation, having voted FOR the authorization and issuance of said $ 700 ,000 of General Obligation Bonds o construct permanent Street Improvements in said City and the levy of the tax in payment thereof as submitted in the Proposition; the City Council of said City hereby determines that it is accordingly authorized to issue said bonds in accordance with the authority granted in said Proposition and with law. II The public importance of this measure and the pressing need of the City to obtain funds for the purposes described in the foregoing proposition, for the immediate preservation of the public peace , health and safety of the citizens of Friendswood, Texas , con- stitute and create an urgent public necessity requiring that this ordinance be passed and take effect as an emergency measure , and this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage .
